Police confirm that 45-year-old Danny Brumfield was shot and killed outside the convention center in the early morning darkness of September 3.

A police statement says Officer Ronald Mitchell fired his weapon after he and his partner thought they heard a gunshot, and a man swinging something shiny jumped onto the hood of their patrol car. The statement issued after The Associated Press asked about the shooting says the incident was considered attempted murder of a police officer.

Brumfield's daughter and niece dispute that account. They say the officer who shot Brumfield hit him twice with a squad car before firing. Afterward, the two say the patrol car ran over Brumfield, then left his body unattended for hours until other officers arrived.

A New Orleans police spokesman says the homicide section is investigating.

Two New Orleans police officers repeatedly punched a 64-year-old man accused of public intoxication, and another city officer assaulted an Associated Press Television News producer as a cameraman taped the confrontations.

There will be a criminal investigation, and the three officers were to be suspended, arrested and charged with simple battery Sunday, Capt. Marlon Defillo said.

"We have great concern with what we saw this morning," Defillo said after he and about a dozen other high-ranking police department officials watched the APTN footage Sunday. "It's a troubling tape, no doubt about it. ... This department will take immediate action."

Sylvester Brumfield knew his brother was dead when he saw the photograph — a body in the street outside the New Orleans convention center, a little boy on a curb nearby.

He couldn’t see the body, draped in a black blanket, but the child in the camo shirt and cornrows he recognized as his brother Danny’s grandson.

Danny Brumfield, 45, originally was listed as a victim of Hurricane Katrina. But he survived the storm and flooding, and helped get his family to shelter.

Friday, New Orleans police confirmed Danny Brumfield was shot and killed by officer Ronald Mitchell about 2 a.m.

Sept. 3, in the darkness before the National Guard arrived and began evacuating the convention center.

A police statement released after The Associated Press asked about the shooting said that, moments after Mitchell and his partner heard what appeared to be a gunshot, a man jumped onto the hood of their patrol car swinging something shiny.

The four-paragraph news release termed it attempted murder of a police officer.

Sylvester Brumfield doesn’t know exactly what happened, even after talking with family members who were there and going to Louisiana for his brother’s memorial service.

But he doubts the police version. And he said his family wants answers.

“I want my brother to have justice. I don’t want these people to ruin his name,” he said. “... I don’t need these guys to use my brother to justify their wrongdoing.”

Danny Brumfield’s daughter, Shantan Brumfield, and his niece Africa Brumfield, both of whom were there and both of whom were interviewed by phone by the AP, dispute the police’s account as well.

They say the officer who shot Danny Brumfield had hit him twice with a squad car before doing so — a nudge the first time, and a heavier bump the second. That was when he leaped onto the hood and was shot, they said. Afterward, they said, the car ran over him, and other officers didn’t come to investigate for several hours.

Capt. Marlon Defillo, a New Orleans police spokesman, said he had not heard any reports about Brumfield being hit or run over. He said the homicide section is investigating the incident, and all information will be turned over to the district attorney’s office.

A former New Orleans police officer who committed perjury by lying about what happened after he shot and killed a man in the days after Hurricane Katrina was sentenced Wednesday in federal court to serve 20 months in prison. Ronald Mitchell, 35, was convicted by a jury in December of obstruction of justice and of lying years earlier in a civil deposition about the death of 45-year-old Danny Brumfield...

The lie came in a deposition tied to a federal lawsuit filed by Brumfield's widow. The family settled that lawsuit with the city of New Orleans for $400,000.

The U.S. Department of Justice probe into the Brumfield shooting followed a series of investigative reports in late 2009 by The Times-Picayune, PBS "Frontline" and ProPublica, a nonprofit newsroom. The articles found the department conducted cursory investigations of several post-Katrina police shootings, relying largely on the statements made by the officers involved, failing to talk to civilian witnesses and neglecting to collect physical evidence.
