S.J. dad won't face charges in death of girl, 2, who was left in garage in running car
Santa Clara County prosecutors have decided not to press charges against Long Nguyen, the father of a 2-year-old girl who died Sept. 29 after she was left in a car in the family garage in San Jose with the engine running.
Tina Nguyen died of acute carbon monoxide poisoning.
Deputy District Attorney Dan Nishigaya said a review of the case showed there was not enough evidence to support a conviction. He noted that the district attorney's office did not condone Long's actions.
``We hope this case reminds the community of the extreme risk involved in leaving a child alone in a car, regardless of the length of time or the circumstances,'' Nishigaya said.
Last year, the district attorney's office reviewed 21 cases against people accused of leaving children alone in a car in Santa Clara County. Misdemeanor charges were filed in 11 cases, five people were cited for vehicle code infractions and five cases were not pursued.
No children died in any of those cases.
According to police and coroner reports, Tina Nguyen's parents called for help after she was found dead in the garage ....
Nishigaya said Long left his daughter in the car after he picked her up from day care and she fell asleep. Nishigaya said Long kept the engine running to power the car's air conditioning because he felt it was too warm in the garage.
