Baez Expected To Pick Up Casey Jailhouse Video

ORLANDO, Fla. -- In the case against Casey Anthony, Eyewitness News expects to find out Wednesday if defense attorney Jose Baez picks up the jailhouse video taken of Casey the day she learned her daughter's remains were discovered.
Baez could have picked up the videotape on Tuesday, but Eyewitness News learned he did not pick it up.
On Monday, Baez convinced a judge not to release the videotape to the public until he has a chance to see it and find out how it was recorded.
The state made a copy of the videotape for Baez.
The judge has 15 days to either release the video or seal it.

Casey Anthony Answers Questions In Civil Suit

ORANGE COUNTY, Fla. -- Eyewitness News has learned Casey Anthony did answer questions under oath and in writing in a civil lawsuit she's facing.
Zenaida Gonzalez's attorney, John Morgan, submitted 17 different topics, some with multiple related questions, for Casey to answer as part of her deposition in the case.
Of the 29 total questions, Casey answered to only two. Casey wrote her name to answer the question asking for it, but had a much stronger response to another question.
"Were you involved in the death of Caylee?" question 17 asks.

"The defendant would object to the question and would move to strike it. This question is being brought solely to embarrass, harass and brought in an attempt to implicate the Defendant in an on-going criminal prosecution for First (1st) Degree Murder," Casey responded.

The document was signed by Casey and dated February 25.
A court hearing is scheduled for May 19 when Casey's attorney will attempt to get the lawsuit thrown out.

Casey Anthony won't answer lawsuit questions

It's official. Casey Anthony is not answering any written questions in the defamation lawsuit against her.
Now, the lawyers for Zenaida Gonzalez, 38-year-old mother of six, are going to ask a judge to force Anthony to answer the questions.
Circuit Judge Jose R. Rodriguez came up with the idea of written questions in January after Anthony's attorneys tried to block a videotaped question-and-answer session with her in jail.
The judge was trying to balance Fernandez-Gonzalez's attempt to clear her name against Anthony's rights in the criminal process.
Authorities interviewed the Gonzalez who later filed the lawsuit. She told them she didn't know Anthony or her daughter.
Detectives have said the babysitter story was one of many lies by Anthony that they discovered as they investigated the disappearance.

The next hearing for the criminal case, which Anthony is required to attend, has been set for March 12 at 3:30 p.m. Four motions will be heard, including a motion regarding access to George Anthony's suicide note.
Lawyers for Zenaida Gonzalez sent Anthony a 29-item questionnaire, but she would only answer two of them -- and one was her name.

The decision won't be made until all the evidence is back and it isn't yet."We do not know what all the evidence is and what the evidence absolutely means. There's a mountain of forensic evidence that has not been disclosed yet," WFTV legal analyst Bill Sheaffer said.
On the surface, many of Florida's death penalty legal arguments could apply. The murder could be cruel and atrocious, cold, calculated and premeditated. It may have happened while Caylee was being abused. Also, Caylee is younger than 12 and she was particularly vulnerable because she was allegedly murdered by a person she trusted.

But Sheaffer, who is a former prosecutor, says this is a circumstantial case, so the evidence linking Casey to Caylee's murder must be very strong for the State Attorney to seek death even if the legal arguments for the death penalty, called aggravators, outweigh the arguments against it, called mitigators. Sheaffer says prosecutors always consult with the State Attorney General's Office before seeking a death sentence, because the Attorney General has to defend it before the Florida Supreme Court. "It's a much harsher standard that the court applies in looking at the evidence as to whether the death penalty should be upheld," Sheaffer said.
There is no deadline for prosecutors to decide. What usually happens is, once they make the decision, they inform the defense right away so they can begin to prepare.


CASEY TO BE BACK IN COURT MARCH 12
Wednesday afternoon, the judge set a court date for Thursday, March 12.
Casey's attorney is trying to get access to more evidence in the case related to DNA tests and evidence taken from a computer belonging to Ricardo Morales, Casey's ex-boyfriend.

The clock is now ticking for Casey Anthony's attorney to block a jail house video from being released. Baez picked up a copy and is now reviewing the tape. He has two weeks to ask a judge to seal it.

On March 12, the lawyers will argue various requests made to Orange Circuit Court Judge Stan Strickland. Some of the issues to be discussed:

&#8226; The defense's request for the state and law enforcement to produce all DNA notes and reports and standards used to collect evidence.
&#8226; The defense wants the judge to sanction the state for not telling a defense expert that trash and other items were removed before he inspected the Anthony's car. The defense now asks for the notes and photos from the state's experts who inspected the removed items.
&#8226; Attorney for Casey Anthony's parents, George and Cindy Anthony, wants the judge to stop prosecutors from releasing the letter George Anthony wrote the night he threatened suicide.

Another Motion Hearing Set In Casey Anthony Case

In the first motion, Baez is looking to get a copy of all forensic evidence collected and reports regarding his client's case, including evidence from her car and other trace evidence specimens.
In the second motion, Baez is looking for copies of evidence found during the search of Casey's ex-boyfriend Ricardo Morales' computer.
Morales apparently posted a picture of a woman on MySpace with the quote "Win her over with chloroform."
Other motions include one to block the state from releasing George Anthony's suicide note, along with other documents from the case set to become public in a few weeks.
The hearing for the motions is set for Thursday, March 12 at 3:30 p.m.
