Atlanta police officer in court over fatal shooting of unarmed black man

Former officer James Burns faces charges, including murder, in connection with the fatal shooting of 22-year-old Deravis Caine Rogers

A former Atlanta police officer charged in the fatal shooting of an unarmed black man made his first appearance in court on Monday.

James Burns faces charges of murder, aggravated assault with a deadly weapon and violation of his oath of office in connection with the 22 June shooting of 22-year-old Deravis Caine Rogers.

A spokesman for the police department said there was no evidence of car break-ins at the apartment complex or that Rogers was involved in any criminal activity.

After watching dash-cam videos of an incident in which an Atlanta police officer shoots a man in a passing car, a Fulton County grand jury last week did something that grand juries rarely do in Georgia: it indicted a cop for murder in the death of an unarmed civilian.

Burns, 34, had told police internal affairs investigators that he believed Rogers, 22, was trying to kill him with his car.

“He clearly lied and had there not been any cameras in the car he possibly would have gotten away with it,” said Grand Juror No. 7, who asked not to be identified by name. “When he got out of the car the gun was drawn and within four seconds he fired off a shot into a car and he didn’t know exactly who or what he was shooting.”

It wasn’t the first time Burns’ judgment had been questioned during his brief career in law enforcement.

His actions in July 2014, while a probationary employee, led to an internal affairs investigation, his temporary relief from duty and reprimands both written and oral, records show.

The investigation, according to a November 2014 memo, found that Burns had taken part in an unauthorized entry in a vehicle as the car’s alarm was blaring late at night in the apartment complex parking lot. Apartment management had called Burns for help and he responded wearing his department-issued bulletproof vest while carrying his personal handgun, records show.

“It was clear that the actions Officer Burns took exceeded reasonableness,” the investigator’s memo said. “Especially, since he made no attempt to locate the owner of the vehicle prior to such actions.”

Burns’ mistakes were chalked up to inexperience, records show, and he was allowed to continue with the force.
 
Indictment of APD officer gives Union City mother hope

When Freda Waiters found out a Fulton County grand jury indicted Atlanta Police Officer James Burns on murder chargers last week, she felt a sense of victory for Caine Rogers' family.

"I cried, and thank God that she got justice in the accountability," Waiters said.

Waiters says she's been waiting on justice for her son, Ariston Waiters, for five years.
 
Caine Rogers, 22, was shot and killed by now-ex Atlanta police officer James Rolfe Burns in 2016.

Burns had been responding as backup to a call of a suspicious person, possibly breaking into cars, at an apartment complex off of Monroe Drive, when Rogers came upon him in his car.

Burns put his lights and siren on, and pulled in front of Rogers' car, but Rogers tried to continue around him. Burns fired a single shot into the passenger side of the car, hitting and killing Rogers.

Initially, Burns allegedly told investigators Rogers tried to run him over with a car, but an internal affairs investigation found Rogers posed no threat to Burns. Dashcam video released in 2020 showed there was no attempt to ram the officer's car head-on or otherwise run him over.

Shean Williams, an attorney for the family, said "evidence strongly suggests" he had no involvement in the break-ins that initiated the police call.

Where it stands: Burns was fired and charged with murder.

The case was briefly dropped in 2018, but he was re-indicted. No trial date has ever been set. Burns is free on bond with restrictions.

The family is suing the City of Atlanta.
