State: Casey Dismissal Motion 'Flawed'
Prosecution Asks Judge To Throw Out Motion

Saying the defense's motion to dismiss was &#8220;legally flawed&#8221; and &#8220;inartfully&#8221; crafted, assistant state attorney Linda Drane Burdick asked the judge to strike the motion &#8211; meaning it should not be considered because it violated Florida Rules of Criminal Procedure.

&#8220;The flaws in Miss Anthony&#8217;s motion are glaring and fatal,&#8221; Drane Burdick wrote, saying Anthony herself would need to swear under oath to whatever facts she claims prove she is being illegally prosecuted.

&#8220;The court cannot even begin to consider the motion because Miss Anthony has alleged no facts and had not sworn to any material facts,&#8221; the prosecutor claimed.

The defense motion did not include a sworn statement from Anthony.

&#8220;If and when Miss Anthony decides to swear to any or all material facts, the State of Florida will issue the response required,&#8221; the state said.

The state&#8217;s motion to strike goes on to say that even if its evidence is &#8220;all circumstantial,&#8221; the judge must wait until the close of all evidence at trial before ruling whether the charge should be dismissed.

For the very first time in the case against Casey Anthony, her lawyer says he won't rule out the chance of a plea deal.

"Any plea that would ever be taken would have to be taken by Casey,&#8221; Jose Baez told Geraldo Rivera during an interview over the weekend.

Prosecutors still haven't publicly offered a deal to Casey, but over the weekend talk show host Geraldo Rivera asked Baez, with all the evidence against Casey, why not agree to a plea deal to save her life. Baez says it&#8217;s up to Casey.

&#8220;Well, that&#8217;s not my decision to make. Umm, that, any plea that would ever be taken would have to be taken by Casey and she would have to accept a plea, if one were offered,&#8221; Baez told Rivera.

&#8220;The proper response would have been, &#8216;Are you kidding me? She&#8217;s innocent! We pled not guilty. We are going to trial,&#8221; WFTV legal analyst Bill Sheaffer said.

Eyewitness News received no response from Baez in attempts to get his comments Monday.

WFTV legal analyst Bill Sheaffer scoffed at Baez's response: "The proper response would be: Are you kidding me? She's innocent. We've pled not guilty. We're going to trial."

Belich said noted that Baez started the Rivera interview by saying the evidence against Anthony is weak and the case should be thrown out.

Sheaffer again blasted the defense's approach: "There's one thing consistent about the defense. And that's their ability to continue to make inconsistent statements, one right after another."

Baez had no response to WFTV's story, Belich said. But WFTV put the Rivera interview at the top of its 5 o'clock news tonight. "Up until now, Casey's defense team and her family have insisted there would be no deal," anchor Bob Opsahl said.

State Wants Dismissal Motion Thrown Out In Casey Case

The state has filed a new motion in the case.

It all started with Casey's defense attorneys filing a motion saying that the charges of first-degree murder and child abuse should be thrown out.

The state said the motion is flawed and should be thrown out.

The state attorney's office actually calls the motion "glaring and fatal."

Casey Anthony case: State responds to defense's motion to dismiss murder and child abuse charges

Prosecutors in the case against Casey Anthony responded to her defense team's motion to dismiss the murder and aggravated child abuse charges by reminding them about Florida's criminal procedure rule.

Assistant State Attorney Linda Drane Burdick called the defense motion "legally flawed" and "glaring and fatal."

Last month, Anthony's defense team filed a motion to dismiss the murder and aggravated child abuse charges. They argue there isn't enough evidence to support the charges.

Burdick ended the state's response by adding that it will be decided at the "close of all evidence" if the state carried its burden of "excluding all reasonable hypothesis of innocence."

The judge has not ruled on the issue.

George Anthony appeared before a grand jury in October 2008, a day before his daughter, Casey Anthony, was arrested.

