Nifong getting thrown out would probably be the best possible thing for this case.

Well, definitely the best thing for the case. Probably not the best thing for Raven. Raven has definitely benefitted from Nifong being such a slack DA.

Disbarment's are hard to come by. This is a very long, tedious process. This seems to be another long drawn out media affair in the making with all the focus pointed at politics in NC, instead of on Janet again.

Anyone can file a complaint with the Attorney Registration & Disciplinary Committee (ARDC) of each state against an attorney. All complaints filed with that state's ARDC must and will be investigated. The Rules for the North Carolina State Bar are located here:

http://www.ncbar.com/rules/rules.asp

To search each rule and conduct code please check out each section by clicking on the dropdown box here:

http://www.ncbar.com/rules/rpcsearch.asp

Unfortunately having such a strong political aspiration and fighting so hard to win at the risk of doing something unethical is something that happens in politics all the time, it's whether or not it is deemed the code of ethics was broken, or a law broken that he will actually be disbarred. He will be going up against his peers picked through the ARDC for the hearing against him. All he may end up getting is a mark on his record, having a complaint filed against him does not mean he will be disbarred.

The shame to me, is not that Nifong is under scrutiny, the shame is that ONCE AGAIN, in Durham, in North Carolina, in the Media, Janet's Story and her case is taking a back seat to something else.

I pray all the reporters, politicians and all the higher ups in the Durham Police Department go to bed at night and Remember Janet and wake up the next day and start focusing on her and her unborn child.

I believe the Detectives handling this case are focused on it still, I know most of us here are also, but the ones that can start moving harder on this case are too caught up in the politics and other things right now. That's the shame of it all to me.

Okay Okay. I am NC born and raised and proud of it. I grew up not very far from Durham. Now those of you that are focusing on this being in NC need to understand that Durham is different from the other big towns in NC. Things like this are not a NC problem :snooty: , they are a DURHAM problem.

I know that we all feel very frustrated that there has been no break in this case and I hear some saying that this case is gettting lost in all the stuff going on in NC. No it is getting lost for 2 reasons: 1) all the crap with Nifong 2) all the other murders that take place in Durham. Durham has a huge crime problem. As crass as it sounds to say this, Janet's murder is only one of many in Durham still unsolved. I am still completely amazed that the Peterson East trial ever took place and the guy was convicted. Of course they had a different DA at the time, one who was more concered with justice for the people than making a name for himself. So lets keep the focus where it belongs on Durham and not bash NC. Remember....the citidiots in Durham voted him in this time. He was appointed the last time and the people had no say, but they did in the last election and for some unknown reason they elected him??? :banghead: My only guess as to why they voted him in is because he went after the rich boys and the majority of the citizens thought 'yea, stick it to the rich boys over there at Duke thinking they are better than us.'

Now if this southern gal has been oversensitive I sincerly apologize...ya'll. :blushing:

I totally agree, curious1, that this shouldn't be a reflection on NC. However, I'm not sure that I agree about the number of unsolved murders. Who was it that found the numbers for us before? How many murders from 2005 remained unsolved besides Janet's in Durham? I thought that it was only Janet's and an execution-style murder of several people? If anyone remembers, can you refresh our memories about the number of murders in 2005 and the number that remain unsolved?

Thanks Jersey Girl.

The numbers I found show there were 35 murders in Durham in 2005. Now consider they had a pop of 204,845 in 2005 and nearby the of Raleigh with a pop of 341,530 had only 21 murders in 2005 and you can see that Durham is a bit 'special'. I am searching for how many are still unsolved.

Wow, my beloved, nearby Philly must be REALLY special - they topped 400 in 2006. Of course, the population is significantly higher too.

Anyway, now that I'm thinking back, wasn't there a break in those execution-style murders? SES, Term, was it one of you maybe that mentioned these things before?

So far, all I've found is the end of year crime report for 2005 that was published on March 20, 2006. As of that time, here's what it says:

There were 35 homicides and one fatal officer-involved shooting ... during 2005.

5 gang-related
10 drug-related
3 domestic violence
6 arguments
5 killed during robbery
3 resulted from child abuse
3 motives not determined

2 double murders
1 quadruple homicide

Only 2 were stabbings.
Only 1 was a white female, (Janet).

