This is a very beautiful young woman that is missing out of SD. I hope everything turns out well but it does not sound good. This is my first thread start so please bear with me...

A burned-out car that contained a body in the trunk was removed from rural Hanson County on Wednesday and sent to the state crime lab in Pierre.

The South Dakota Attorney General's Office said the body was found in the car southeast of Mitchell and that it might be related to the case of a missing girl, 16-year-old Jasmine Guevara of Mitchell.

Roger and Judy Bartscher, who live near the scene, said the body was found in the trunk of the car, a Chevy Malibu.

OK I think that I have managed to attach a photo of the young lady. Keep your fingers crossed.

It appears that a funeral has been provided for, but they still have not released the remains, and that one of the accused is a 15-year old girl.

Guevara, 16, was killed Nov. 10. Two days later, authorities arrested Alexander Salgado, 20, and a 15-year-old girl whose name is being withheld because of her juvenile status.

The two are accused of stabbing Guevara, cutting her throat, putting her into a car and setting the car on fire.

from the Daily Republic article which won't let me get back to the story without registering.

How sad..what is driving young people to do such horrible things.:banghead:

Another life taken far too soon  & in such a horriable way. My heart & prayers go out to her loved ones. :prayer:

Guevara Family To Receive Free Funeral
11/20/2009 10:49 AM
<snipped>
Terry Rietveld of Will Funeral Chapel in Mitchell says he offered the teen's family a free funeral. Also, the city offered a free grave opening and closing at the city cemetery, Shafer Memorials contributed a grave marker, and Nepstad's Flowers and Gifts will give flowers.

No date has been set for the funeral.

Authorities say Guevara was killed November 10. Two days later, Alexander Salgado, 20, and a 15-year-old girl were arrested. Court documents say the motive for the killing is believed to be the girl's jealousy over a developing relationship between Salgado and Guevara.

In court documents, it becomes clear Alexander Salgado has a romantic relationship with his 15-year-old female co-conspirator, identified as "M-D".

Jasmine Guevara's murder is apparently the result of teen-aged jealousy.

All three attended a party this last sunday and in court documents, detectives say "according to witnesses, m-d became jealous because of a suspect relationship developing between jasmine and salgado."

A preliminary hearing has been set for Salgado on November 25th.

Remembering Jasmine Guevara
11/13/2009 4:55 PM

Jasmine was enrolled in an upper-level Spanish class taught by Teri Morgan. Morgan last saw Jasmine on Monday. Her empty desk is a difficult reminder of the tragic loss everyone in school is feeling.

"I miss her already because just from knowing her, since she was really little she would always speak Spanish to me from when she first came here and even before I had her in class, and she's just a little fireball," Morgan said.

Morgan says Jasmine came from a close-knit Guatemalan family steeped in Latino traditions. She says Jasmine would often speak proudly about her new baby brother. Jasmine also has a twin brother at Mitchell High School.

The 15-year-old girl charged in Jasmine's death does not attend the high school.

Serious charge such as murder could mean trying child as adult
12/02/2009
<snipped>
Although a state prosecutor association keeps no statistics on the number of South Dakota juveniles prosecuted as adults, the group’s executive director said teens involved in homicide cases often stand trial as adults. “It has been my experience, if it involves a serious charge such as murder, the person will be charged as an adult,” said Charles Schroyer, executive director of the South Dakota State’s Attorney Association.

Three weeks after a Mitchell girl was found dead in the trunk of a car, prosecutors are considering whether to try a second suspect as an adult.

As Mitchell residents wonder whether a 15-year-old girl will be tried as an adult in connection with the murder of another local teen, the state of Missouri is in the midst of an eerily similar case. In that state, it was determined last week that 15-year-old Alyssa Bustamante will be tried as an adult for the murder of 9-year-old Elizabeth Olten.

The remains of a burned out car and a body found inside it, discovered just south of Mitchell Tuesday night, are now in Pierre with officials for further investigation. Wednesday we learned a 16 year old Mitchell girl, Jasmine Guevara, is somehow connected to the burning car...but we don't know how.

Thursday we spoke with one of Guevara's friends about what they think happened to Jasmine. Some heavy thoughts are running through Amanda Nava's head as she plays with her daughter. Nava says, "I'm just hopin' it's not her." Nava is a friend of Jasmine Guevara's family. An autopsy will be performed on the body investigators removed from the car.

Hanson County prosecutors say two people are responsible for the death of 16-year-old Jasmine Guevara, whose body was found in a burned out car in a rural area of the county on November 10th. One of them is this man, 20-year-old Alexander Salgado of Fort Wayne, Indiana. The second suspect is a 15-year-old girl identified in court papers as "M-D".

Action News has been working to determine if this girl will be tried as an adult for Jasmine Guevara's murder.
Hanson County States Attorney Jim Davies told Action News that determination will be made by a judge after a thorough review of the evidence, including a confession she gave to investigators. When that determination will be made, davies would not speculate.

Salgado Wants Evidence Thrown Out

Alexander Salgado was in court Wednesday for a pre-trial hearing for his involvement in the murder of 16 year old Jasmine Guevara. The big part of the hearing today dealt with the defense's motion to supress 16 newly admitted exhibits of evidence that stem from Salgado's questioning prior to arrest.

