“He was caught in gunfire that he had nothing to do with. And there is nothing we can do, nothing the doctors can do, but pray,” Gov. Cuomo said after visiting Gabay’s bedside. “It is a personal, painful reminder of gun violence. And it has to stop. It just has to stop.”

I just saw this in the news. How terrible! Doesn't sound good as he was hit in the head and is in critical condition. Here is the latest report I see:

After the incident, which happened at about 3:40 a.m., Mr. Gabay was taken to Kings County Hospital Center, where police said he was in critical condition, with no brain activity.

On Monday afternoon, family, friends and government colleagues filtered through the hospital lobby. A pair of friends struggled to console Mr. McNaughton (Mr. Gabay's brother) as he sat sobbing into his phone, a Jamaican flag bandanna still tied around his neck from the celebration.

Both Mr. Cuomo and Mayor Bill de Blasio visited Mr. Gabay and his family in the hospital on Monday. Speaking to reporters on a plane to Puerto Rico, Mr. Cuomo said doctors had said Mr. Gabay had suffered inoperable brain damage.

Mr. Gabay had overcome so much in life:

Mr. Gabay grew up in public housing in the Bronx before graduating from Harvard, where he was president of the Undergraduate Council.

He told the Harvard Crimson in 1993 that growing up amid poverty and losing an older brother to drugs drew him toward politics. “I saw a lot of things that made me really rethink life and rethink what I had,” Mr. Gabay said.

Carey Gabay, 43, suffered a fatal gunshot wound to the head during the J’ouvert Festival in Crown Heights on Sept. 7, 2015.

CROWN HEIGHTS, Brooklyn —*An arrest has been made in the death of Carey Gabay, an aide to Gov. Andrew Cuomo who was shot during last year’s J’ouvert Festival in Crown Heights, according to Brooklyn district attorney’s office.

Micah Alleyne faces charges of murder, reckless endangerment and criminal possession of a firearm*in connection with the slaying, officials said. He*was arrested Thursday.

Gabay, a 43-year-old expectant father, was walking with his brother near the West Indian Day Parade route just before 4 a.m. Sept. 7, when gunfire erupted. Gabay was struck in the head and rushed to a hospital, where he died nine days later.

Kenny Bazile, 31, was arrested walking past a strip mall on Country Club Drive near Washington St. in Palm Desert about 2 p.m. for his alleged role in the Sept. 7 killing of Carey Gabay, a Harvard-educated attorney who was first deputy counsel to Cuomo&#8217;s Empire State Development Corp.

Trial begins for 4 men accused in shooting of Cuomo aide Carey Gabay

Opening statements begin in the trial of four men accused of opening fire during a J'ouvert celebration, killing an aide to Governor Andrew Cuomo.

Two juries will simultaneously hear evidence against Micah Alleyne, Kenny Bazile, Stanley Elianor and Keith Luncheon.

Carey Gabay, an administrative aide for Governor Cuomo, was hit with a stray bullet and died nine days later.

A fifth defendant, Tyshawn Crawford, agreed to a plea deal and is expected to testify against the other four.

Summations begin in trial for Carey Gabay slaying

Closing arguments got underway Monday for one of the men accused of killing Carey Gabay, a former aide to Gov. Andrew Cuomo.

The prosecution alleged Bazile and three other men, Micah Alleyne, Stanley Elianor and Keith Luncheon intentionally created a zone of violence when they opened fire. Bazile’s lawyer says he had no part of that gang war and was just trying to protect himself.

The other defendants are being tried before a separate jury.

All four men face 25 years to life in prison if convicted of murder. Meanwhile another man, Tyshawn Crawford, took a plea deal to avoid a possible life sentence in exchange for testifying against them.
 
Micah Alleyne received the maximum of 15 years in prison for manslaughter and a minimum of 15 years for criminal possession of a weapon, with five years' post-release supervision. That sentence is to be served consecutively, bringing his maximum time in prison to 30 years.

Kenny Bazile got 10 years for manslaughter and a maximum of 15 years for criminal possession of a weapon, also with five years' post-release supervision. Those two sentences are also to be served consecutively.

Stanley Elianor, who was acquitted of manslaughter, was handed a maximum of seven years for reckless endangerment.
