I think he should bear some responsibility for getting the implant in the first place. If his health is so bad that he can't take viagra or have the implant removed, he shouldn't have gotten it in the first place! I was curious as to what this implant actually was, so I went to their website. And although it really wasn't technically helpful, it did mention that medicare would pay for the implant. WHAT!!!! :doh:
 
Medicare amazes me.....they will pay for an "implant" in an old man, but they wont pay for many medical necessities that older people need. I'm sitting here shaking my head on this one.

Also it says 1996 was when it was installed(hehe), but just says he's 68.
Was he 68 back in 1996 or today?

I had a close friend at one time, that because of some kind of natural valve problem would stay erect several hours after having sex with his wife. (We are not talking any kind of implants here.)
He told me that it was very uncomfortable, and because of his financial condition could not afford to have surgery done to cure it.
Sadly, for the same financial reason, he ignored a skin cancer spot for years and died of it at the age of 45. :bang:

But that does not matter, if you "buy" something and it does not work the way it was intended to, well you "could not be aware of the consequences" and you bear no responsibility for the "manufacturing" defect.

You did not have the ability to "inform" yourself that this device was defective.
 
A lifetime of pain sucks regardless of the reason. If he can't have it taken out, and can't fix it - and it's a malfunction.... I'd say the money is justified.

The man's penis would still have been constantly erect just not pointing upward even if it worked correctly. I wonder if the surgeon didn't remove enough tissue or if it was the wrong size implant since he couldn't fold it downward. Looks like he could have had the implant immediately removed when he discovered it wouldn't bend but decided to keep it and his health can't hold up to removal now.
