That Steven Gunbie sound dangerous, I hope Lance is OK..

It is really unfortunate that Mr. Gunbie, in the above-stated article, did not serve the entire 22 month prison sentence. He would still be in prison and LM would still be alive. He is missing, the car has his blood in it, and this does not end well IMO.

Man accused of murdering Lance John Murphy goes on trial

http://www.stuff.co.nz/national/89127341/two-accused-of-kidnapping-and-murdering-lance-john-murphy-to-stand-trial

A father of three was murdered on a remote hilltop with a bag over his head and his hands shackled, the Crown alleges.

The man accused of killing Lance John Murphy, 56, was his friend of 30 years.

Michael Joseph Waipouri, also known as Michael Davies, has pleaded not guilty to kidnapping and murdering his long-time friend.

His trial in the High Court at Auckland began on Tuesday.

His co-accused Steven Gunbie has pleaded not guilty to kidnapping, and assisting to help Waipouri evade arrest.

A defence lawyer has suggested that the daughter of a slain man was aware of her father's murder and agreed to help cover it up.

Christy Thompson gave evidence on Wednesday in the High Court at Auckland in the murder trial of Michael Joseph Waipouri, who is accused of killing her father Lance John Murphy...

It's alleged Murphy was shackled, bagged, put in the boot of his own car, and taken to a remote hill near Puhoi.

Waipouri later confessed to police he struck Murphy in the back of the head with a baseball bat and a branch, causing Murphy's head to cave in.

He says it was self defence.

Wow. Hadn't heard of this. Self defence my arse. I wonder why the daughter allegedly helped to cover it up. My initial thought was domestic abuse. Murphy might have privately been a violent man and members of his family or close friends finally killed him to prevent more violence. However, that doesn't condone his murder, no matter the reason. What other reasons are likely? Financial? A debt owed or criminal activity he was planning to report?

What would make a friend of 30 years finally turn on someone?

A witness in an Auckland murder trial says he didn't know who the good guy was after he found a man hog-tied to a tree and fighting for his life shortly after his friend had visited his property...

Sometime in the morning, his friend Steve Gunbie pulled up with a man who he did not know. The Crown says that man was Michael Waipouri...

The witness said Mr Gunbie and his friend headed further up the driveway to a hilltop and were gone for about 20 minutes... the witness said as soon as Mr Gunbie and his friend left the property, he and his friend Marty headed straight up the hill...

"He was making gurgling noises so I presume he was fighting to live."

He said he went and got Mr Gunbie at his home near Warkworth and brought him back. Mr Gunbie spent the day at his property but the body was still there when he left.

It took a third visit from Mr Gunbie to get rid of the body.

Crown rubbishes Auckland murder accused's claims his victim was a hitman

http://www.stuff.co.nz/auckland/89675998/crown-rubbishes-auckland-murder-accuseds-claims-his-victim-was-a-hitman

Among the claims Waipouri has made in his evidence at the High Court at Auckland was that Murphy was a hit man who had killed 10 people and was responsible for the deaths of high profile missing persons or murder victims including Wayne Henderson, Jane Furlong, and Jim Donnelly.

Waipouri said Murphy had killed his late wife, Wendi Murphy, and her mother Eileen Wilkinson, and had threatened to kill him.

Contrary to previous evidence that Murphy was a loving husband who nursed his cancer stricken wife and was grief stricken following her death, Waipouri claims Murphy gave her a lethal injection, and had spoken about her in degrading terms prior to her death.

During cross examination by Crown prosecutor Gareth Kayes, Waipouri continued his defence, labelling Murphy a "serial killer", and added an allegation that Murphy had behaved inappropriately with Waipouri's partner's children.

Heated questioning between Kayes and Waiporui continued on Wednesday morning, with Kayes saying Waipouri's evidence was "nonsense" and that he was "making it up".

Murder accused says he acted alone

Davies' co-accused, 38-year-old Steve Gunbie, is charged with helping in the kidnapping and with hiding the body.

On Tuesday, Davies, also known as Michael Waipouri, told the High Court at Auckland, Gunbie had played no part in the attack on Lance.

When questioned by Gunbie's lawyer Adam Couchman, Davies accepted he had not seen Gunbie since Christmas Day in 2011 before suddenly arriving at his mother's home in November 2015 with Lance.