According to an police interview transcript Salgado says "That's the truth now take me right to jail." The defense claims that this is an indication that Salgado is requesting to impose his right to remain silent and that anything gathered or testimony given after that point should be thrown out.

As for the state, they argue that that is not a clear indication and Salgado continued to speak and freely gave his testimony. The judge will now take time to review the tapes, exhibits and attorney briefs. A written ruling is expected later next week.

As the five witnesses recounted their testimony, Alexander Salgado showed no emotion. The family members of Jasmine Guevara were clearly torn by having to relive that painful day.

A 20-year-old Mexican national charged with murder in South Dakota will go on trial in January.

Maricela Diaz is charged in the 2009 death of 16-year-old Jasmine Guevara. Diaz was 15 at the time, but is being tried in adult court... Diaz faces up to life in prison if convicted.

From August 2010:

http://www.keloland.com/newsdetail.cfm/salgado-admits-to-killing-jasmine-guevara-/?id=104352

Twenty-one-year-old Alexander Salgado was carefully guarded as he made his way into the Davison County Courtroom. Once inside, he admitted he took part in the November 2009 killing of Guevara and was sentenced to spend the rest of his life in prison without the chance of parole.

http://www.argusleader.com/story/news/crime/2014/12/26/trial-set-mitchell-murder-case/20920585/

Maricela Diaz initially was charged with first-degree murder as a juvenile, but the case was moved to adult court in 2011. Since then, an alleged confession was suppressed by a circuit court judge, was reinstated by the state Supreme Court and considered for arguments before the U.S. Supreme Court, which declined to take up the issue this fall...

Salgado, who’s serving a life sentence without parole for second-degree murder, told police the two of them killed Guevara to assuage Diaz’s jealousy. He told police he hadn’t wanted to kill her but that Diaz initiated the violence.

Diaz’s lawyers say the notion that a former gang leader would be bullied into a murder by a 15-year-old he’d abused sexually and physically is nonsense, and they plan to argue that their client’s culpability is far less serious than her controversial confession would suggest.

http://www.keloland.com/newsdetail.cfm/trial-begins-for-2009-mitchell-teens-murder/?id=174146

Opening arguments have begun for the trial of Maricela Diaz, who is accused of killing 16-year-old Guevara in 2009. Guevara was friends with Diaz, who was 15 at the time, and Diaz's boyfriend, Alexander Salgado...

"Miss Diaz believed Salgado had a wandering eye. She began to get jealous, and soon that jealousy would turn to Jasmine Guevara. Miss Diaz was having no part of that. No one was getting between her and her man," Kempema said.

Kempema told the 14-member jury Guevara, Diaz and Salgado drove out into rural Hanson County, where they stabbed Guevara, put her in the trunk of the car, doused her in lighter fluid and set her on fire. "She was burned alive," Kempema said.

http://www.mitchellrepublic.com/news/local/3648298-guevara-murder-trial-begins

Kempema said on the night of Nov. 10, 2009, Guevara agreed to give Salgado and Diaz a ride in her new vehicle -- a 1999 Chevy Malibu -- to Walmart to purchase lighter fluid for a cookout and bonfire. Salgado and Diaz convinced Guevara to accompany them to a "haunted house" in rural Hanson County for the bonfire.

Guevara agreed and drove the couple, who had plotted the killing of Guevara once they arrived at the abandoned house, Kempema said. He said the couple took knives from the home they were staying at, and planned to stab and burn Guevara.

Upon arriving at the abandoned home, "Jasmine was no longer their friend. She was their prey."

Alexander Salgado, an inmate doing life for the murder of Jasmine Guevara, took the stand this morning in the trial of Maricela Diaz...

The questioning started with a chilling exchange.

Prosecutor: Why are you in prison?
Salgado: Because I murdered Jasmine Guevara.
Prosecutor: Why do you have a grin on your face?
Salgado: Because I don't care.

On Wednesday he refused to cooperate. He repeatedly asked to be taken off the stand. He refused to answer most of the questions he was asked. “All you need to know right now is that all of you are asking too many questions about this (expletive). She has nothing to do with it. It was all my fault,” Salgado said.

At one point while on the stand, he sat back in his chair as though he were taking a nap, silent as prosecutor Bob Mayer asked questions. He laughed at questions about his tattoos and gang affiliation. He refused to answer questions about alleged abuse of his then girlfriend, now accused murder, Maricela Diaz...

After an hourlong recess, the judge decided he’d seen enough and made Salgado unavailable for the remainder of the trial. As a result, both lawyers read an interview transcript from a previous preceding to the jury, which will be used as evidence against Diaz.

Alexander Salgado struck a deal with prosecutors almost five years ago: plead guilty to second-degree murder and testify against his co-defendant and former girlfriend and the state's attorneys wouldn't seek the death penalty...

The state's attorneys in the case declined to comment on Salgado's behavior until the Diaz trial is over, but other legal observers said his uncooperative testimony probably opens a door for the state to pursue a tougher sentence...

However, Salgado's case could prove to be more complicated because he's already serving time. Pommersheim said it would be unusual for a judge to make a ruling that a plea agreement should be vacated.
