Criminal defense attorney says kidnapping charges against Sidney and Tammy Moorer should be dismissed

MYRTLE BEACH, SC (WBTW)- Sidney Moorer is scheduled to appear for a pre-trial hearing Monday on charges related to Heather Elvis’ disappearance.

Last month, the solicitor dropped murder charges against Tammy and Sidney Moorer, but the couple still faces a kidnapping charge.

Criminal Defense Attorney Stuart Axelrod says he’s been following the case for years, and he simply doesn’t see how the case can move forward.

His attorney sent a list of evidence he wants kept out of court, which includes communication between the Moorer’s, staged photographs of the Moorer’s posing with guns while on vacation, and communication from Tammy to Heather and her family. Sidney’s attorney also asks the kidnapping and obstruction of justice charges not be tried together, any plea deals offered to Moorer made admissible, and to stop the state from using some testimony from Bree Warrellman.

On Friday, Tammy’s attorney filed a motion under a seal that mirrored the motions submitted to the court by Sidney’s attorney. The motion would allow Tammy to join into the same motion that was filed for Sidney.

Seems like TM's "paid" attorney lets SM's "indigent" attorney do all the work, then "me too's". Is this a $$ saving tactic?

As far as Axelrod, his picture ad pops up on my phone app for WBTW almost every time I open it! He is big on advertising his services. DUI, defense, "personal injury", etc.... His comments are meant to appeal to his potential clients.

Curious as to why the Elvis's aren't in the courtroom and where is the state? Any experts on here that can explain why? tia

Did the judge say something about the kids not being allowed in the courtroom?

They're going through the long list of various credentials, publications, organizations that this witness has done or belonged to. Defense is now up and questioning him on some of the above. It's rather dull stuff.

The important point: this witness has never not been qualified as a forensic video expert in all the years he's been working and testifying. The expectation is he will be determined to be an expert witness here too. Let's see if the judge manages to find a way to disqualify him.