Circuit Judge Stan Strickland signed an order today that a transcript of Anthony's appearance before the grand jury -- an appearance that came a day before his daughter was indicted on a charge of first-degree murder in the death of her 2-year-old daughter -- be delivered to the State Attorney's office.

Prosecutors asked for a copy of the Anthony's testimony in preparation for Casey Anthony's murder trial, which is expected to begin next summer.

A copy of the testimony will enable prosecutors to compare that to the facts George Anthony gave during a recent deposition in the case.

1st Casey Anthony book details Casey's litany of lies
Freelance author Diane Fanning pens a 339-page book about a murder case that is not yet resolved

"Mommy's Little Girl" in no way can be construed as a pro-Casey Anthony book.

Author Diane Fanning tirelessly recounts the young woman's lying ways, theorizes how Anthony might have disposed of her daughter and concludes that Anthony is "an individual whose self-absorption and insensitivity to others is a destructive force."

Fanning divides the book in parts -- The Disclosure, The Past, The Crime and The Discovery -- that are made up of short chapters. The Past notes that Cindy Anthony was nicknamed "The Princess" in her family. The book touches on the Anthony family's money problems, George's gambling and Cindy's realization she couldn't afford a divorce.

"Mommy's Little Girl" traces George and Cindy Anthony's media interviews and their support of Casey. Why the couple shifted, from desperately trying to find Caylee to backing their daughter as a perfect mom, will have to be explained in another book.

Fanning takes liberties -- writing about what people were thinking, theorizing what happened to Caylee. For the most part, she sticks closely to the documented record, and she brings the book back to Caylee, the victim "who mattered the most." She was a rambunctious child who could count to 45 in Spanish. And she's still the reason that this story matters.

Just hours after he testified before the grand jury, his daughter, Casey Anthony, was indicted on a charge of premeditated murder and put in jail. Months later, prosecutors chose to pursue the death penalty. So the question is did George Anthony try to soften or change his testimony in August knowing that his daughter was facing the death penalty? Prosecutor Jeff Ashton said he will share the testimony with Casey Anthony's defense team.

In other news in the case, a new state witness has been named. Maitland computer store owner Jim Thompson claims he saw Casey and Caylee twice in the days leading up to Caylee's disappearance.

"I tried to go several times...It was at least six months before I went the first time because I didn't think what little I saw mattered," Thompson said.

Prosecutors in the Casey Anthony murder case will get a transcript of her father's testimony before a grand jury, a judge ruled on Tuesday.

Prosecutors said they want to compare George Anthony's grand jury testimony to a deposition he gave to see if there are any contradictions.

Casey Anthony's defense also wants a copy of George Anthony's grand jury testimony, but Orange County Circuit Judge Stan Strickland said only the state will get a transcript of the secret proceedings for now.

Several motions in the first-degree murder case against Casey Anthony will be addressed at a hearing next Friday.

Orange Circuit Judge Stan Strickland will hear the arguments for the motions at 9:30 a.m. on Oct. 16. Strickland will also preside over a status hearing in the check fraud case against Casey Anthony on the same day.

About 40 pages will be released to the defense. Most of those will be forensic entomology investigative reports, the state's court filing said.

The documents are being released to the defense as part of the discovery process. The items will later be released to the public.

Strickland did not call the motion to dismiss to be heard at next week's hearing, but did set for hearing the state's move to have that motion to dismiss cleared from the record because it is flawed.

Pipitone said it looks like Strickland is trying to clear the clutter over the defense's claims that she case should be dismissed. Strickland also did not call the defense's motion to bar the state from seeking the death penalty to be heard next week.

Defense Wants Charges Dropped In Casey Case

In order to get those charges dropped, prosecutors say Casey must swear the evidence they have is true and convince a judge it's not enough to convict her.

However, so far, she's only admitted to two things.

Also Wednesday, Casey's defense team got another 42 pages from prosecutors detailing forensic entomology reports from August 28 and December 11 of 2008.
