Detroit — An 11-year-old boy has been charged in the shooting death of a 3-year-old boy, the Wayne County Prosecutor’s Office announced Wednesday.

Two children were playing with a gun in a yard around 1:40 p.m. Monday in the 16000 block of Eastwood when the 11-year-old fatally shot the 3-year-old, police said.

The 11-year-old is charged with manslaughter — death by weapon aimed with intent but without malice and felony firearm...

“I cannot remember a time where we have charged someone so young with taking a life,” Wayne County Prosecutor Kym L. Worthy said in a statement. “Very unfortunately and very tragically, the alleged facts in this case demanded it. Competency hearing sought for boy charged in shooting

Detroit — A defense attorney has asked for a competency hearing for an 11-year-old boy charged with manslaughter in the shooting death of his 3-year-old brother this week.

The request was made at a pre-trial hearing Wednesday afternoon before Wayne County Juvenile Court Referee Anthony Crutchfield, who set a $5,000 or 10 percent bond for the juvenile.

According to the Wayne County Prosecutor’s Office, at about 1:40 p.m. Monday the boy and his brother were playing with a gun in a yard in the 16000 block of Eastwood when the 11-year-old fatally shot the 3-year-old, police said.

An 11-year-old Detroit boy was arrested after he allegedly killed a 3-year-old with a handgun Monday — a rare case involving a suspect so young, local prosecutors say.

The suspect has been charged as a juvenile with manslaughter (death by weapon aimed with intent but without malice) and for possessing a felony firearm, according to NBC affiliate WDIV. His bail was set at $5,000 on Wednesday, and he faces a pretrial hearing next week.

The victim — identified by his family as Elijah Walker — was shot in the face and died instantly, the station said...

JMO whoever let that child access a gun needs to be charged for the death too. Apparently it was not even an isolated incident.

Police also are investigating reports that the 11-year-old pulled a gun on a neighbor during an argument last week, the source said. Meanwhile, federal authorities are trying to trace an AK-47 assault rifle taken from the shooting scene to determine if it was used in any other crimes, the source said.

A judge has ordered a mental competency exam for an 11-year-old Detroit boy who is charged with manslaughter in the fatal shooting of a 3-year-old boy.

The boy is charged in Juvenile Court with manslaughter without malice, as well as using a firearm during a felony.

Judge Frank Szymanski on Monday ordered the exam and set a next court date in September. The boy was released on bond but must refrain from being anywhere where a gun is present or stored...

From the WDIV update:

...The older boy's mother, Kwanna Luchie, said they're sorry for what happened and that it was an accident.

"My son's not a bad child like everybody say he is. He's a good child," Luchie said.

She blames her son's father for not locking up his gun.

"He should get something, he shouldn't just walk away for free," Luchie said. "If my son have to go through this, he should too."

The 11 yr old pulled a gun on a neighbor a week ago? WHY were there still guns in the home? Didnt anyone report that? The father should be in jail , imo.

An 11-year old can decide where he lives now? If his, um, caretakers own guns, what is he supposed to do about it?

Shouldn't this be a duty for his guardians? they need to refrain from exposing him to guns.
 
I don't get it. What does "intent without malice" mean? That the 11-year-old intended to pull the trigger but without intending to harm the 3-year-old? It sounds like the 11-year-old didn't really comprehend the damage a gun could do. When he realized that Elijah was injured, he did the right thing by running and telling the little boy's mother.

Maybe they decided to charge the 11-year-old because there had been other incidents with him involving a firearm which LE responded to, so they thought he should know better than to play with a gun? But, it seems LE should have cited the father in the earlier incidents for not having the gun properly locked up and removed the boy from the home.

Pulling a gun on someone during an argument....sounds like the boy was imitating behavior he'd observed previously in an adult. He should have been removed from that environment much sooner and the owner of the gun(s) held accountable.

That parent is only concerned about himself! Why isn't he being held accountable for a this preventable tragedy???
 
I don't understand why the father is not being charged. He allowed the child to get his hands on a loaded weapon, REPEATEDLY. I guess I can see them letting him off easy the first time, but it happened again a week later---and no consequences? Even though a tragedy happened because of it. I blame the father equally if not more than the 11 yr old. I don't get it.

Glad to see charges leveled at an adult in this case. If the 11 year old minor is being charged then boy golly I feel strongly that the adult responsible for his access, not once but twice, to the weapon should be in some hot water too.
 
I am glad they are charging this father. That was totally irresponsible on his part.

Oh he is a good father.

Bryson has insisted that he had the gun locked up.

“That’s why they didn’t charge me,” he told The News earlier this month. “It was locked up. My son broke into my stuff.”

The gun was locked inside a bedroom closet, Bryson said.

“It was locked in my closet and the bedroom door was locked, too,” Bryson said. “I did the right thing. Everyone thinks I’m the bad one, but my son broke into the window and broke into the closet.”

“This guy’s a good father. He takes care of his kid. There were two adults that were present (at the home when Elijah was shot),” Barney said.

There were two adults at home and no one heard anything when the child broke a window and burglarized a closet?