Murder accused Michael Joseph Waipouri's bizarre dragon rant shocks court

http://www.newshub.co.nz/home/new-zealand/2017/02/murder-accused-michael-joseph-waipouri-s-bizarre-dragon-rant-shocks-court.html

"And that's when these ten dragon heads come out of his chest and dropped to the ground - and they vibrated towards the door, and they started to climb because the door was locked and they started to climb up three high. And by then he had opened the door and gone out and out these things went."

Waipouri told the court he had broken the news to Mr Murphy's children - who were Waipouri's godchildren.

"I said listen kids - I had no choice - I killed him. He was evil."

Waipouri's lawyers say they will call a psychiatrist to give evidence.

The last link contains brief video footage from Waipouri's testimony. Bizarre indeed

Judge rules murder accused's self defence claim can't be considered by jury

http://www.stuff.co.nz/auckland/89874926/judge-rules-murder-accuseds-self-defence-claim-cant-be-considered-by-jury

Waipouri has consistently claimed he was acting in self defence, and made a series of claims throughout the trial including that Murphy was a hitman who had killed 10 people, that he had murdered his wife and mother-in-law, that he had defrauded ACC, acted inappropriately with Waipouri's children, and that he had made threats on Waipouri's life.

Finally Waipouri told the jury he saw 10 dragons, or demons, coming out of Murphy's chest in the days before the killing, and that he heard the spirit of Murphy's late wife, who died of cancer, telling him to kill him.

On Tuesday morning Justice Anne Hinton told jurors that after hearing arguments from counsel, Waipouri's self defence claim couldn't be put before them, and that it would no longer be an issue for them to consider- though they still must return a verdict.

During his closing address afterward, Crown prosecutor Gareth Kayes told the jury that left them little to consider.

In order to return a guilty verdict the jury must be sure Waipouri killed Murphy, that he did it unlawfully and not by accident, and that he meant to.

"I suggest to you that you can be quite sure on all three of those questions," Kayes said.

A jury is expected to begin deciding on Wednesday whether Michael Joseph Davies murdered his long time friend on a remote hilltop.

Fifty-two-year-old Davies, also known as Michael Waipouri is charged with kidnapping and brutally murdering his friend of 30 years, Lance John Murphy, in Puhoi, north of Auckland, in November 2015.

Davies' co-accused, 38-year-old Steve Gunbie, is charged with helping in the kidnapping and hiding the body.

Michael Waipouri found guilty of murdering Lance John Murphy

http://www.stuff.co.nz/national/crime/89920082/michael-waipouri-found-guilty-of-murdering-lance-john-murphy

Michael Waipouri has been found guilty of the kidnapping and murder of his long-time friend Lance John Murphy.

The jury in the High Court at Auckland returned its unanimous verdict after two hours of deliberation.

Waipouri's associate, Steven Gunbie, was found not guilty on charges of being an accessory to murder, and kidnapping.

A sentencing date was set for April 12.

Outside court, Murphy's family said they had "waited a long time for today's verdict".

Murphy's sister, Shannon Murphy, said her brother was a loved husband, son, father, brother, and friend.

"He should still be with us today," she said.

"We'd like to thank the jury for their careful deliberations. We understand how difficult it would be for them."

Michael Waipouri sentenced to 19 years for murder of Lance John Murphy

http://www.stuff.co.nz/national/crime/91462147/michael-waipouri-sentenced-to-19-years-for-murder-of-lance-john-murphy

A man who kidnapped and murdered his longtime friend has been sentenced to 19 years in prison.

Michael Joseph Waipouri, 52, beat Lance John Murphy to death in November 2015 by hitting him over the head with a baseball bat and branch.

Murphy's younger sister Coralie Murphy spoke of how the murder had impacted her family.

"As for your family, I know they have a dad in jail, but they can visit you and hug you and tell you about their life," she said.

"What have we got to visit? A hole in the ground . . . some friend you turned out to be."

Justice Hinton said in her summing up that Murphy's action showed a high level of brutality and callousness.

"You began by using a bat, but then used a tree branch to deliver the killing blows, caving in Murphy's skull," she said.

"You displayed no compassion for your friend at all."

Waipouri received a minimum non-parole period of 19 years and will also serve a concurrent sentence of eight years for Murphy's kidnapping.
