Anthony tries to stop bondsmen testimony

The Florida mother charged with killing her toddler daughter wants to force the head of a Texas-based search-and-rescue group to testify at her trial but wants to stop her former bail bondsmen from being a witness for the state.

Defense attorneys for Casey Anthony will argue in court Friday that the head of Texas EquuSearch should be a witness at her murder trial. They hope to use that testimony to show it would have been impossible for Anthony to dispose of the 2-year-old girl's body in woods near her home because she was in jail.

Anthony's attorneys also want to prevent her bail bondsmen from testifying for the state about what she told them about the case.

"There is substantial evidence that we've found ... that the body or remains of Caylee Anthony was placed there after Casey Anthony was locked up," said Todd Macaluso, a defense attorney. "It proves that somebody else placed the remains in the area."

Macaluso did not disclose the evidence.

The defense team hoped that testimony would show it would have been impossible for Anthony to dispose of Caylee's body in the woods because she was arrested and in jail two months before the discovery of the girl's remains.

Anthony's father, George Anthony, took the stand during the hearing during a motion heard about the dealings the Anthony family had with celebrity bounty hunter Leonard Padilla, who posted Anthony's bond after she was arrested on child neglect charges last summer.

Casey Anthony cried while her father was answering questions.

Anthony's defense team wants to prevent Padilla and his team of bail bondsmen from testifying for the state about what she told them about the case.

Defense attorney Todd Macaluso argued there is substantial evidence that Caylee's body was placed in a wooded area near the Anthony family's home after Casey Anthony was jailed.

Judge Stan Strickland said he would review the motion and rule as early as later on Friday. He said he was leaning toward allowing the defense to review the records to determine who they may want to question regarding search activities.

The court then addressed a motion to prevent the state from getting phone records from Anthony Lazarro. Lazarro's attorney said the defense narrowed their request for the records, and they're no longer objecting to turning them over.

Strickland ruled that Lazarro's phone records between June 1 and Dec. 18 would be provided to the prosecution.

Another motion was to bar privileged testimony from bounty hunter Leonard Padilla, Tony Padilla, Tracy McLaughlin and Robert Dick.

Strickland decided to allow the testimony of the four individuals which was contained on a compact disc. The judge planned to further review the disc before issuing a formal ruling.

There is also a motion that objects to the state setting a new trial date in Anthony's check forgery case. Strickland did not rule on that motion.

Todd E. Macaluso, one of Casey Anthony's defense attorneys, told the judge that they have found evidence that shows Caylee's remains were placed there after Casey Anthony was in jail.

"It proves her innocence," he said.

EquuSearch's attorney Mark NeJame is responding to the defense's request. He calls the request "absurd" and "too broad."

If someone had found something, that person would not have an expectation of privacy. But those who did not find anything should have their privacy, he said.

NeJame is offering the information of 32 volunteers who searched within 200 yards of the area.

He does not want Miller deposed in Texas. He would be willing to have Miller questioned if the scope of the interview was narrowed.

Cindy and George Anthony are in the courtroom with their attorney, Brad Conway.

They tried to sit in the first row behind the defense table, but the court deputies told them they had to move back a row.

Lead investigator John Allen and Detective Eric Edwards are in the courtroom.

The issues addressed during Friday's hearing will just add to the growing complexity of the case.

So far Judge Stan Strickland has decided to hold off on making a ruling about forcing Texas EquuSearch to turn over the names and information of volunteers who took part in the search for Caylee Anthony. There was no ruling either if Tim Miller, the founder of EquuSearch will be named a material witness in the case.

The judge did grant the defense access to some phone and communication records for Tony Lazzaro - Casey's former boyfriend.

Another motion includes keeping bounty hunter Leonard Padilla quiet. The defense wants to stop the former bail bondsman from being a witness for the state.

Prosecutors said Baez&#8217;s argument that he is &#8220;busy&#8221; is an excuse because lawyer Andrea Lyon has not quit her day job as an instructor and Baez has gained more clients since the state announced it would seek the death penalty against Casey Anthony. Prosecutors said Anthony&#8217;s defense team should be able to set aside one day for the check fraud trial.

Casey walked into the courtroom around 9:40am wearing a blue, long-sleeve shirt and a pair of grey pants. She was not nearly as happy-looking as previous court appearances.

At 10:42am, George Anthony took the stand under oath to answer questions from Jose Baez. The courtroom camera then showed that Casey had begun to cry, wiping tears away with a tissue.

George stepped down from the stand just before 11:00am and gestured a sign of support toward a still visibly upset Casey, mouthing "I love you," and sat down in the courtroom audience.

