Arizona man who apparently tweeted that he'd murder his roommate is arrested in death of roommate

A man in Arizona who apparently tweeted that he was close to “viciously” murdering his roommates is now facing murder charges – in the death of one of his roommates.

A fight between Zachary Penton, 21, and Daniel Garofalo, 41, led to a shooting Sunday night at the home in Gilbert.

Police said Penton called 9-1-1 to report that he had killed Garofalo. He faced second-degree murder charges.

“I need to move out of my place before I viciously murder my roommates,” read a post Saturday morning on a Twitter account under the name Zac_Penton.

A Twitter posting by an Arizona man who was arrested on suspicion of killing his roommate during a struggle could elevate the severity of charges he could face.

Two days before the fatal shooting, 21-year-old Zachary Dale Penton posted a comment saying he needed to move out of the metropolitan Phoenix home where he was living before he killed his roommates. The comment creates an opening for prosecutors to argue that Sunday’s killing of Daniel Garofalo was premeditated, meaning they could charge Penton with first-degree murder and seek the death penalty.

An Arizona man who tweeted that he needed to move out of the home where he was living before he killed his roommates has pleaded guilty to manslaughter in the subsequent shooting death of the owner of the suburban Phoenix house.

Zachary Dale Penton, 23, was originally charged with second-degree murder in the August 2016 fatal shooting of 41-year-old Danny Garofalo. The plea deal made on Monday to the lesser charge of manslaughter doesn't recommend a sentence for Penton, who faces seven to 21 years in prison.

Sentencing is currently scheduled for March 23rd.

Arizona man gets 12-year sentence in roommate's killing

An Arizona man who tweeted that he needed to move out of the home he was living in before he killed his roommates was sentenced to 12 years in prison Friday for his manslaughter conviction in the subsequent shooting death of the owner of the suburban Phoenix house.

Zachary Dale Penton, 23, was stoic as Superior Court Judge Michael Gordon announced the sentence in the August 2016 fatal shooting of 41-year-old Danny Garofalo. Penton had faced a possible sentence of seven to 21 years in prison.

At the sentencing, the victim's brother, David Garofalo, urged the judge to impose the maximum sentence. "I am asking you to consider the pain and suffering that my family has endured," Garofalo said. "I truly believe there is no remorse here."

The family of a Valley man who was shot and killed by his roommate in 2016, does not feel justice was served after the killer was sentenced to 12 years in prison Friday.

"Twelve years," said Dennis Garofalo. "I was sick. I wanted to get up and scream, that there wasn't justice for my son. My son's life is worth 12 years. As far as I'm concerned, it was worth a lot more."

Danny's mother has a message for her son's killer if Penton has a family after prison.

"I hope that he will one day realize what he did," said Barbara Garofalo. "I don't think he will until he has children or a child of his own."
