UPDATED: Judge will set Casey Anthony's check-fraud trial date in near future
Casey Anthony's defense argued that preparing for the check-fraud case would hamper her legal team's ability to prepare for her murder trial.

The spokeswoman for Casey Anthony's attorney Jose Baez said the defense team's reaction to the judge's ruling is "disappointing."

"All our resources need to be focused on defending Casey Anthony from the State's determination to seek the death penalty," spokeswoman Marti Mackenzie said in an e-mail to the Orlando Sentinel.


In support of its motion, the state offered an affidavit from Amy Huizenga, Casey Anthony's friend and victim in the check fraud case. Strickland wrote in his order that he found Huizenga's affidavit "compelling."

"The affidavit states that the duration of this legal process over the last year has caused her a great deal of mental stress," Strickland wrote.

"After considering all of the factors and argument of counsel, this Court feels that the best resolution is to set the matter for trial in the near future," Strickland wrote. "In terms of legal skill and analysis, this case is rather simple."

Also this morning, the State Attorney's Office notified the media that more evidence will be released tomorrow morning. The information will include several audio and video clips. It is expected to include an interview with California bounty hunter Leonard Padilla.

Orange County Judge Stan Strickland ruled Thursday Casey will have to face check fraud charges before her murder trial.

Her defense tried to fight the motion but prosecutors won the day by arguing the victim wanted swift justice.

Legal experts said something else may be at work.

To win a death penalty case, prosecutors need aggravating circumstances, one of which is a previous felony.

"They want to do it so they can have an aggravating circumstances,&#8221; said Cheney Mason, a defense attorney. &#8220;If they get a conviction, they can pursue the death penalty, the statute requires the state proving aggravating circumstances."


More documents in the case against Casey are scheduled to be released Friday.

On Thursday the court announced that Casey Anthony&#8217;s trial for check fraud will be scheduled before her murder trial.

The Defendant argued that the forgery case would divert attention currently being paid to preparation of the capital case.

In terms of legal skill and analysis, the check fraud case will be rather simple. Few witnesses will be called, and excluding jury selection, should not take more than a day or two. The Defendant argued that the real problem will be jury selection. The State offered to go "non-jury" with a simple bench trial.

More discovery is expected to be released tomorrow.

If prosecutors have their way, Casey Anthony will already be a convicted felon before she stands trial in her daughter's murder. A judge ruled Thursday he'll schedule her check forgery trial before her murder trial.

WFTV legal analyst Bill Sheaffer believes there are unspoken reasons the defense wanted to put off Casey's 13-count check fraud trial. First, if Casey has any intention of taking the stand during her murder trial.

"If I were the prosecutor I would ask, 'Have you ever been convicted of a crime?'" Sheaffer said.

If she's convicted of stealing Huizenga's checks, she'd have to say yes.

"As soon as a jury hears that, it would be as though what a dog hears when you talk to a dog after you say its name, it's just blah, blah, blah," Sheaffer said.

If Casey is convicted of stealing the checks, it could hurt her chances of fighting the death penalty if she's convicted of the premeditated murder of her daughter Caylee.

"The greater likelihood that, one, you're going to have the jury recommend death and, two, the sentence of death would be upheld on appeal," Sheaffer said.

Judge Stan Strickland has ruled on the state's request for a speedy trial in the forgery case against Casey Anthony.

The defense argued that holding this trial before Casey Anthony's murder trial would hamper its ability to prepare for the murder trial.

The state offered a plea from Amy Huizenga, who is Anthony's friend from whom she allegedly stole money.

Huizenga said this has caused her mental stress; her name pops on the Internet in connection with the case which embarrasses her. Also, she worries it will hurt her chances of finding a job.

Strickland has approved the motion for a speedy trial, so the forgery trial will go before the murder trial.

Strickland will set a date for the trial in the near future.

The state has offered to go non-jury with this trial, allowing a judge to hear the testimony and rule on the charges.

Casey Anthony will face trial on check fraud charges &#8220;in the near future&#8221; -- long before her capital murder trial on the death of her daughter, an Orange-Osceola Circuit Court judge ruled in an order released Thursday.

Judge Stan Strickland granted the state&#8217;s motion to set the check fraud case for trial before the murder trial, which is expected to begin next summer.