Casey's attorney asked the judge to allow her attorneys to interview the head of EquuSearch, claiming his testimony could prove her innocence.

WFTV legal analyst Bill Sheaffer says it'll be a hard sell to a jury that the mystery killer took great pains to keep secrets until November, after EquuSearch left, then killed Caylee and went to the area which posed the greatest risk of getting caught to hide her body, Caylee's neighborhood, where the media and law enforcement were often focused.

"Not only does it not raise reasonable doubt, it just defies logic. So the defense is gonna have a problem in that area," Sheaffer said.

Circuit Judge Stan Strickland said he would make a ruling by next week.

Bolden called attention to Casey Anthony's tears when her father took the stand to talk about the family's dealings with bounty hunter Leonard Padilla.

WFTV-Channel 9's Kathi Belich also highlighted Anthony's emotional reaction when took the stand. "When George got off the witness stand this morning, he looked at his daughter, Casey, as he walked past, with his hands folded and mouthed the words, 'I love you' to her."


Belich later said that Casey Anthony's body "actually shook" when George was called to testify. "She did not look at her parents when she walked into court," Belich said. "She shook hands with defense attorney Todd Macaluso instead."

At 12:30, WFTV showed Cindy Anthony talking to reporters about her daughter, Casey. "It was awesome to see my daughter today," Anthony said. "It gives me a lot of peace to see that she actually looks OK, she looks healthy. That's important to me."

Cindy Anthony Says There's No Book Deal

Cindy Anthony told WESH 2 News Friday that she and George Anthony do not have a book deal.

There has been some media speculation about a book deal. Before the start of Friday's hearing, Cindy Anthony said her hair dresser has encouraged her to write about the struggled that she and George have faced, but there is no book deal.

Her defense team did not give details about its evidence.

"I can't get into that," lead defense attorney Jose Baez said afterward. "We have said all along that we are going to try our case in the courtroom."

The defense considers work that Padilla and his team did is an extension of legal services provided by Baez. The information should not be made public during the trial, Baez argued, because it is covered under attorney-client privilege.

Prosecutors disagreed, saying what Padilla and others have to say is not privileged.

Strickland did not rule on the issue.

Anthony did gain one win on Friday. Strickland granted the defense team's request for Anthony's former boyfriend Tony Lazzaro's phone calls and "pings" -- signals that show a cell phone location at a given time -- from June 1 to Dec. 18, 2008.

Strickland did not decide today on the date of the fraud trial.

"It was awesome to see my daughter today," Cindy Anthony said, surprisingly upbeat. Her daughter is charged with the first-degree murder of her daughter, Caylee.

Cindy Anthony also told WESH that she and her husband, George, do not have a deal to write a book.

But defense attorney Jose Baez answered Texas EquuSearch by calling attention to footage of Anthony private investigator Dominic Casey searching the area in November. "It's clear it wasn't wet," Baez said.

And that strategy wasn't impressing WFTV legal analyst Bill Sheaffer. The defense team is arguing that someone else placed the toddler's body in the woods after her mother was jailed -- and that proves Casey is innocent.

WOFL-Channel 35 also studied Casey's tears. "Casey Anthony started crying when her dad unexpectedly took the stand," anchor Cale Ramaker said.

Reporter Holly Bristow said, "What I saw clearly in the courtroom: Casey Anthony shedding big tears, sobbing instantly the second her father started talking. Four minutes later, when the camera turns to Casey, she had calmed down."

WOFL succinctly recapped the issues. Anthony's team got access to her former boyfriend Anthony Lazzaro's phone records. But Judge Stan Strickland made no rulings on whether testimony from Padilla's team will be blocked, on whether Casey's check fraud will be delayed and on whether Tim Miller of Texas EquuSearch will be designated a material witness.

Casey Anthony: WFTV asks if defense is holding it together

At 6, the station studied mistakes by the defense team.

"Last-minute motions, incorrect motions, lack of motions -- it's not the kind of work we were told to expect from Professor Andrea Lyon, as the defense likes to call her," WFTV's Kathi Belich said.

Belich listed the mistakes: In seeking Texas EquuSearch records, defense lawyer Lyon had a last-minute motion with the wrong case number. Lyon hadn't filed the proper paper work to join the Anthony check fraud case. And the defense team failed to alert the media that it wants to keep public records secret.

"There were several missteps," WFTV legal analyst Bill Sheaffer said. And he added that Lyon had been touted as an expert and "a lawyer's lawyer."

What does it all mean? Could Anthony's legal dream team be a nightmare?
