Delores Futrell sounds like she was a wonderful, caring woman. How sad it is that a 19 year old neighbor slit this poor woman's throat.

Randall Diveney has a rap sheet that must be a mile long. He was arrested for the murder of Mrs. Futrell after DNA under her fingernails pointed to the guy she was kind to and cooked meals for. According to LE this nice woman was speaking to Diveney about his past and he snapped. :furious:

The Florida Supreme Court has thrown out the conviction and death sentence of Randall Deviney, saying Jacksonville police who questioned him in a 65-year-old woman’s slaying did not honor his constitutional right to remain silent.

Deviney, 23, was convicted of slitting the throat of Dolores Futrell in August 2008 with a fish filleting knife in her Westside home on Bennington Drive.

He was sentenced to death by Circuit Judge Mallory Cooper in 2010 after the jury that convicted him recommended death by a 10-2 vote.

Deviney now claims to have inside info on another murder, but says he will only talk if the death penalty is off the table for his retrial:

“The road to justice has been a long one for the families of Delores Futrell and Cherish Perrywinkle,” the State Attorney's Office said in a statement Tuesday. “Our hope is to get these cases before a jury as soon as possible.”

It was a new day but the same result for Randall Deviney Wednesday when he was sentenced to Florida’s Death Row for the first-degree murder of Delores Futrell...

In the second trial prosecutors got another conviction, and the jury recommended Deviney be executed by an 8-4 vote. The jury also made additional findings that the murder was premeditated and occurred during a burglary and an attempted sexual battery.

They were given an unpleasant task. And so after three days of testimony from psychologists, police and a tearful father who admitted he worked too much and wasn’t there enough for his wayward son, a 12-person jury Friday decided Randall Deviney should die.

The hearing in Jacksonville this week was the third time a jury decided Deviney should be put to death. It will likely be the last.

In October, after two days of testimony from detectives, forensic scientists, family members and psychologists, a jury unanimously recommended he be given the death penalty. On Monday, Judge Mark Borello formally sentenced Deviney to be returned to death row.

On Monday, Borello said the nature and cruelty of the crime and age of the victim were all factors that led him to give Deviney to the death penalty.

"All lives have value, but we are a nation of laws," Borello said. "Randall Deviney, you have not only forfeited your right to live among us, but under the laws of the state of Florida, you have forfeited your right to live at all.”
