Attorneys to ask judge to block death penalty

A hearing in Casey Anthony's case was held Friday morning in Orlando. Attorneys for Anthony asked the judge to stop prosecutors from seeking the death penalty. They also wanted the Orange County Jail to stop videotaping visits to Anthony from attorneys, family and friends.

UPDATED: Casey Anthony case: Lawyers make arguments about death penalty and jail recordings

Strickland told prosecutors to issue a investigative subpoena. If anything else comes out, the court can address it next week, which was when the initial deposition was scheduled.

*Death penalty

Ashton said Caylee died with duct tape over her nose and mouth. A child that age should have been able to remove the tape -- so she must have been chemically or physically restrained, he said.

There is a misunderstanding why the state opts to seek the death penalty, he said. A jury will decide this case, and then the court. The state isn't deciding to seek the death penalty.

Strickland said he would rule as quickly as possible, and told the court he saw "good lawyering.".

*Lawyers argue about jail recordings

Lyon said even if their meetings are just to say "I love you," it will appear on the front page of the paper and on TV.

The judge did not rule on the jail video issue.

"Her killer prepared some substance in advance that would render physically unable to resist, administered the substance, awaited its effect and then methodically applied three pieces of duct tape to completely cut off the flow of air through her mouth or her nose and let nature take its course," prosecutor Jeff Ashton said. "At least Caylee wouldn't have any fear. How would jurors apply those facts to the law the court will give them? If she was physically restrained, her killer would have to have restrained her arms by some means, applying tape while she was conscious. As the killer looked into her face, maybe her killer even saw her eyes as the tape was applied -- first one piece, then two, then three -- so that no breath was possible. Could Caylee have understood what was happening to her? Did she try to resist? Could her killer see the fear in her eyes as the tape was applied? These are questions only jurors will be able to answer in this case."

UPDATED: Will Casey Face Death Penalty?

The judge in the case against Casey Anthony heard three key motions, including whether the state should be able to seek the death penalty.

Judge Strickland said the check fraud case will be resolved before the capital case, either by plea or trial, and that she would be treated fairly by the judge, as she has no priors.

The judge said he would likely rule on all three of the motions later Friday or early next week.

Friday’s proceedings may have been especially hard for the Anthony family, as it marked the one-year anniversary of the day little Caylee’s body was found.

•As her attorney was arguing for the jail to turn off video during family visits, Casey Anthony started crying for several minutes. An attorney representing the county said the jail is following the law, which makes such visits public. The judge did not rule on the motion.

•Prosecutors argued for the right to subpoena private investigator Dominic Casey, who worked for the defense during 2008. There have been questions about whether what he knows is covered by attorney-client privilege. Judge Stan Strickland told prosecutors they could issue an investigative subpoena.

•Anthony's attorneys also argued to dismiss some of the check fraud charges against Anthony. The judge did not rule, but said he expected those charges to be handled before the trial begins on the murder case.

Casey broke down in tears when Judge Strickland basically didn't rule on much, saving rulings on the most important motions for either later Friday or next week.

Casey cried as her attorneys explained that she's had no conversations with her parents for one year because all of them are recorded inside the Orange County jail. Casey’s attorneys say, more importantly, their conversations with their client are compromised when security cameras are on them inside the jail.

Casey broke down in tears yet again when a prosecutor described a scenario that might have led to Caylee’s death.

“If she was physically restrained, her killer would have to restrain her arms by some means, applying tape while she was conscious,” the prosecutor said. “As the killer looked into her face, maybe her killer even looked into her eyes as the tape was applied. First one piece, then two, then three, so that no breath was possible.”

A plastic bag of child's bones found in a wet, wooded area Thursday could solve a months-old mystery: Where is Caylee Marie Anthony?

But can it answer a more perplexing question: What happened to her?

An Orange County utility worker discovered a child's remains among vines and twigs about two blocks from the home on Hopespring Drive where Caylee lived with her mother and grandparents.

"The bottom line is real simple, folks," Sheriff Kevin Beary said. "We recovered this human skull. It appears to be that of a small child. Now the investigation continues."
