Justin Stevenson, 23, Nathan Price, 18, and Isaiah Scott, 17, were led out of the Indiana County courthouse this morning after their hearing...

According to the criminal complaint, Stevenson, Price and Scott went to Gardner’s house to rob him of drugs and money. Prosecutors say they beat Gardner and his girlfriend with a chrome pipe, then ran off with a safe, cash and marijuana.

At today’s hearing, all three were ordered to stand trial.

Indiana County District Attorney Patrick Dougherty announced Friday he will seek the death penalty for two Clymer-area defendants in a drug-related double homicide in Cherryhill Township last fall.

The defendants are Nathaniel Price, 18, and Justin Stevenson, 19, who are each charged with two counts of criminal homicide in the deaths of Timothy Gardner, 26, and Jacqueline Brink, 20, during a robbery early Oct. 27 in their home at 903 Hillside Drive near Clymer.

A third defendant, Isaiah Scott, 17, is also accused of homicide in the case and was charged as an adult. But Dougherty said today he cannot seek the death penalty for Scott because he is a juvenile.

Formal arraignments are scheduled for two of the three defendants in the murder of a Cherryhill Township couple in October, while the third suspect’s case is not yet listed in the online schedule of the county’s Court of Common Pleas.

The formal arraignments for Stevenson and Price are scheduled for 1:15 PM Friday before Indiana County president Judge William Martin.

The ruling last week by Judge Bianco rejects a motion by attorney David Shrager, who contended that the audio and video of the interrogation of Stevenson after his arrest had been altered in some way. Bianco wrote that the court specifically relies on the testimony of Trooper John McCombie and the prosecutors affirming that the video and audio are “full and accurate and have not been abridged or edited in any way.”

JUDGE SETS TIMELINE FOR PRETRIAL MOVES IN PRICE MURDER CASE

Judge Bianco set in place a timeline for the two sides to get their pretrial maneuvering done. He ordered the defense attorney to provide the district attorney’s office with a written transcript of the audio portion of a police interview with Price which was conducted after his arrest on the night of the shooting, and then D.A. Pat Dougherty will have fifteen days to give Manzi suggested additions, deletions, or corrections. Then the two sides will have get together to finalize the document for use at trial. The defense will then submit a brief in support of pending pretrial motions, after which Dougherty will respond and the defense file any supplemental briefs.
 

Court documents show that 25-year-old Justin Tyler Stevenson of Houtzdale will be in front of Indiana County President Judge Thomas Bianco this afternoon for a petition for relief that he filed last year. He had entered guilty pleas to two counts of murder in the second degree while other charges were not prosecuted. Police said he and 24-yea-rold Nathanial Ray Price went to the apartment of Timothy Gardner and Jacqueline Brink outside of Clymer to buy marijuana, but the two allegedly planned to rob Gardner. They allegedly jumped him and beat him to death with a metal pipe. Brink was beaten to death as well as they feared she could have been a witness against them.

A third person, Isaiah Scott of Clymer, was initially charged in this case, but his case was later referred to juvenile court.
