This is the Bosma murder trial daily discussion thread. The trial daily discussion thread is for discussion of trial evidence/testimony only, not for general discussion, posts about past threads, other members, etc. Off-topic posts will be removed.

Note: Only testimony that is published through MSM reporting (articles and tweets) is allowed. Keep discussion focused on testimony as it becomes public knowledge and remember to link up to MSM reporting of same.

Any testimony that might remain under Publication Ban, and any courtroom discussion that takes place when the jury is not present, is strictly off-limits. Posts that violate a Publication Ban, or discussion when the jury is absent, will be removed.

At all times, keep in mind Websleuths TOS, so affectionately referred to as The Rules.

There will be ZERO TOLERANCE for snarky or disrespectful posts and/or subtle digs at other members. Mods will not be PMing you with explanations, you will find your post has disappeared, or that you can no longer post.

There is to be NO name calling or name variations, not even of the accused.

There is to be no BICKERING between members. A difference of opinion is NOT a TOS violation. Some will think one or both of the accused are guilty, some will think one or both are not guilty, and some will be on the fence. All of that is okay and should NOT BE ATTACKED. If you disagree, that's fine, move past the post. If a post is offensive, alert it and let the Mods review it. If you respond to the post, both the offensive post AND yours will be removed and may result in other consequences.

Other reminders for reference as we have respectful discussion in each of the daily trial discussion threads:

Abuse of the WS Alert feature can have consequences including timeout or worse. Such abuse includes, but is not limited to:

• Overuse of the alert system

• Repeatedly alerting on the same poster

• Demanding a specific outcome

• Alerting on the same post more than once

Once you have alerted on a post, please move on without discussing it, and don't question the decisions of our Administrators, Moderators or Owners, and don't expect personalized responses with explanations about a particular decision.

The principle of “innocent until proven guilty” is for the court room … it is not required that Websleuths members adhere to that principle. Members are allowed to discuss, speculate, theorize, and judge according to opinions they develop from following the specifics of the case.

If you have any questions, PM a Mod and we will be happy to assist you. The main Mods/Admin for this trial will be Bessie, Coldpizza, and sillybilly.

Good Nite from the West Coast, and Good Morning to all you early risers :)

Just a note that our thread titles have now gone one day out of synch with the Tim Bosma Trial Tweets (Clairmont, Hayes, Carter) because they have assigned April 11 (which was legal arguments only) as Day 33 while we only count trial days when the jury is sitting. I don't know why the reporters have done that now as there have been other dates with just legal arguments and they haven't assigned trial day numbers to them.

Upshot is, you'll just have go with matching up the actual dates instead of trial day #.

Colin Butler ‏@ColinButlerCBC 2m2 minutes ago
Jury is back. Andrew Milchalski still in the witness box. Smich lawyer Thomas Dungey is cross-examining. #TimBosma

molly hayes ‏@mollyhayes 2m2 minutes ago
Dungey continuing with his cross. #Bosma

Dungey asking again about video games -- Halo and Halo Wars.
by Adam Carter 11:00 AM

Halo is a first person shooter, Halo Wars is a strategy game.
by Adam Carter 11:00 AM

Michalski testified previously they would play those games.
by Adam Carter 11:00 AM

Smich used to play the game online with Millard, Michalski and co.
by Adam Carter 11:02 AM

molly hayes ‏@mollyhayes 2m2 minutes ago
Dungey asking a couple more Qs about video games. Distinguishes between halo and halo wars. #Bosma

molly hayes ‏@mollyhayes 1m1 minute ago
Establishes halo wars is more of a strategy game (building bases etc). Michalski agrees. #Bosma

Susan Clairmont ‏@susanclairmont 1m1 minute ago
Dungey is continuing his cross-examination. Back to video game called Halo. And Halo Wars. Smich was seldom at the Maplegate house. #Bosma

Lisa Hepfner ‏@HefCHCHNews 1m1 minute ago
#Smich lawyer Dungey asking again about the video games the #Millard friends played for hrs daily -- Halo.

molly hayes ‏@mollyhayes 1m1 minute ago
Dungey suggests Mark Smich was "very seldom in your presence at 5 Maplegate." Michalski agrees. #Bosma

Colin Butler ‏@ColinButlerCBC 45s45 seconds ago
Michalski agrees with the suggestion that Mark Smich was rarely at Millard's house while he lived there. #TimBosma

molly hayes ‏@mollyhayes 1m1 minute ago
Back in May 13, 2013 police statement Michalski told cops MS had been over "a few times" while he lived there. #Bosma

molly hayes ‏@mollyhayes 1m1 minute ago
He said Smich wanted to buy a skateboard. Dungey suggests Smich never played halo with them. "He definitely did sir," Michalski says. #Bosma

Susan Clairmont ‏@susanclairmont 1m1 minute ago
Police statement has Michalski referring to Smich being at the house just one time and he wanted to buy a skateboard.

Alex Pierson ‏@AlexpiersonAMP 1m1 minute ago
Dungey- Smich was seldom in your presence. Correct- michalski. He played on line. @AM900CHML #timbosma

molly hayes ‏@mollyhayes 1m1 minute ago
Michalski explains its an online game. Smich played remotely. Dungey says the only game he played was halo wars. Michalski disagrees. #Bosma

Susan Clairmont ‏@susanclairmont 56s56 seconds ago
Halo is an on-line game, so Smich played with them, although he wasn't at Maplegate house. #Bosma

So far, SS and AM are the only witnesses who provided their testimony over 3 trial days.

