DC - Family of attorney who lay dying in Metro for 4 days launch $25m lawsuit

Family of 35-year-old Washington attorney Okiemute Whiteru, who lay dying for four days after falling from the escalator at Judiciary Square station in 2013, is seeking $25 million from the Washington Metropolitan Area Transit Authority.

The lawsuit alleges that despite the fall being recorded on surveillance cameras, and staff witnessing the accident, Whiteru was left to slowly die behind a small wall. His death was eventually ruled an accident from blunt force trauma.

Metro officials have not commented on the lawsuit.
 
I don't know, the article says no one witnessed the fall and that video surveillance tapes are not looked at unless there is a specific reason to do so. The man was extremely intoxicated and fell backwards off a wall he sat on, down into a trough, and then rolled underneath the platform. Apparently he could not be seen from above.
 
Sounds like it may be hard for the family to prove their case. Terribly sad case.
