With September 26th approaching quickly, I thought I would add a new thread to find information directly related to that hearing.

Luke Berg has filed notice that he will be giving oral arguments on behalf of the state. Here is his profile.

IDK~~it took several months before the 3 circuit judges made their decision, so I don't see it happening very quickly.

Yeah i did read elsewhere where it took about 4 mnths. for someone else's en banc, but it is all a waiting game for sure.
 
I hope they speed things up after the hearing. Brendan needs to be home by Christmas.

I feel a sense of deja vu...makes me wonder if I posted that around this time last year.

Christmas is only around 3 mnths. away. I wonder if the en banc hearing in Brendan's favor if they will then finally release him from prison? I hope so.
 
It's only about 8 days before the en banc hearing. Does anyone know if we will be able to listen to it like the previous one?
 
Karinna, I don't think we get to listen to it live, but the audio is released right after. I will keep my eye out out though, and if I find that it's live I will post a link. From what I have read recently, I think both sides have been given 30 minutes to argue/answer questions.

Brendan Dassey faces crucial hearing Tuesday before federal appeals court
Regardless of which way the Seventh Circuit rules, an appeal to the U.S. Supreme Court is virtually certain, said Raymond Dall’Osto, a Milwaukee attorney with a specialty in criminal defense.

But he said it would be unusual for the nation’s highest court to take the Dassey case.

“Those (petitions for review) are rarely granted,” he said.

Dall’Osto said he is hoping that Dassey will prevail before the Seventh Circuit.

“If (the judges) follow the law as applied in this case … the conventional wisdom would be affirmation,” he said.

For those who may not know, today is the day the full 7th Circuit hears Brendan Dassey's case.

There is someone on reddit that is there and giving updates, as of about 20 minutes ago, he said that 1 judge had dropped out, leaving only 7 judges now (there was 8, and Brendan would have needed 4 to rule in his favour, with 7, 4 would still be the majority). They were also moving to a larger room, lots of spectators there to listen, all major players were already in the courtroom.

I'm not sure the 7 judge thing is confirmed, but only 7 had signed in, and JButing tweeted 7 will hear it... we might not have confirmation of that until the end because as far as I know, no electronics allowed in the court room, twitter has gone dead silent, anyone that is there can't tweet/report until it's over.

It should have started about 15 minutes ago, and they were allowing 30 minutes for each side, so should be done in 45 minutes, but I won't be surprised if it's about an hour or so from now before we hear from anyone in that was there. (they gave extra time the last time)

Wow at the last tweet! That must have been from one of the original judges that heard the case and ruled in BD's favor? I hope not, but I'm guessing it is lol
