Homicide looks for missing Victoria woman

Bendigo, Victoria, Australia -
A mother of four is missing from her home in regional Victoria, prompting the homicide squad to investigate the out-of-character disappearance.

Samantha Kelly, 39, was last seen around the High Street shopping strip in the Bendigo suburb of Kangaroo Flat about 3.20pm on Wednesday January 20, police say.

There are unconfirmed reports Ms Kelly was seen a number of times between that date and January 23.

"The disappearance of the mother of four is out of character and investigators would like to hear from anyone who may be able to provide details of her whereabouts," a Victoria Police spokeswoman said.

A Bendigo woman who disappeared under suspicious circumstances has been called a "doting" mother of four and may have met with foul play, police say.

Samantha Kelly, 39, was last seen near the shopping centre area on High Street in Kangaroo Flat on January 20.

She was reported missing more than two weeks later by her brother.

Detective Senior Sergeant Shane O'Connell said police were gravely concerned for her safety and believed she "may have met with foul play".

"It's out of character for Sam to go missing under these circumstances. She has four young children," he said.

"The youngest one has turned one recently and she missed that first birthday, which is very unusual.

"She dotes on those children. That's one of the reasons why we have greater concerns."

He also said police had questioned why it took so long for her to be reported missing.

"She was reported missing on February 4 by her brother. It's the early stages of our investigation and that [the delay] is an aspect we are looking into," Detective Senior Sergeant O'Connell said.

"But we haven't been able to ascertain why, at this stage, there has been such a delay."

Channel 9 just reported that she was living with the parents of the children's father. I can't believe she wasn't reported missing by them. Very suspect in my opinion. Were they covering for someone by not reporting her missing?

Complicated life and living arrangements but clear something is amiss, I wonder why people think they can get away with this kind of thing, almost like they think their explanations make sense.

No, they weren't the parents of the children's fathers. They were relatives to the children's fathers. I believe it was only discovered she was missing by others on the day of her youngest child's first birthday.

Homicide Squad Detective Inspector Mick Hughes said a person had led investigators to a dry creek bed in Shelbourne, west of Bendigo, late last night where they had located a blue tarpaulin containing what they believe to be a body.

UPDATE NOON: A 44-year-old man, a 43-year-old man and a 44-year-old woman, all from Kangaroo Flat, are being interviewed by police in connection to the disappearance of Samantha Kelly.

The housemates of Bendigo mother-of-four Samantha Kelly have been charged over her murder, more than three weeks after she vanished.

Peter James Arthur, 44, of Kangaroo Flat, appeared in an out of sessions hearing at the Bendigo police station on Friday night, charge with her murder.

Detective Senior Constable Chris Saulle opposed bail, alleging that Mr Arthur killed Ms Kelly with a hammer in her bungalow, before stealing $3690 from her bank account over five transactions.

Mr Arthur appeared at an out-of-sessions hearing in Bendigo on Friday night, where he was remanded in custody to face court on Monday.

Mr Arthur had immediately told his other housemates, Christine Lyons and Ronald Lyons, who also appeared before a bail justice, charged with one count each of accessory to murder

No need to apologise. I was probably a bit abrupt with my reply - wasn't thinking.

There was a few different untruths going round - think mostly spread by those housemates.

It's so sad that a mum's life was taken this way, and 4 young children are now without her. :(

A third housemate, who has already pleaded guilty to murder, on Friday told a committal hearing he carried out the murder but his two co-accused concocted the story about Ms Kelly’s disappearance.

Peter James Arthur, 45, appeared as a witness at the final day of a committal hearing for murder co-accused Christine Lyons, 45, and Ronald Lyons, 44, in the Bendigo Magistrates’ Court.

Christine and Ronald pleaded not guilty to murder at the end of the hearing, and will face a Supreme Court directions hearing on January 31.

Three Bendigo housemates living in a “squalid” love triangle murdered a mother in a crime unmatched in the state’s history, a court has heard.

