Tempe police booked Johnson into the Fourth Avenue jail at early Sunday. She is being held on $1.1 million cash bond.

Elizabeth now faces charges of kidnapping, child abuse and custodial interference.

Jack and Tammi Smith tried adopting Gabriel Johnson in December, in the weeks leading up to his disappearance.

They maintain they played no role in that disappearance and have no idea where Gabriel is, but investigators believe the Smiths aren't sharing everything they know.

One reason why is a posting from Tammi Smith's Facebook page from December 23 days after Gabriel's mother took him from Arizona.

She wrote "please keep praying for Gabriel and his mommy's safety on the road. She found underground help in Texas that's given her formulas, diapers, and legal formalities."

The Smiths say they're now angry with Gabriel's mother 23 year-old Elizabeth Johnson.

She's still in custody in Miami, not helping police, waiting to be brought back to Arizona.

Jack and Terri Smith spent hours at the Tempe, Ariz., police station answering questions as part of the police investigation into the disappearance of 8-month-old Gabriel Johnson.

Police said Thursday they believe the Smiths, who had wanted to adopt Garbriel, may know more about the missing child's whereabouts than they're telling investigators.

"We are getting some indications that Gabriel is alive," Carbajal said Thursday. "We can't say specifically just what those are, but we are getting some indications that those are correct."

The Smiths have given numerous media interviews in recent days where they said they met Johnson at an airport during a long layover and befriended her. Terri Smith said the young mother wanted to give up her baby for adoption but the ex-boyfriend wouldn't go along.

Elizabeth Johnson's grandfather says she grew up with a drug-addicted father and an alcoholic mother and then bounced around five different foster homes.

She has always been impulsive, secretive and prone to fits of rage. A relative says that as a child, she would break windows in her home and chased her father with a plunger.

Yet she carried a 4.0 GPA through high school, and she was determined to not let her son suffer the same kind of childhood she had.

That is why her grandfather Bob Johnson says he can't believe she would harm her baby, Gabriel, even to get back at the boy's father.

"She's got a spiteful streak," said Bob, who is the person Elizabeth has turned to the most since her parents died.

"She has a pattern of physical destruction," he said. "I don't know why she hates Logan so much. He tried as hard as he could to make her happy, but she's a tough horse to ride."

Court records and interviews show that Elizabeth's fights with McQueary were so violent that she cut up his clothes and broke windows in the apartment they shared. Elizabeth was charged with domestic-violence-related criminal damage and went into a diversion program, court records show.

McQueary got an order of protection against her in September, but it took only days for the couple to make up. He didn't appear in court, and the order was quashed.

When asked if Elizabeth was capable of following through on the threats she made to McQueary, Bob paused.

"I think anybody is capable, including Elizabeth, in a fit of rage," he said.

The mother at the center of a missing baby case is being held on a $1,100,000 cash bond after she was extradited to Arizona and booked on multiple charges, according to the Tempe Police Department.

Late last week, FBI agents in Nashville rushed to a home after getting a tip from agents in Miami that Gabriel Johnson might be there.

Exactly what evidence Elizabeth Johnson offered that led authorities to Nashville is still unclear.

But it was enough to have FBI agents rush to the home in Nashville, a city to which her friends say Elizabeth has never been.

"We went, knocked on the door, and interviewed the occupants and have been unable at this point to locate the child," said FBI Special Agent Keith Moss.

In an exclusive interview with CBS 5 News from her jail cell last week, Elizabeth Johnson said she has no idea where her little boy is.

Johnson said even though she did not harm her baby, she&#8217;s not worried about his safety now.

When asked whether she&#8217;s worried her baby is dead or alive, she said, &#8220;No, I&#8217;m not.&#8221;

Johnson's first phone call from jail Sunday morning was to her grandfather, Bob Johnson.

Bob Johnson said, "Well my telephone rang and it was my darling granddaughter calling me from the Fourth Avenue Maricopa County Jail."

Just hours after her booking photo was snapped, Elizabeth was calling to say hello.

"She seemed in a very happy, upbeat mood, " Bob Johnson said. "I guess in her mind she's accomplished her goal, which was to adopt her son, give him to somebody."

Johnson said it was a short talk that only lasted a couple of minutes. He said he didn't ask any questions about where 8-month-old Gabriel might be.

He said, "I chose not to, that she had stated what happened and I knew we were on a recorded line and she isn't going to tell me anything on a recorded line that would be of any value."

Mother of missing child returned to Valley

The Valley woman who is not cooperating with police in the search for her missing 8-month-old son has been extradited from Florida to the Tempe jail, police said Sunday afternoon.

Tempe police also announced that Elizabeth Johnson faces charges of kidnapping, child abuse and custodial interference. She is being held on a cash bond of $1.1 million.

The Tempe woman claimed she killed Gabriel Johnson and left him in a dumpster, but police believe the child is still alive. The child&#8217;s disappearance has sparked a nationwide search.

