Jennifer Nalley, a founder of Texas Rollergirls who helped reignite roller derby from a niche oddity into an international phenomenon was found killed Tuesday in a small Idaho town.

Nalley, 39, was known on the flat track as “Pixie Tourette.” She helped found the Texas Rollergirls as an original member of the team Hotrod Honeys. (...)

A Jackson, Wyo., man has been charged with two counts of first-degree murder in the deaths of Nalley and her unborn child. Nalley was shot multiple times, according to a report from the Associated Press.

The Teton County Prosecutor’s office confirmed that they will be seeking the death penalty for Erik Ohlson, 39, of Jackson.

Ohlson will be arraigned in an Idaho District Court on Sept. 6 with two charges of first degree murder. There, he will have the opportunity to plead guilty or not guilty.

Ohlson was arrested for a DUI after crashing his vehicle into a utility pole. While he was in custody, he told investigators he shot Nalley after coming to her home in Driggs. He said he was in a relationship with Nalley and was aware that she was pregnant.

Ohlson’s confession tossed out
A judge has thrown out a recording in which a Jackson man told police he killed his ex-girlfriend, causing the first murder case in 20 years in Teton County, Idaho, to take a dramatic turn.

Judge Bruce Pickett, of the Seventh District Court, ruled against the confession being used in the upcoming death penalty trial, agreeing with Erik Ohlson’s defense team that police violated Ohlson’s rights by interrogating him after he requested an attorney.

The trial of Jackson man Erik Ohlson, 40, charged with murdering a Driggs resident and her unborn child will not begin this summer as scheduled.

Idaho District Judge Bruce Pickett heard arguments from Ohlson’s attorney Jim Archibald as well as Teton County Prosecutor Billie Siddoway on whether to push the trial, which is scheduled to begin July 31, back and for how long.

“It would be unusual to have death penalty cases tried in a year,” Archibald explained. “These cases can languish in appeal courts for 20 years. Let’s do it right the first time.”

Archibald argued that his team would not be ready, since they had not yet completed gathering evidence, let alone begun preparing arguments based on that evidence.

Judge Pickett agreed to delay the trial but did not specify a new date, which depends on whether the trial would be moved out of the county.

Archibald has argued that it should, explaining that media reports from the area, including reporting by the Teton Valley News, made it impossible to find an impartial jury in the county.

“Even since I filed, there’s been ever more pre-trial publicity that’s been more aggravating to find a fair trial,” he said, pointing out in particular the media coverage of Ohlson’s confession to police being suppressed from evidence.

Judge Pickett ordered evidence to be presented on whether to move the trial. The next hearing is set for May 26 at 11:00 am.

In Teton County District Court on Friday, defense attorney Jim Archibald told Judge Bruce Pickett that the trial should happen in Idaho Falls, Idaho, because there’s a better chance residents there haven’t heard about the case.

“It’s very difficult for people to unremember things,” Archibald said. “The most concerning to the defense is that my client confessed and that’s now evidence that will not go in front of the jury.”

Pickett granted the motion to delay the trial but hasn’t scheduled a new date. He promised to rule on the motion to change venue in the next 30 days. A status conference will follow.
 
Teton County murder case will be tried in Blackfoot

An Idaho District Judge has ordered that the first murder case in Teton County in more than 20 years be tried in Bingham County in order to ensure a fair trial.

In the order moving the trial, Judge Bruce Pickett laid out his reasoning, citing “extensive pretrial publicity covering the Defendant’s confession, the small size of Teton County, the number of Teton County residents involved in the case and/or affiliated with Jennifer Nalley” and the fact that both the state and the defendant did not object to a move.

A judge in Idaho’s 7th Judicial District who heard arguments last week from attorneys on both sides of Jennifer Nalley’s murder case decided it should go to district court for a second time.

In a decision filed Thursday, Magistrate Judge Colin Luke said the court found enough probable cause during a Nov. 13 preliminary hearing to indicate Erik Ohlson killed 39-year-old Nalley and her unborn baby on July 4 or 5, 2016 at her cabin near Driggs, Idaho.

It’s the second preliminary hearing for the case. The death penalty case was sent back to magistrate court last month to re-establish probable cause after the court agreed with the defense that Idaho Police detectives violated Ohlson’s Miranda rights during the same interrogation in which Ohlson confessed to the murder. Counsel must now proceed to trial as if the confession never happened.

The Jackson man who’s in jail accused of murdering his pregnant ex-girlfriend a year and a half ago pleaded not guilty on Friday to six charges, including two counts of first-degree murder.

Erik Martin Ohlson, 40, entered pleas of not guilty in Idaho’s 7th Judicial District around noon on Friday, over two hours after his scheduled 10 a.m. arraignment.

Ohlson’s pleadings prompted the court to schedule the case for trial, which Judge Bruce Pickett set for May 4 in Blackfoot, Idaho.
 
Accused killer wants state’s evidence tossed
Ohlson’s attorneys say their client was denied due process during his preliminary hearing May 10 because a doctor “testified to facts unknown to the defense team” and because Teton County (Idaho) Prosecutor Billie Siddoway had a private conversation with the witness during a short recess while he was under oath.

“The hearing should have been vacated and the defendant should have been afforded a new hearing on another date,” attorneys Jim Archibald and John Thomas wrote. “The defense should have had an opportunity to fully examine the doctor on all of his knowledge about the case without the fear of possible alteration of testimony after a conversation with the prosecuting attorney.”

Ohlson’s attorneys also claim that evidence collected from their client’s vehicle the morning after the murder was illegally obtained because of an “invalid search warrant.”

Their argument is that police’s language when pursuing the warrant was too vague. They contend the fact that Ohlson was arrested near the crime scene and had a known relationship with the victim were not enough to establish probable cause.

DRIGGS — A Jackson man who murdered his ex-girlfriend and killed her unborn baby will serve 25 years to life in prison.

Erik Ohlson, 42, was sentenced by District Judge Bruce L. Pickett Friday afternoon following hours of testimony and victim impact statements. Ohlson shot and killed 39-year-old Jennifer Nalley, who was 8 to 12 weeks pregnant, at a cabin in Driggs on July 5, 2016.

Ohlson sat stoned faced and did not react when Pickett handed down the sentence. The only time Ohlson showed emotion during the hearing was when he started to cry as his sister described how they were best friends. Ohlson’s mother also took the stand on his behalf.

Jim Archibald, Ohlson’s defense attorney, asked Pickett to give his client 10 years to life in prison with the possibility of parole in seven years. Archibald justified his request by mentioning Ohlson’s struggles with alcoholism, his lack of a criminal record and the “emotionally stressful” situation he was in with Nalley.
