Man charged in deadly Conway bank robbery requests another trial delay

This request, filed on January 5, comes after A U.S. District Court judge granted an order to delay the trial of Brandon Michael Council past the term that began on December 7, 2017. The request asks for a continuance beyond the current term of court that began on Monday, January 8.

Man offers plea deal in Conway double murder, bank robbery
Brandon Council offered to plea guilty and serve life in prison without parole for charges related to a double murder and bank robbery at the Conway CresCom in August 2017.

Jimmy Richardson, 15th Judicial District Solicitor, said the offer only applied to the federal case as Council also faces state charges. Richardson said they still plan to pursue the state case no matter what federal prosecutors decide.


Richardson said he doubted federal officials would accept the offer.
 
Federal court paperwork shows the initial jury summons for the trial of Brandon Council will be sent on our around October 1 of this year.

The court information shows a standard jury questionnaire that will be sent to 2,000 randomly-drawn people from the Florence area. The trial is scheduled to begin around January 14, 2019.

A judge ruled that jury summons will not be sent out yet, pending a ruling on a motion to delay the trial against Brandon Michael Council.

In a motion filed September 20, the defense asked the judge to delay jury selection and the trial claiming Council’s attorneys need more time to prepare. According to those documents, the trial is set to begin January 14.

The judge says the clerk will not send those jury summons until the court rules on the motion to continue.

Trial for man accused of killing two women during bank robbery delayed until September 2019

The trial for the man accused of shooting and killing two women during the August 2017 robbery of the Crescom Bank has been delayed until September 2019.

The judge also outlined a new timeline for jury selection. The new documents say around May 15, 2019, a jury summons will be sent to 2,000 potential jurors randomly drawn from a district-wide pool. That process was initially set to begin on October 1.

According to the amended order governing jury selection procedures, a 12 person jury with four alternates will be seated around September 16, 2019.
 
“For Donna Major and Katie Skeen it was horrific,” said Nathaniel Williams, a federal prosecutor.

“This defendant chose murder. He chose to kill. He decided when their lives would end,” Williams said.

“He!” the lawyer exclaimed and pointed to Brandon Council in a federal courtroom, “this defendant made the choice [to kill].”

Council is on trial for killing the two women. His case is being heard by a jury in a federal courtroom in Florence and if convicted Council faces the death penalty. Tuesday marked the start of the trial with opening statements, surveillance video from inside the bank and witness testimony.

Council’s attorney Duane Bryant admitted his client’s guilt, but he said they were having a trial for guilt because the government announced its intention to seek the death penalty and because there needs to be closure. He also expressed regret on Council’s behalf.

“Closure for the family,” Bryant said. “Closure for the community and closure for the state of South Carolina.”

Members of the Skeen and Major families packed a few rows of the courtroom as some cried or hid their eyes from the evidence shown on nearby television screens. Others stoically stared at the video of their loved one’s murders.

Following this trial closely. I was in one of the juror groups on Aug 28 but was excused for a health condition and did not fill out the questionnaire. I feel so much empathy for the jurors.
 
The jury — of eight women and four men — delivered its sentencing verdict Thursday morning after nearly three weeks of trial. The same jury convicted Council on murder and robbery last week.

Council showed no emotion as the verdict of “death” was read on two accounts. Members of the victims’ families also showed little reaction to the verdict, though a few sobs could be heard in the room.