Colin Butler ‏@ColinButlerCBC 2m2 minutes ago
Michalski says Smich played video games with Millard's friends online, but wasn't at the house. #TimBosma

Alex Pierson ‏@AlexpiersonAMP 1m1 minute ago
Dungey seems confused about the technology that smich doesn't need to be there in person to play Halo. AM says he was. He heard his voice.

molly hayes ‏@mollyhayes 58s58 seconds ago
Now going back to the theft of the bobcat, plants...Dungey says there was also a theft Millard told AM about, of a Harley inside a trailer.

molly hayes ‏@mollyhayes 2m2 minutes ago
Michalski agrees. #Bosma

Susan Clairmont ‏@susanclairmont 2m2 minutes ago
Theft of Bobcat, plants, Harley Davidson. Millard said he stole Harley Davidson and put it inside a closed trailer.

Colin Butler ‏@ColinButlerCBC 1m1 minute ago
Michalski says Millard told him that he stole a Harley Davidson and a trailer. #TimBosma

molly hayes ‏@mollyhayes 2m2 minutes ago
Prior to meeting Millard, Dungey asks if he was into criminal activity. Michalski says he did drugs and maybe "petty theft." #Bosma

Susan Clairmont ‏@susanclairmont 2m2 minutes ago
Michalski has no criminal record. Says he has done drugs and stole stuff from convenience store when he was young. Comes from good family.

molly hayes ‏@mollyhayes 1m1 minute ago
Like from a convenience store as a kid, he says. Dungey says but not like a Bobcat. Michalski agrees. #Bosma

Lisa Hepfner ‏@HefCHCHNews 1m1 minute ago
Dungey suggests #Smich didn't play Halo with the friends because he was rarely at house, Michalski disagrees. "It's an online game, sir."

molly hayes ‏@mollyhayes 2m2 minutes ago
Michalski says he "felt safe" around Millard, when Dungey asks what happened and why it started. #Bosma

Susan Clairmont ‏@susanclairmont 1m1 minute ago
So why start stealing with Millard? "I guess I felt safe around him...Thinking you're indestructible and nothing can hurt you."

Millard told Michalski about stealing a Harley Davidson, he says. "The Harley Davidson was on a trailer and Mr. Millard told you that he stole that and the trailer?" Dungey says. "That's correct." Michalski says.
by Adam Carter 11:04 AM

"Prior to meeting Mr. Millard, were you into any criminal activity?" Dungey asks. "Not really," Michalski says. “I guess I felt safe around him … I can’t explain it.”
by Adam Carter 11:06 AM

Dungey asks what means. “Thinking that you’re indestructible and nothing can hurt you," Michalski says.
“So if you hadn't met Mr. Millard, you probably wouldn’t have gotten into stealing things?” Dungey says. “Probably not," Michalski answers.
by Adam Carter 11:07 AM

molly hayes ‏@mollyhayes 2m2 minutes ago
Michalski says he felt "indestructible...like nothing can hurt you." Because of association with Millard. #Bosma

Lisa Hepfner ‏@HefCHCHNews 2m2 minutes ago
Michalski says he didn't steal things like Bobcats before #Millard. "I guess I felt safe with him... That feeling of being indestructible"

molly hayes ‏@mollyhayes 1m1 minute ago
Dungey suggests had he not Millard he wouldn't have gotten into stealing things. "Probably not," Michalski agrees. #Bosma

Colin Butler ‏@ColinButlerCBC 1m1 minute ago
Michalski says he felt "indestructible" when he was around Millard. The accused killer made him feel that way, Michalski says. #Bosma

Susan Clairmont ‏@susanclairmont 1m1 minute ago
Millard made him feel that way. Caused through bonding with Millard. If he hadn't met Millard would he have stolen things? "Probably not."

Alex Pierson ‏@AlexpiersonAMP 2m2 minutes ago
Michalski never stole before DM. Says I "felt safe around him. I was indestructable" @AM900CHML#timbosma

Lisa Hepfner ‏@HefCHCHNews 1m1 minute ago
Dungey: "If you hadn't met Mllard you wouldn't have gotten into stealing things?"
Michalski: "Probably not."

molly hayes ‏@mollyhayes 1m1 minute ago
Michalski didn't make any money. Dungey asks if it was partly payback for all the "perks" that came w Millard's friendship. He agrees #Bosma

Colin Butler ‏@ColinButlerCBC 2m2 minutes ago
Michalski says he might never have stolen anything if had never met Millard #Bosma

Susan Clairmont ‏@susanclairmont 2m2 minutes ago
When Bobcat is stolen, Michalski was 19 or 20. Influenced by Millard.

molly hayes ‏@mollyhayes 2m2 minutes ago
Michalski was younger, Dungey says. (Yes) #Bosma

Alex Pierson ‏@AlexpiersonAMP 1m1 minute ago
Dungey- "u wouldn't have gotten into thefts if u didn't meet DM?" AM-"no" agrees it was pay back for perks. @AM900CHML #timbosma
