The ^ vid & other MSM reports crash location as Tenn (TN).

Miraculous (almost?) that no fatalities occurred. That truck = scary. JM2cts.

Dont really understand why they have to press charges ? He was the only one injured -he is human he made a mistake probably.

They will be able to tell if he was trying to run it tho so I guess they could try to get the poor guy for that.
Yeh. I'm sure he's learned his lesson ... the hard way, of course. He's so blessed he survived to learn that lesson. But, I wonder if THP would only fine him to help pay for damages and clean up. And it would go against his driving record, too, so he'll likely lose his job with FedEx. JMO

^bbm^ Yes, he is human and made a mistake, as all of us do, but I understand pressing charges of some kind.
Many aspects of operating a motor vehicle require higher cognitive functions and calculating many factors in decision making. However a couple simple black & white rules about driving and RR tracks are so basic imo kindergarteners can understand how to follow them. Virtually no 'judgment' call involved.

1. Never stop your vehicle on (or close to) a train track. If vehicle stalls or stops on a track, exit it & walk away.
2. Do not cross a RR track while any signals - lights, gates, etc - indicate impending arrival of train. IOW don't try to 'beat the train.'

The principals behind traffic laws do not just protect drivers & passengers of a vehicle on track. They are in place to help protect people aboard train from injury or death. Happily ppl on this train, this time were not hurt or IIRC at least were not seriously hurt. When a vehicle is on a track, either moving or stationary, as a train approaches, is it possible, likely, probable or 100% certain that there will be injuries or death? IDK what the percentages are and not gonna search for injury or fatality rates & stats.

Failing to press charges for driver's violation in these ^ circumstances, seems imo, to encourage drivers to ignore safety rues and inflict harm selves, vehicle passengers, train employees & passengers, and possibly bystanders from flying debris/crash.

What about DUI or DWI? Driving interstate w three times legal limit for alcohol, but did not hurt anyone other than self, so driver should not be charged? Respectfully disagreeing. Also applies to many other traffic issues: speed, stop lights, etc. All JM2cts. Lecture/rant over.
