Police in the US are continuing their investigation into the death of a Limerick man who was killed in a suspected domestic disturbance at his home in North Carolina.

Jason Corbett (39), who is originally from the Janesboro area of Limerick city, was found at Panther Creek Court in Wallburg with fatal head injuries early on Sunday morning. The father of two children, moved to America four years ago after his first wife Mags Corbett died following an asthma attack in 2006. Its understood Mr Corbett was living in North Carolina with his new partner who is American and who previously worked as a child minder.

Thomas Martens, a former FBI agent, told 911 he had been “in an argument” with his son-in-law and that he had “struck him with a baseball bat”, the Irish Daily Mail reports. According to an police incident report seen by the paper, the incident was recorded as “an assault” by 911.

His wife Molly was believed to have been the main suspect but police in the US have confirmed that her father Thomas Martens (65), a retired FBI agent, is also a person of interest.

Tracey Lynch, Jason’s older sister, said she flew to the United States from Ireland as soon as she heard of her brother’s death and thought that she would get custody of the children, who were born in Ireland.

“When I got to New York, the Department of Social Services called and told me the situation had changed,” Lynch said last week.

The children were put in the care of their stepmother. Lynch said her brother’s will named her and her husband, David, legal guardians of his children should something happen to him. The will, however, was written before Corbett’s marriage to Molly. The Davidson County Sheriff’s Office has said that suspects in Jason’s death were not being sought outside of the home. Other details in the investigation have not been released, but Sheriff David Grice told the Irish Daily Mail newspaper that Molly and her father, Thomas Martens, 65, of Knoxville, Tenn., are persons of interest in Jason’s death. Neither Molly Corbett nor Martens has been criminally charged in the case. Grice told the Daily Mail that Jason was bludgeoned to death with a baseball bat.

Mr Corbett's older brother John said that Jason's second wife, Molly Martens Corbett, had tried to adopt the children but that Jason was reluctant. He said this issue had caused friction and arguments between the pair.

"Molly was trying to adopt the kids for the past two months but Jason always seemed reluctant and they did have rows about it," he said.

"She was trying to persuade Jason to adopt the kids so that they could get US citizenship," he added.

"You would think that would be a natural progression, but Jason did not want that.

A hearing for guardianship was held on Friday and a North Carolina official presiding over the case ordered on Monday that the children be taken from the care of Ms Martens.

Presiding over the case, Brian Shipwash, Clerk of Davidson County Superior Court, determined it was "in the best interest of the minor child that to appoint applicants Tracey and David Lynch, paternal aunt and uncle, as guardians of the minor child."

On foot of the order officials from the state's Department of Social Services travelled to where Ms Martens was staying with the children and removed them from her custody. The children were brought to the Davidson Department of Social Services Office in Lexington, where they waited until they were collected by Tracey and David Lynch on Monday night.

The court heard that in June and July 2013, Ms Martens, 31, told family friend Lynn Shanahan that she had sought legal advice on custody of the children in the event of a divorce.

The court also heard that in the autumn of 2014, Molly Corbett spoke to her attorney about her rights to the children.

Mr Shipman’s findings of fact in the custody case stated: “The decedent [dead person] would not consent to a step-parent adoption even though Molly Corbett expressed a desire to adopt the child.”

She (MMC) took to Facebook to express her sadness at the children returning to Ireland, writing: “I miss you every second of every minute of every hour of every day… I know you are being so strong and so brave and I am so proud of you.”

The Limerick Leader reports that Martens’ relatives also unsuccessfully tried to have messages flown to Ireland to wish Jack a happy birthday.

In the letter sent to the paper, Corbett’s parents wrote: We have struggled to comprehend and come to terms with the loss of our youngest born – a son who was a gentle, caring, ambitious child, who grew into a generous, loving and kind man greatly loved by everyone special in his life.

DAVIDSON COUNTY, N.C. — A woman and her father have been indicted in the murder of an Irish man at his Davidson County home in August 2015, according to Davidson County District Attorney Garry Frank.

Frank confirmed Monday the grand jury has indicted Molly Martens Corbett, 31, and her father Thomas Michael Martens, 65, with second-degree murder and voluntary manslaughter. They are accused of killing 39-year-old Jason Paul Corbett.

