JACKSONVILLE, Fla. - For the seventh time, a trial date has been set for Donald Smith in the 2013 kidnap, rape and murder of Cherish Perriwinkle.

The trial is scheduled for Feb. 5, 2018.

The first of 300 potential jurors in the trial were in the courtroom Monday morning to be briefed on the process, which includes them filling out questionnaires. A few dozen will be invited back to be interviewed by attorneys for both sides.

The jury pool is already narrowing. At least four people were excused for work conflicts, and one man said he “would not be a fair juror.”

Smith's defense has added a psychological legal analyst -- Dr. Brooke Butler -- who will help them select potential jurors.

Once a jury is picked, the trial is expected to last three to four days, with another three to four days for the penalty phase. It’s uncertain if the penalty phase will start immediately. In Duval County, there’s usually a one- to two-week gap.

According to Smith's attorneys, he no longer wants the jury to be sequestered for the entire trial. However, in court, his attorneys made it clear that they are concerned about Smith getting a fair trial.

Probably because most people would be completely outraged by the allegations, and have probably read or seen the case in the news and have already decided he's guilty imo

Oh, I thought they would just show the video of him abducting her, and then hand down his sentence.

My bad, now I just read their expecting this to be a 4-day trial. I guess the courts are moving a bit slow over there.

Day two of jury selection in the Donald Smith trial was an exercise in grinding procedural work broken by moments of real drama: a reminder of how viscerally some in Jacksonville feel about the case.

Smith’s attorney Julie Schlax held a picture of the child as she questioned one juror. The man, who had already expressed reservations about serving on such a difficult case, fought back tears as he looked at it, asking, "Is that the one in question?"

Assistant State Attorney Mark Calliel complained about the use of the photo, which Schlax previously received permission to use, saying it was being used to inflame jurors. The judge seemed to agree. Although Judge Cooper previously granted permission to show the photo to prospective jurors, she asked Schlax to limit how much she displayed the photo.

But that was not the only photo that caused concerns. The same juror said he was extremely “squeamish” about having to look at gory photos. Schlax told him the trial would involve “the most graphic photos you could possibly imagine.” Both autopsy and crime scene photos will be shown to jurors.


At least one other juror grew tearful under questioning. The grandmother of two said she was particularly sensitive to crimes involving children, and would “lose it” at trial, “especially if I have to look at pictures.”

It’s an issue the defense has been concerned about for weeks in arguments that the trial should be moved out of Duval County. Smith's attorneys argued the media attention that the murder of Cherish Perrywinkle has received would mean an impartial jury could not be found in Jacksonville.

I'm thinking the defense may succeed in having the trial moved. I know I couldn't be impartial; most trial I could, but not this one.

I've followed this case from the very beginning. This one totally gutted me. I do not think they will find an impartial jury here.

After all this time, I am still so angry. I will be happy to see him face justice...finally!
