After one week, here is what the jury knows about Nicole Vanderheyden's murder

After five days of testimony and 32 witnesses, prosecutors are well on their way to having established their case against George S. Burch.

Burch, 40, is accused of murdering Nicole VanderHeyden on May 21, 2016, near her Ledgeview home and dumping her naked body down an embankment in a field off Hoffman Road in Bellevue.

The defense is arguing that VanderHeyden’s live-in boyfriend, Douglass Detrie, the father of her child, was the actual killer.


Witnesses say Nicole VanderHeyden's relationship was rocky with original suspect in case

Prosecutors say Burch picked VanderHeyden up near the bar where she had been with friends, drove her to her neighborhood in Ledgeview, murdered her there and then drove her to the field off Hoffman Road.

The defense claims VanderHeyden’s live-in boyfriend, Douglass Detrie, the father of VanderHeyden's 6-month-old baby boy, was the actual murderer. Burch claims Detrie caught them having sex in Burch’s truck, murdered VanderHeyden, then forced Burch at gunpoint to dispose of the body.


Medical examiner reveals new details of Nicole VanderHeyden murder

She said the autopsy revealed two causes of death: Strangulation and blunt force trauma to the head. It was not possible to tell which injuries came first, she said.

"There are what's known as vital reactions, meaning there's still blood flow, corresponding to both kinds of injuries," Rogalska said. "I can't say which ones came first or which ones came second, or say or that they didn't occur at the same time. That's why they both have to be evoked, because either is sufficient to cause death."

Rogalska said VanderHeyden's body was covered in bruises, most significantly on her arms, legs and back. Evidence also shows the bruising happened both before and after VanderHeyden died.

She said injuries to VanderHeyden's head were so severe, they caused major hemorrhaging. She said blood pooled around the wounds, which indicates she was alive for some time during the beating.

Although it can not be determined what caused all of the bruising, she said there are signs she was hit with a foreign object, which left irregular geometric shapes and repetitive zigzag patterns on her skin.

In addition, bruising and contusions suggested VanderHeyden may have been assaulted sexually, Rogalska said.
 
Close Friends Testify In Burch Murder Trial
Week two of the George Burch murder trial started with testimony from those who knew him well.

Those who lived with Burch were among the eleven witnesses that the state called to the stand on Monday.

Edward Jackson was asked about a trip that he took with Burch right after the night that Nicole VanderHeyden was murdered.

Jackson testified that he went on a fishing trip to Racine with Burch, and that Burch slept most of the way there. The state asked Jackson if Burch had any signs of injury on his head, which Jackson testified that he did not. That is significant becuase Burch's defense team is contending that he was knocked out by Doug Detrie when he found Burch and VanderHeyden getting intimate together.

Jackson also testified that he watched a news story on Nicole VanderHeyden's murder with Burch after they got home, and recalled what he said to Burch when he first saw it.

"I said the ******* that did this needs to be taken down."

He was also asked if he remembered how Burch responded to the news story.

"He was intensly looking at the TV" Jackson said.

Raymond Lenz from the State Crime Lab testified for a short period of time about evidence that was found on VanderHeyden. Lenz confirmed that small pieces of wire were found on VanderHeyden's clothes, and they came up as a match of the wires that were found in the yard across the street from the Detrie home. The state contends that the cord was used in the murder.

Fitbit, GPS tracking to take center stage as state wraps up its side in VanderHeyden murder
Prosecutors expect to wrap up their case against George Burch Tuesday morning with technical testimony showing Burch was at Nicole VanderHeyden’s murder scene and at the place where her body was found.

Prosecutors also expect to show data from Douglass Detrie’s Fitbit that they believe will show Detrie was not active enough on the night of VanderHeyden’s murder to have been involved, as Burch's lawyers claim.

Defense lawyers have a standing objection to the Fitbit testimony on the grounds that there is insufficient evidence to trust in the activity-measuring device’s accuracy.

District Attorney David Lasee said Monday that detectives conducted an experiment with Detrie and his Fitbit. Brown County Sheriff’s Office analyst Tyler Behling had him mimic his activities of the night of VanderHeyden’s disappearance and into the morning and compared it against the data the Fitbit provided from the actual night in question.

Lasee implied that the results of that experiment were comparable to the Fitbit data from the day of VanderHeyden's murder.

They also loaned him vehicles, including the Chevrolet Blazer he was driving at the time of VanderHeyden's death. Burch is claiming Detrie forced him to drive the Blazer to the Hoffman Road field where VanderHeyden's body was found.

The vehicle was never tested for DNA evidence because it was destroyed before Burch became a suspect.

Burch reported the truck stolen on June 8, and Green Bay police learned the vehicle was involved in a hit-and-run crash and was destroyed in a fire.