Investigators have cleared 22 of the 35. 13 open cases as of March 2006, including 2 cases in which charges have been filed, but no arrest has been made.

http://www.durhampolice.com/pdf/05_year_end_crime_report.pdf

newsobserver.com | Homicides down, but other crime up

... Arrests have been made in 12 of the 13 homicides committed this year, Hodge said. In addition, arrests have been made in 14 older cases, including a quadruple slaying in an Alpine Road townhouse last November that shocked many in Durham for its brutality. That crime and others drove Durham's 2005 homicide rate to the highest of any of North Carolina's 10 largest cities and focused increased attention on the problem...

Hi All, I have been away for quite some time. I continue to wonder when something will happen with this case. I too am very disturbed by the Durham stats, and have put my house (only a few blocks from Janets) on the market and am moving to small town midwest. I see things in Durham as getting much worse before they get better...I will continue to follow this until the end...Raven behind bars for life

No need to apologize, I think maybe it may be my blunt way of delivering my posts at time and sometimes written words may come off as insenstive. I will try my best to explain my feelings towards the Government of North Carolina as a whole.

I believe it is a Durham problem, however, the Governor of North Carolina is the one that elected DA Nifong to become the acting DA.

During National Crime Victims Right week, the last day of NCVRW was the Candlelight Vigil. I was under the understanding that the Governor and Attorney General were invited to the Candlelight Vigil, neither showed up, neither did the Mayor (Mayor Pro Tem did show up), Chief of Police did not show up, and this may have been due to the politics going on in Durham at the time.

(Monday after the vigil there was a huge Rally and The national chairman of the New Black Panther Party for Self-Defense says his group intends to march at Duke University on Monday to "deal directly" with lacrosse players about charges of rape of an escort service dancer at a team party.) A huge Town Hall meeting was planned after this with politicians.

North Carolina Government does have a responsibility as to what happens in Durham. There is a $10,000.00 Governors' Reward. We are starting to close in on two years since the murder, and the Governor has not put up this reward towards information leading to the arrest and conviction of the murderer, he has for other victims of crime, after a SHORTER period of time without an arrest......why not Janet and her unborn child?

I am not bashing North Carolina as a whole, I'm just thinking that something needs to be done starting with the Governor's office, down to the Attorney General's office, through to the all the politicians in Durham.

The NC Politicians in the Governor's office and their representatives do have a some say as to how Durham politics are handled and that's what I think needs to happen. There either needs to be more money coming in from the State to properly train investigtors, hire more law enforcement, they need to be alloted more money to investigate crimes, and they need to start working on uniting the citizens to get them more involved.

There is also a responsibility of the citizens of Durham, North Carolina to show up to their Town Hall Meetings, and demand to know why there is such a crime problem, to ask why there are still so many unsolved murders.

This is not a North Carolina bash, I'm simply stating that the Government in NC has to be tightened up and the responsibility does lie on all the politician's shoulders.

Gosh, I'm tired, and I hope you understand I am not trying to bash North Carolina, the politicians need to remember Janet and her unborn child and put more effort into getting this monster behind bars.

Does anyone honestly think that Raven will ever be arrested for Janet's murder? It seems that if LE had the evidence to arrest him it would have been done already. If they didn't get the evidence then it is probably to late.
I think that the guy has gotten away with murder and that he is well aware of it.

Yes.

I honestly believe he will be arrested tried and sentenced for the murder of his wife and unborn child.

I too believe he WILL be arrested for murdering his wife. I trust the detectives working on this case, it's the DA's office I worry about!

Duke lacrosse district attorney asks for special prosecutor in sexual assault case By AARON BEARD, Associated Press Writer
January 13, 2007

RALEIGH, N.C. (AP) -- As he aggressively pursued sexual assault charges against three Duke lacrosse players for nearly 10 months, Mike Nifong never wavered publicly in his commitment to take the oft-sensationalized case to trial.

But facing ethics charges that could lead to his disbarment, the Durham County district attorney quietly asked to be removed from the case Friday -- faxing a letter to the state attorney general asking for a special prosecutor to take over the case that is sure to define his nearly three-decade career.

"His withdrawing from the case has nothing to do with how he feels about the merit of the case," Nifong's attorney, David Freedman, told The Associated Press. "He's disappointed he has to get out of the case. He likes to see things from beginning to end."

What comes next in the troubled prosecution of Reade Seligmann, Collin Finnerty and David Evans will likely be determined by the lawyer appointed by State Attorney General Roy Cooper. His office declined to comment Friday night, but a spokeswoman said officials would speak with reporters Saturday.

"If he decides to take it, his staff is going to spend a significant amount of time to review the case files, interviewing the witnesses and making a determination on what is the proper process," said Peg Dorer, director of the North Carolina Conference of District Attorneys.
