Cayden Berryman who was just shy of six months old, are scheduled for Friday, April 3. Berryman had a twin brother and two sisters.

The sheriff’s office and the N.C. State Bureau of Investigation (SBI) immediately began an investigation into the death, as per protocol. The infant was sent for an autopsy, with the sheriff’s office receiving preliminary results. Hill said the coroner’s office ruled the death a homicide.

Hill also said he knows the cause of death but can’t release that information until the official autopsy result is received.

Hill said the death has been difficult for the sheriff’s office, especially since April is child abuse prevention and awareness month. The sheriff’s office and department of social services (DSS) had just marched at Stearns Park on Wednesday for child abuse awareness.

“Everybody needs to think about the life of this child,” Hill said. “He never had a chance.”

Jackson has a lengthy criminal record, according to Hill, but Hill said he can’t yet release the details until Jackson’s background is confirmed.

“What’s disturbing is this individual had a prior record,” Hill said. “If he would have been where he should have been, in my opinion, this child would still be alive.”

POLK COUNTY, N.C. -- A man charged in the death of his 5-month-old nephew made his first court appearance in Polk County Monday.

Jeremiah Jackson, 31, is charged with second-degree murder in the infant's death. That bears a maximum sentence of life in prison without parole.

Law enforcement says Jackson has a previous criminal record spanning several states, with charges that include statutory rape and child abuse.

Jackson is being housed in the Transylvania County jail under a $200,000 secured bond.

His next court date is a probable cause hearing, set for April 15.

There is a video that describes, that Cayden's parents had gone out to dinner and when they returned Cayden was unresponsive...they are the ones that called 911.
 
The baby’s father has said that on Monday, March 30, he and the baby’s mother left their twins in Jackson’s care. When the couple returned home, they found Cayden not breathing. CPR was performed while 911 was called and emergency crews rushed the baby to St. Luke’s Hospital where he later died.

Investigators say Jackson has an extensive criminal record in several states, including a charge of statutory rape, a child abuse conviction, fraud, drug convictions and currently has a communicating threat charge pending in court.

“Anytime you see statutory rape, it’s a serious offense and especially when you see a previous child abuse,” said Det. Randall Hodge with the Polk County Sheriff’s Office on Monday. “Both of them are serious matters and that’s why we’re hoping to find out the details about those two incidents to try to put together if it’s a pattern or if it’s isolated incidents about his behavior.”

Did the parents know he had a previous conviction for child abuse?
 
What the h&LL is wrong with people? Why, why, why, would you leave your defenseless infant in the care of a waste of flesh with a criminal background??? Whether they knew about the previous crimes against children or not (I believe they KNEW). I swear, we need to make people take a test and get a license before allowing them to have children. Rights, my butt. Where are the rights of these babies????

A Mill Spring was sentenced to more than nine years in prison after he pleaded guilty to one count of voluntary manslaughter in the death of 5-month-old Cayden Berryman on March 30, 2015, District Attorney Greg Newman announced

Superior Court Judge Mark Powell sentenced Jeremiah Lee Jackson, who was indicted for second degree murder and agreed to plead to the manslaughter charge.

“The defendant stated in open court that he did not immediately call 911 because he panicked. Mr. Jackson has a history of both drug abuse and mental illness issues and was unsuited to watch these children,” Newman said n the release.

“The difference between the original charge and the manslaughter charge is whether we could prove that he acted with malice toward the child. I am satisfied that we have achieved a just result. It is significant that Jackson came into court and admitted his guilt."

Polk County Sheriff’s Office Capt. B.J. Bayne, who worked the case, said these types of cases are always difficult.

“These type cases are always hard,” said Bayne, “especially when the victim is an innocent baby. The punishment never seems to fit the crime. The only solace the community can take from this is knowing the offender will serve prison time.”
