New motion in Anthony Case

Baez stated that his depositions with Lt. Tammy Uncer and Sergeant Billy Richardson paint a more accurate picture as the two were with Casey in the jail on that December day.

They told Baez that Casey was under the impression that "mental health wanted to see her."

Instead Uncer and Richardson said that the sheriff's office really wanted to capture her reaction on video.

Lt. Uncer told Baez that she was asked to do something out of the norm, which was to take notes on what inmate Anthony did when she learned the news.

Baez also quoted Uncer as saying her boss ordered her to take Casey Anthony to the medical unit before her attorney arrived.

New Attorney In Casey Case Expected To Be Revealed Thursday

However, it's the new face in court that's generating the most attention.

Casey Anthony's defense team is expected to reveal its new lead attorney.

Jose Baez has been in that role since last year when Anthony was first arrested. However, he doesn't meet the state's requirements to try a death penalty case.

The hearing is being held to determine if a videotape of Anthony's reaction to news coverage of the discovery of her daughter&#8217;s remains should be made public.

She first worked for the Cook County Public Defenders' Office-in the felony trial division, post-conviction/habeas corpus unit, preliminary hearing/first municipal (misdemeanor) unit, and the appeals division. Her last position there was Chief of the Homicide Task Force, a 22-lawyer unit that represents persons accused of homicide.

Andrea has tried more than 130 homicide cases, both within the public defender's office and elsewhere. She has defended more than 30 potential capital cases at the trial level. Of these, she has taken 19 through the penalty phase, and won them all.

In 1990, she founded the Illinois Capital Resource Center and served as its director until joining the University of Michigan Law School faculty in 1995 as an Assistant Clinical Professor. In 2000, she joined the faculty at DePaul.

Professor Lyon is a graduate of Rutgers University and the Antioch School of Law.

Judge Stan Strickland gave Baez one week to try to work out an arrangement with the witnesses who object to having their phone records released and provide the court with justification for the requests.

"At the end of business next Thursday, if I haven&#8217;t heard from you, I will deny the motion without prejudice so that you can refile it stating materiality and the numbers you're seeking and if all else fails I'll do an on camera inspection of the records that are provided," Strickland said.

According to a news release, Baez said he welcomes the addition of Lyon to Anthony's defense team. The team also includes Linda Kenney Baden, who concentrates in forensic evidence and Todd Macaluso, a California-based trial lawyer who concentrates in complex litigation.

Thursday morning, Judge Stan Strickland decided to postpone a hearing on whether video of Casey Anthony hearing of the discovery of a child's remains can be released to the media.

Strickland said he needed more information before ruling on the issue, which basically centers on Florida's Right-To-Know law.

During Thursday's hearing, lawyers for the prosecution and the defense butted heads about whether all phone calls and text messages from witnesses in the case should be released to the defense.

Lawyers for three people objected to the release, including the legal representatives for Roy Kronk, a deputy and former Casey Anthony friend Amy Huizenga.

Strickland granted the motions to release the phone records for the witnesses who did not object. He gave the defense seven days to work out the objections of the three witnesses.

The new attorney for Casey Anthony is a death-penalty expert from Chicago who has tried more than 130 homicide cases, her defense team announced today.

Professor Andrea D. Lyon is a clinical professor of law at the DePaul University College of Law in Chicago, where she also directs the law school's Center for Justice in Capital Cases, according to a news release.

"Professor Lyon has tried over 130 homicide cases. A former Cook County Public Defender in Illinois, she served as chief of the public defender's homicide task force," the statement said. "In 1990 she founded the Illinois Capital Resource Center and served as its director until joining the University of Michigan Law School faculty in 1995."

Circuit Court Judge Stan Strickland has delayed a decision on whether to block the release of a jailhouse video showing the reaction of Casey Anthony to news that her daughter's remains
had been discovered.

Judge Strickland said he wanted input from lawyers from the media before he rules whether the recording of Casey Anthony's reaction can be made public. Anthony was charged with murdering her two-year-old daughter Caylee.

The decision to release the video was put on hold, because Casey's attorney, Jose Baez, brought a late and incomplete filed motion to the court.

However, Baez will get access to two private investigators and her family's phone records because they did not contest the motion.

Baez will not get the phone records from Casey's ex-fiancé, Jesse Grund, Casey's former friend Amy Huizenga and meter reader Roy Kronk, because they did contest the motion to release the records.

Casey Anthony walked into the courtroom smiling at 10:05am Thursday, wearing a long sleeve blue shirt and striped gray slacks. Wearing her hair down, Casey smiled a few more times then turned serious as her lawyers spoke.

The newest member of Casey Anthony's defense team said there is no way Anthony's trial will start in October.

Andrea Lyon, a professor at DePaul University College of Law, was introduced at a hearing Thursday. Lyon is to handle death-penalty matters.

She said because she is just learning the case, she will need more time to prepare a defense.

Lyon also said she will prove the case does not qualify for the death penalty. She said motions will be filed in the next few months showing that the state does not have sufficient evidence to prove that Anthony's case is a death penalty case.

Casey Anthony's defense team argued that jail video should stay sealed and also introduced a new member of its team, DePaul University law professor Andrea Lyon.

Defense lawyer Todd Macaluso argued that a video of Casey Anthony taken inside the jail the day her daughter's remains were found should not be released. He said it violates her privacy and constitutional rights.

He accused Orange County Sheriff's Office and corrections officials of orchestrating the events that led to Casey Anthony watching a local television station as the December day unfolded.

"This is cruel. This is inhumane. This is illegal," he said.

A county attorney and prosecutor said they didn't object to sealing the video. But Strickland said he wanted to provide the media an opportunity to argue why it should be public record.

The owner of the property where the remains of slain toddler Caylee Anthony were found did not remove a massive makeshift memorial that had accumulated on the site, listing agent Tina Martin said.

Caylee's grandparents George and Cindy Anthony and the Orange County government have also said they did not remove the memorial.

Hundreds of stuffed animals, dirty and wet from exposure to the elements, had been at the site for the past six months, along with signs, religious items and a fair amount of debris. The memorial was removed earlier this week.

Outside the Orange County Courthouse Thursday, Lyon was quick to say she may be the lead attorney on paper but considers herself an equal member of an "excellent team," which includes Jose Baez from Kissimmee, Linda Kenney Baden from New York and Todd Macaluso from San Diego.

She said prosecutors are seeking the death penalty for "strategic reasons."

"You will hear about those strategic reasons in motions that I will be filing, challenging their right to even ask for the death penalty in these circumstances," Lyon said. "I believe Florida law simply doesn't allow asking for the death penalty in these circumstances."
