:furious: :furious: I cant believe this.The stepfather was removed from the home and then gets back in and rapes and murders her .I wonder how long he had been living with the mother and raping the little girl.

how very sad...
what really sucks is, this is the man she was suppose to feel safe with, the man in her life that was suppose to protect her... what a blow to the mother, that her own husband could do this...

Death Follows Complaint Of Earlier Sex Assault

LEHIGH ACRES, Fla. -- A 13-year-old girl who deputies say was the victim of a rape and beating by her stepfather earlier this week died Thursday at a Fort Myers hospital.

Police say they expect the stepfather, Alberto Hernandez, to be charged with murder following the girl's death.

A sheriff's report says paramedics found the girl unconscious and badly beaten at her home Monday after an apparent struggle. The girl's mother called 911 after she said she returned home and found the teen "convulsing."

The article really doesn't say, but I took it that he forced his way in to retaliate for being "removed" and told on.

Irrigardless of how the dirtball got into the house..

Wheather the mom permitted it or he broke in...

After such a traumatic experience why was this girl left alone so soon after?
Why was she even in the house alone?
Would you leave your traumatized 13 YO home alone knowing the creep was still free?
 
Why wasn't he arrested after the allegations were made?

Amraan, good point. I would fear for my child's safety and make sure she was not alone during this time.

Linda, he should have been in jail until trial, imo.

According to Department of Children & Families records obtained by The News-Press of Fort Myers, a social worker with the Child Protection Team recommended that Michelle be removed from the home because she said Hernandez sexually abused her and she had "extreme hatred for her mother," who did not believe those allegations...

A DCF investigation into its caseworkers' and lawyers' conduct concluded the agency made mistakes. The report said a number of policies were not followed and harm to Michelle was not adequately assessed.

Alberto Hernandez pleaded no contest to first degree murder and aggravated child abuse. One count of sexual activity with a child was dropped...

Hernandez was sentenced to life in prison without the possibility of parole for the murder charge and 30 years in prison for the child abuse charge. The sentences will be served concurrently.