A GRAND jury in the United States has indicted the wife and father-in-law of Limerick man Jason Corbett who was killed at his home in North Carolina last August.

According to reports from US media this evening the Davidson County Grand Jury has indicted Molly Martens Corbett, 31, and her father, Thomas Michael Martens, 65, with second-degree murder and voluntary manslaughter.

“It was an extremely thorough investigation,” Davidson County Sheriff David Grice told the-dispatch.com. “We are pleased with the decision of the grand jury,” he added.

The 39-year-old's first wife Mags, the mother of his two children, J (11) and S (9), died after suffering an asthma attack in 2006.

Her widower later set up the Mags Corbett Trust, which raised tens of thousands of euro for the Irish Asthma Society.

He moved to the USA in 2011 and later married Ms Martens, who had been the children's nanny.

MURDER accused Molly Martens Corbett has been portrayed as a violent fantasist who was anxious to leave her husband but desperate to keep custody of his children.

A sister of her slain husband Jason Corbett (39) has alleged Ms Martens (32) engaged in a series of incidents involving violence against her young stepson J. Tracey Lynch also claimed the murder accused confided to a family friend she "wanted to leave Jason because she did not love him any more and did not care what happened to him".

She alleged during a court hearing that "Molly flipped out at the wedding and completely lost control and began screaming at Jason and at my husband... She threw her chief bridesmaid and her parents out of the wedding."

She is said to have been upset because a guest was allergic to some of the wedding banquet meal and went to get a McDonald's instead.

Details of the alleged admission were outlined by the deceased's sister Tracey Lynch at a court hearing last August, but could not be reported until now.

Ms Lynch's allegations were aired at a hearing held behind closed doors to decide on the guardianship of Mr Corbett's two children. Details of the alleged admission can now be disclosed after a transcript was made public by the Davidson County Superior Court.

At the hearing, Ms Lynch and her husband David successfully applied for guardianship of the children, J (11) and S (9), in line with wishes expressed by Mr Corbett in his will.

Ms Lynch argued under questioning that the children needed protection from Ms Martens, their stepmother, who, she said, had admitted to killing her brother.

However, in the 911 call, Mr Martens took responsibility for the head injuries suffered by Mr Corbett.

He said he was visiting the Corbett family with his wife Sharon when his daughter got into a fight with her husband and he intervened.

Mr Martens told the dispatcher that he hit Mr Corbett in the head with a baseball bat. He claimed Mr Corbett was choking his wife and had threatened: "I'm gonna kill her."

The call lasts 14 minutes and 27 seconds. More than half of it is taken up with the dispatcher instructing Ms Martens and her father on how to administer CPR.

In February 2008, Molly Martens, from Knoxville Tennessee, came into Jason's life; she was eight years his junior and his fourth au pair. A relationship blossomed and by 2011 Jason and Molly were engaged to be married and planned to move to America with the children.

"Molly said she couldn't stand the cold weather in Ireland and she missed her friends and her family," said Jason's friend and colleague, Morgan Fogarty, this weekend.

As the leaving date approached, Morgan noticed that Jason was not quite so enthusiastic. When Jason's travel documents got delayed, he "almost seemed to be happy" about it, he said.

The autopsy report, which will play a key part of the prosecution case at the murder trial later this year, shows he has multiple lacerations and fractures all over his head, face and body.

Extensive injuries to his left hand are thought to have been sustained as the 39-year-old Irish man made a desperate effort to shield himself from blows, along with abrasions to his right arm and hand.

According to the warrant, Thomas Martens told deputies he hit Jason Corbett with the bat after being awakened by a disturbance involving him and Molly. The warrant said Thomas Martens called the incident a "donnybrook," or an uncontrolled fight, but the detective alleged the description "was not consistent with evidence at the scene, particularly the master bedroom."

A statement from the Martens family alleges Thomas Martens acted in self-defense, and that both suspects have been cooperative. Neither suspect was injured in the incident, deputies said.

Thomas Martens and his wife--Molly's mother--were staying in a guest bedroom at the home, deputies said. Jason Corbett's two children also were in the home when investigators responded to the scene, according to the warrant.

The uncle of Molly Martens, charged with the murder of her Limerick-born husband Jason Corbett, is reportedly being investigated for attempting to gain access to Corbett’s office the day after his murder.

