GUILTY NJ - Homeless Veteran helps stranded motorist, Motorist keeps $400k of funding, Aug 2018 *Arrests*

The gentleman was a homeless veteran, he shouldn't be homeless. I hope the outcome of this is that he is able to live in an apartment, he deserves a dignified life. His actions show that he is a gentleman with a good heart.

Homeless Vet Kate McClure, of Florence, New Jersey, and her boyfriend Mark D'Amico raised the funds for Johnny Bobbitt, the homeless vet, after he gave McClure his last $20 when she ran out of gas while driving in Philadelphia. The couple then put together a page that went viral but, 10 months later, Bobbitt's lawyer told NBC News that her client is back on the streets because D'Amico and McClure are withholding the funds.

A judge ordered a New Jersey couple Thursday to give a homeless Philadelphia man whatever's left of the $400,000 they raised for him.

Katie McClure and her boyfriend, Mark D'Amico, were told by the Burlington, New Jersey, judge to turn over the remaining money they raised through a campaign for Johnny Bobbitt, according to NBC Philadelphia.

The judge also demanded that McClure and D'Amico provide a full accounting of each dollar they collected, the station reported.

D'Amico told the Philadelphia Inquirer that he withheld the cash because the veteran allegedly has a drug problem. The couple initially purchased a camper for Bobbit to live in and placed it on property controlled by McClure's family. But Bobbitt was kicked out in June, making him homeless again, according to NBC Philadelphia.

During an appearance Monday on NBC's "Megyn Kelly Today" show, D'Amico said more than $150,000 of the money remained.

He denied misusing the funds but admitted to the Inquirer that he spent $500 of it at a casino.

nearly $403,000 raised from about 14,000 online donors — never fully ended up in Mr. Bobbitt's possession... where is it?

Couple accused of stealing some of the $400,000 they raised for a homeless man are told to hand over the remaining funds and show proof of where it was spent
  • Kate McClure and Mark D'Amico ordered to handover remainder of raised funds
  • New Jersey couple raised $400,000 for homeless man Johnny Bobbitt last year
  • They withheld money from Bobbitt, 35, because he 'was spending it all on drugs'
  • But now a judge has made them put money in a third party account and show proof of where funds were spent

This is the the part that bothered me the most. They were so cruel here.

It will be interesting to see the results of the audit. We are starting to see more and more problems with go fund me accounts and other similar fund raising platforms when the person who sets it up isn't the intended beneficiary. There are also interesting tax implications for those involved that get pretty messy. In this case, the fund was clearly set up with good intentions and hopefully all the money can be accounted for. I certainly hope they didn't think that they could just help themselves to that money. They will have to pay it back if they did.

What started with a story touching my heart is ending with icing my heart. Let's remember homeless people have a heart...most of the times they are more generous and helpful than a lot of us. Probably he would fall into a shock having this amount of money suddenly, but anyway . I think he is the rightful owner. It's a disgrace holding the money back, because of his lifestyle isn't suiting you...hellooooooo he is living a rough life!! Even spending it....well they had their 10 minutes of glory for being so marvelous doing the "go fund me" thing. I hope they fall deep....very deep... Sorry for my reaction like this...sometimes I'm so intensely disgusted by people.

I was so touched by this story originally, that I myself donated to the Go Fund Me campaign for Mr. Bobbit. It was Thanksgiving, he was a homeless Veteran (which absolutely breaks my heart), he was from New Jersey I'm a Jersey Girl, it was such a feel good moment.

I'm just so disheartened by how this story ended. I can't wait to see the financial accounting for this fund, I sincerely hope that these two didn't use the money for themselves.

$400,000 raised for good samaritan homeless veteran has gone, his lawyer says, after couple started the fund in his name then withheld it from him for a year
  • Nothing remains of the money raised by 14,000 people for Johnny Bobbitt
  • The homeless veteran won hearts last November when he spent his last $20 buying gas for Kate McClure
  • McClure set up a page to repay him and strangers gave $400,000
  • He was never given access to the money and now there is nothing left of it
  • He says McClure and her boyfriend Mark D'Amico spent the money on themselves
  • They insist all of it went on his care and that he spent $25,000 of it on drugs
  • Now, Bobbitt's lawyers are asking for detailed records of their spending
  • Last week, the couple said there was 'well over' $150,000 left of the money

In a devastating outcome for Johnny Bobbitt after what seemed like an end to his strife with the couple, he and his lawyer discovered the fund was depleted on Tuesday after finally winning control of it nine months after it was set up to help him.

'There is no money left. Where the money went, I have no idea,' Bobbitt's lawyer Christopher C. Fallon Jr. told nj.com on Tuesday, adding Bobbitt was 'completely devastated' by the discovery.

It comes less than a week after Kate McLure and Mark D'Amico, the couple who set it up then withheld it from him, went on national television to claim there was still 'well over' $150,000 left.

Well, there is still supposed to be a formal accounting of the funds. So we will see what they produce for the court. If the money is indeed all gone, I would imagine the Court would ask law enforcement to investigate what crimes may have been committed. There are also a plethora of civil remedies that could be sought both by Mr. Bobbitt and/or people that donated to the fund.
