Jury reaches verdict in first phase of James Holmes sentencing trial

CENTENNIAL, Colo. -- Jury in the James Holmes Colorado theater shooting trial reached a verdict in the first phase of sentencing on Thursday. Jurors unanimously decided the death penalty can be considered for Holmes and will move on to the next phase of sentencing.

They said capital punishment is justified because Holmes murdered a large number of victims; caused a grave risk of death to others; committed murder in a heinous, cruel or depraved manner; and laid in wait or ambush.

One factor jurors said prosecutors did not prove was that Holmes intentionally killed a child, but the other "aggravating factors" ensure that jurors will continue to consider whether he should die for his crimes.

MOO--I do wonder if the shooter is proud that he is brought up over this recent shooting/murder??? Wonder if this is his claim to fame? (in his own mind) :thinking:

I was trying to remember just how many witnesses Def. actually got thru yesterday..They seem to have moved thru them pretty quickly..Course their testimony was pretty narrow as they were from his childhood when he was known as little Jimmy....

Wonder what he thought of hearing that as he was right back into his "frozen Mode" again...??

In Seattle a man that murdered a police officer just got life in prison with no parole.
They were seeking the death penalty.
Wonder if the same thing is going to happen here? They used his handicap (he was shot in spine and paralyzed from it---defense did say he only had 10 years left....)

"When we saw the shirt yesterday, we looked into it just a little bit from online research. That particular album and that particular song from that album can certainly be interpreted as an anti-capital punishment type of song"

Judge says he didn't notice anything on his own Judge says they'll bring the juror in, but "my sense is this is someone who apparently likes Metalica" Other juror who wants to talk to the court is 378 Phil Tenser

ok so t-shirt depicts Metallica's second album, Ride the Lighting, which depicts someone being electrocuted in teh chair. One of the songs was written about someone wrongly sentenced to death. Google the image.