Strickland said in his three-page order that he &#8220;cannot justify making the victim wait even longer to have this matter resolved."

The victim, Anthony&#8217;s former friend Amy Huizenga, argued in an affidavit that the matter has caused her a great deal of mental stress, great embarrassment and fears it will hurt her chances for gainful employment -- arguments Strickland said he found &#8220;compelling.&#8221;

Anthony is charged with 13 felony counts stemming from her allegedly forging and passing checks on July 10 and 15, 2008, after Huizenga left her check book in a car she let Casey use while Huizenga was on vacation in Puerto Rico that month.

The maximum penalty for each third-degree felony is up to five years in prison.

The date for Casey Anthony's check-forgery trial will be set soon, WKMG-Channel 6 reported at noon today.

What does it mean? "Casey Anthony could be a convicted felon by the time she faces trial next summer for her life in the murder of her daughter, Caylee," WKMG's Tony Pipitone said.

Anthony's defense team had asked for the check-fraud case to be delayed after the murder trial. Pipitone said the defense team told him today that it was disappointed in Judge Stan Strickland's ruling and that it needs to focus on the murder trial.

Pipitone speculated that the check-fraud trial could start this month or next. Anthony faces 13 felony counts in the forgery case, and each is punishable by up to five years in prison, Pipitone explained.

Strickland said that Amy Huizenga, the check-forgery victim, made a compelling argument to get the case over, Pipitone explained. Huizenga is Anthony's former best friend.

Casey Anthony: WKMG says duct tape on toddler was rare make

The duct tape found on Caylee Anthony's remains is rare and could be a major setback for Casey Anthony's defense, WKMG-Channel 6 reported tonight.

The defense has argued that Henkel duct tape was the best seller in the country, WKMG's Tony Pipitone said. Yet the tape attached to the toddler is a special make.

"This specific, industrial, fire-resistant tape is a tiny fraction of all the tape sold by Henkel," Pipitone said in a first-rate, eye-opening report. "We tried to buy some today. We couldn't find any."

And what does this mean? "It is extremely rare" and "a crucial find," Pipitone said of the duct tape.

Prosecutors said today in a court papers that they will explain how rare that tape is. And Pipitone said the prosecution will argue that the tape is a link between the body and Anthony. WKMG earlier reported that the tape found on Caylee's remains was similar to tape on a gas can in the Anthony home.

The station held its big find until 6:30 p.m. and teased to it several times. WKMG anchor Jacqueline London said "just within the last few hours" the station "exclusively uncovered how the state plans to use" the tape at the murder trial.

There was more bad news today for Anthony's defense team.

State: Duct Tape In Anthony Case 'Rare'
Prosecution Plans To Link Tape Found On Caylee's Body To Gas Can

Duct tape found both on Caylee Anthony&#8217;s body and a gas can found in the Anthony family home is a rare, industrial fire-resistant tape, according to a court filing Thursday by the Orange-Osceola State Attorney&#8217;s Office.

Investigators believe both the gas can and the body were at one time in the trunk of Casey Anthony&#8217;s car.

The industrial fire-resistant tape, marketed as &#8220;Fire Guard DUCK,&#8221; was manufactured by Henkel Consumer Adhesives, of Avon, Ohio.

Until it recently sold its duct tape division, Henkel was by far the largest manufacturer of duct tape in the nation, according to its Web site.

And, when Local 6 first revealed the same brand tape was found on Caylee&#8217;s body and in the Anthony home, her defense team dismissed that, noting how widely Henkel tape is sold.

But assistant state Attorney Jeff Ashton contacted the Henkel company, now known as ShurTech Brands, and discovered the tape found with the body and on the gas can was actually an extremely rare type of industrial fire resistant tape.

Only 134,719 rolls were sold in 2006 and 2007 in North America, according to the records submitted to the court Thursday.

That constitutes less than 0.2 percent of all duct tape sales during those years, based on more than $100 million in duct tape sales reported by the industry in 2002, the last year for which Local 6 was able to obtain data.

The odds of two pieces of randomly discovered duct tape manufactured in 2006 and 2007 being of that same, rare type approach 250,000 to 1. The odds of such a coincidence are much higher, if you factor in all the duct tape in existence, regardless of when it was manufactured, and determine how much duct tape sales have grown since 2002.