Mike Earnest, Martens’ maternal uncle who works for a US federal law enforcement authority called Special Inspector General for Afghanistan Reconstruction (SIGAR), is being questioned regarding alleged calls made to Corbett’s workplace, Multi-Packing Solutions, attempting to gain access to the office and telling staff he was a federal agent, Irish website Evoke.ie report.
Although Earnest denies that he is under investigation, his employer SIGAR confirmed they were investigating contact he made with MPS on August 3.

In the recorded 911 call made that night by Thomas Martens, he claims that his son-in-law was choking his wife and he thought he may have killed him as a result of allegedly coming to her defence. However, prosecutors contend that excessive force was used in the crime. They have filed a court order requesting the personnel file of Mr Martens, a former counter-intelligence operative – who was trained in the use of lethal self defence - to scrutinise his record and training during his 31-year career.

“Statements by the defendant obtained by law enforcement have suggested that the defendant is claiming self-defence of himself and of a third party.’The state’s evidence will contradict that defence and further show excessive force was used by this defendant proximately causing the victim’s death,” the order has revealed. “The state requests the defendant’s personnel file from the Federal Bureau of Investigation regarding this defendant to include any disciplinary actions taken against the defendant.” The prosecution is especially interested in courses taken in self-defence physical training, and decision-making for use of force.

Davidson County Clerk of Superior Court Brian Shipwash heard Molly Corbett's testimony in an estate hearing Tuesday to determine if she violated the consent order issued Sept. 17, 2015 that directs her or people on her behalf to only remove items from the home at 160 Panther Creek Court that belong to her.
Attorney Edward Griggs represented David Lynch, the executor of the estate of Jason Corbett, claimed that Molly Corbett or people on the behalf of her, went into the home Jan. 21 and removed items that may belong to the estate of Jason Corbett.
Molly Corbett went through an inventory of what was removed from the home and how those items were purchased.

Molly Corbett said she is now employed at a Chico’s clothing store in Knoxville, Tenn., but has been temporarily suspended because “they didn’t like that (she) was on the news.”
Molly Corbett’s lawyer, Brian Thompson, said the items removed from the house are stored in Davidson County and that Lynch’s lawyers could access them this week.
Shipwash said he will take time to consider Molly Corbett’s testimony to determine if the consent order was violated.
Molly Corbett and her father, a retired FBI agent, are out on bond and living in Tennessee.

Davidson County Assistant District Attorney Greg Brown said prosecutors and the defense have tried unsuccessfully to obtain copies of Martens’ personnel file, but they could not get copies without a court order. That was granted Wednesday by Superior Court Judge Mark E. Klass.

On January 5 a judge ordered that several items be given to the guardians.

In relation to Mags Corbett’s rings, the judge ordered that they were to be handed over to the lawyer for the estate of Jason Corbett to determine if they are the property of the estate.

The sheriff's office said the Limerick native, who was a fan of Munster Rugby and Liverpool Football Club, had died from blunt force trauma injuries he suffered during a domestic incident.
A spokesman for police said that no arrests had been made, and that "no one outside the home is being sought in this case".
"There are persons of interest within the family. We are currently still investigating and waiting for autopsy results," the spokesman said, adding that police were conferring with the Davidson County District Attorney's Office regarding the case.
 

Murder accused must return items taken from US home - Dated 9th March 2016

Molly Martens who is accused of killing her husband, Jason Corbett, has been ordered to return items she had taken from their US home after she was charged with the crime. The courts have given her 30 days to do so. It is reported that all that was left in the property following the clearout was cloths & items belonging to the children, cloths belonging to JC & items that JC had brought from Ireland.

At a hearing on February 2, Ms Martens said agents acting on her behalf took the property from the home and that the items were either gifts to her or bought by herself or her parents. She argued that the items she had bought were paid for on a credit card registered solely in her name.However, the court found that the bills arising from the card were paid for by the couple’s joint account, which mostly contained funds earned by Mr Corbett.

The court also found that there was a “high probability” money transferred by Mr Corbett to Ms Martens and her parents was the source of payment for the items she and her parents had bought. The court ruled that “immediate and irreparable injury would have resulted to… the beneficiaries of the estate” if Ms Martens was allowed to take or sell the items.
