A crew from “Crime Watch Daily,” a nationally syndicated program, was in Ottawa on Sunday and Monday recording interviews with an Ottawa detective, state’s attorney, former coroner, the victim’s sister and a Times reporter about the 10-year-old death of 32-year-old Tracy Lynn Cusick.

Cusick was found drowned in her home’s toilet on Jan. 16, 2006. Her husband, Kenneth Cusick, an Ottawa firefighter, discovered her body.

The pathologist who did a second autopsy found that Cusick's injuries — including an abrasion to the bottom of her chin, crushing injuries to the cartilage of her throat and an abrasion on her forehead that matched the contours of her gold diamond wedding ring — indicated foul play...

On the night before she died, Tracy called Gibbons about 10 p.m., upset after fighting with her husband, Gibbons said. Tracy said she'd had a couple of Bloody Marys and was going to go to bed.

"She was sad; she was upset," Gibbons said. "She said, 'My heart hurts.'"

An Ottawa firefighter was indicted Tuesday of first-degree murder by a La Salle County Grand Jury in connection with the death of his wife in 2006.

Kenneth Cusick, 49, was arrested by Ottawa police at the tavern he owns after the grand jury returned an indictment Tuesday afternoon. He is being questioned by Ottawa detectives before being transported to La Salle County Jail.

His bond is set at $5 million.

Thursday, Kenneth M. Cusick, 49, of Ottawa and his lawyer asked for additional time to prepare for Cusick’s murder trial.

Cusick is accused of drowning wife Tracy Lynn in a toilet Jan. 17, 2006, in their Ottawa home.

Judge Cynthia M. Raccuglia granted the continuance and set a July 13 status hearing, at which time she may issue a new trial setting.

Cusick’s trial has been repeatedly postponed while the defense looks for experts on what is shaping up to be a technical trial, based on the design and mechanical properties of a flush toilet.

Thursday, Judge Cynthia M. Raccuglia agreed to a Feb. 1 status hearing so the defense can continue its research.

Kenneth M. Cusick, 50, of Ottawa appeared Thursday on his pending charge of first-degree murder. He faces up to 60 years if convicted of drowning wife Tracy Lynn in a home toilet in 2006.

At the hearing, attorneys in the case loosely committed to a trial setting in early summer; but the judge agreed to an April 19 status hearing to keep the dates fluid.
 
In-home drowning case expected this year
The toilet drowning case was continued again today; but a judge signaled Kenneth Cusick would stand trial for murder by the end of the year.

Raccuglia set an Aug. 30 status hearing and indicated she would schedule a trial before the first of the year.

La Salle County State’s Attorney Karen Donnelly said outside the courtroom, she would seek a trial setting in October or November.

In opening statements, the prosecutor told jurors there is no possible way Tracy Cusick could have drowned in her downstairs bathroom without external force. They argued toilet bowls are designed to prevent accidental drownings.

The defense did not address that argument. Instead, they attributed the woman's death to drugs, citing toxicology reports showing a "toxic" amount of methadone in her system. It's a narcotic they say Tracy was never prescribed, and they say alcohol was in her system.

Cusick's now 25-year-old son also testified. He said his mom never randomly passed out, as the defense claimed.

Prosecutors argued her husband might have been motivated by "domestic problems" the two were having at the time.

Despite being a firefighter, Cusick told investigators he did not try to resuscitate his wife when he found her. The defense rebuttaled saying Tracy was already dead.

The trial is expected to last two weeks.