Peter James Arthur, 44, pleaded guilty to the January 2016 murder of Samantha Kelly by bashing her head with a hammer after stupefying her with sleeping pills.

Prosecutor Fran Dalziel on Tuesday told the Supreme Court she could find no record of a similar crime being carried out in Victoria’s history.

“I’m unable to find any other case with such a motive,” Ms Dalziel said.

“It’s a heinous motive in my submission.”

Ms Dalziel said the murder was ordered by Arthur’s partner Christine Lyons, who wanted to adopt the children with her husband, Ronald.

Defence barrister Shane Gardner said Arthur came from a shockingly disadvantaged background and had difficulty forming relationships with women, falling under Mrs Lyons’ spell.

“He’s not blessed with brains ... he’s functioning in the low to average range,” Mr Gardner said.

“He is not a man blessed with looks or athleticism.”

“It’s a completely dysfunctional scenario ... a chaotic setting ... squalid,” Mr Gardner said.

Over time, Mr Gardner told the court Mrs Lyons’ attention swung back to Mr Lyons, and Arthur became desperate to please her.

“He is under some sort of psychological hold in respect of pleasing Christine,” Mr Gardner.

In a victim impact statement, Ms Kelly’s mother Vivien Kelly said she continues to be haunted by the thoughts of her daughter’s body being dumped in bushland.

“She did nothing to you, just be friends with you,” she wrote.

“I can’t call you animals because animals kill for food, not for fun, like you did to my daughter.

“How stupid did you think we were? We would have found out what you did to her, and we did, thanks to Facebook. I hope Samantha comes back and haunts you for what you did to her.”

Family members were visibly shocked when the court heard Arthur struck Ms Kelly with a hammer “six to seven times to the head, killing her”.

Michael Kelly, the brother of Ms Kelly, described the day he drove to Melbourne to collect the four children after the murder and discovery of the body in early February.

The children’s heads were shaved and they had nothing but backpacks, he said, and two of the children did not know their real names.

“The day my partner and myself picked up her babies was the hardest day as a parent and big brother,” he wrote.

“The rippling effect Samantha’s death has had will haunt them for the rest of their lives.

“She was robbed in the prime of her life, just as she was pursuing her dream of being a mother.

Arthur was called to give evidence before Justice Lex Lasry on Monday, and was asked to reflect on his actions.

He said he was sorry to the family, and he was reminded of his actions every day.

“I reflect on what I’ve done to Samantha Kelly every day, I have flashbacks, I have nightmares about what I’ve done nearly every night,” Arthur told the court.

“If i had a chance to go back in time and have my chance not to do it, I would not do it. It’s something I regret doing every day.

A central Victorian man who viciously bashed his housemate to death with a hammer as part of a plot to take custody of her four children has been sentenced to 16 years' jail.

Justice Lex Lasry described the murder as "vicious, calculated and planned".

He said Arthur was somewhat blinded by his devotion to another woman who allegedly wanted Ms Kelly dead so she could take her four young children – aged six, five, four and 11 months – because she could not have children of her own.

"[The other woman] was the architect of this murder and she was the one who had something to gain," Justice Lasry said.

She has pleaded not guilty to the murder and faces a trial in October.

Another alleged accomplice – who the woman was also in a relationship with – has also pleaded not guilty.

Ms Kelly's brother Michael Kelly said outside court he had hoped for a longer jail term.

"We'd all like it to be life for a life ... But the sentence is what they believe to be fair and that's the way it is," Mr Kelly said.

He and his partner Danielle Stevenson – who now have custody of his sister's children – said Ms Kelly was an extremely vulnerable woman who was devoted to her children.

"She saw the good in everybody," Mr Kelly said.

Mr Kelly, who reported his sister missing, said when the four children arrived at his home interstate, they were very scared, had nothing but their backpacks and two of the girls did not know their real names.

"How do you explain what happened to Samantha?" Mr Kelly said in his victim impact statement.

"Their disabilities mean every day is a struggle in itself, and now add all the trauma and neglect that they had experienced in the days and weeks surrounding their mother's death."