After arriving in the valley, Elizabeth Johnson telephoned her grandfather, who lives in Scottsdale.

"I can't even imagine Elizabeth hurting that child or anything worse," Bob Johnson told FOX 10. "It's unbelievable she would. She's a stubborn young lady, she has got a plan and I suspect she implemented it."

Authorities are calling a Scottsdale couple "persons of interest" in the case. The Smiths tell police they befriended Johnson at an airport and she offered to give her son to them to adopt -- but the baby's father didn't agree.

According to the Maricopa County Sheriff's Office, Elizabeth was booked into an Arizona jail late Saturday on charges of custodial interference and kidnapping.

Her cash-only bond is set at $1,100,000.

Two other people named 'persons of interest' in the case said they took a polygraph test last week.

Tammi and Jack Smith of Scottsdale said they were willing to take the examination after being named suspects on Thursday.

"There is an enormous amount of peace in the truth and the truth is what it is and I can't fabricate the truth," said Jack.

The Tempe Police Department is leading the investigation. According to Spokesperson Steve Carbajal, investigators believe the Smiths have undisclosed information that will lead them to baby Gabriel Johnson.

"We should have been persons of interest from day one," Jack said. "We are persons of interest. We were probably the last people to see Gabriel before he left town."

Carbajal said Elizabeth initially told authorities she gave her baby to a couple she met in San Antonio while on the run after skipping out on a custodial hearing in Phoenix.

"They wanted the baby and she simply gave it to them," said Bob Johnson, Elizabeth's grandfather. "It sounded like a pretty weak story. It was almost on the border of unbelievable that a person would do that with an 8-month-old child."

But Johnson also said he doesn't believe the Smiths had anything to do with Gabriel's disappearance.

Both police officials and the Smiths say they believe Gabriel is alive. Now the challenge is finding him.

Police are now following leads tying the Smiths to the Nashville, Tennessee area.

McQueary was granted custody after Johnson didn't show up for a custodial court hearing and allegedly fled the state with the child.

He has made many public appeals to find the 8-month-old, but court documents now reveal he may not be Gabriel's biological father.

In her petition for custody on Dec. 14, Johnson wrote that there were "two potential fathers," and requested that both McQueary and another man, Craig Cherry, take paternity tests.


Cherry said he had no comment on the case when reached by phone Sunday.

"If they're looking for a place for Gabriel to go, we have the father, and the father wants his baby boy back," said Sgt. Steve Carbajal. "That's the bottom line of this whole case."

In court documents, Johnson said she feared McQueary would kidnap the baby and leave the state.

Three days earlier, McQuary filed for custody, saying he feared Johnson would kidnap the baby, and that she was neglectful and unstable.

In the statement, McQueary wrote that Johnson would leave Gabriel crying in his crib for hours without changing his diaper, and that she kicked McQueary out of their apartment, saying, "Take that damn baby with you."

According to documents, he had previously filed a restraining order against her, after he said she trashed their Tempe apartment, causing thousands of dollars in damage.

Though police say they are confident the baby is alive, McQueary said in his statement that Johnson called him after she disappeared with the boy, saying she was planning to leave the country, and that she would tell him where Gabriel's "blue" dead body was once she had crossed the border.

Recent tips led police to Nashville, Tennessee, where one couple, Jack and Tammi Smith -- persons of interest in the case -- apparently had connections to the boy's mother.

"We found no indication that Gabriel has been in the area, but because of the two ties we have with Elizabeth Johnson and Tammi Smith, obviously we're going to make sure every stone is uncovered and do what we can to find this boy," FBI spokesman Keith Moses said.

Meanwhile, the Smiths, who had hoped to adopt Gabriel, have said they think Elizabeth is trying to protect the child from his father, Logan McQueary. He now legally has custody of Baby Gabriel.

McQueary also has a criminal history -- he was arrested for felony burglary, DUI and drugs.

"He's admitted that, we've admitted that, and that's not something that's a secret," Sgt. Steve Carbajal with the Tempe Police Department said. "But what we're talking about now is Gabriel. So if they're looking for a place for Gabriel to go, we have the father. The father wants his baby boy back. That's the bottom line of this whole case. That's what we're doing here."

"Yeah, I screwed up in the past. And pretty much I've been working my hardest to get back on track, and I have been," McQueary said. "All I've been doing is staying out of trouble and going to work, stuff like that. I was right next to Elizabeth and Gabriel the whole time. We were living together, and taking care of them -- working my hardest."

The baby's mother -- who initially said she killed her baby, then said she gave him away to a random couple at a San Antonio park -- has also had prior run-ins with the law.

She was arrested for domestic violence and criminal damage after she allegedly had a tantrum at the Tempe apartment she shared with McQueary.

Gabriel's father, Logan McQueary, desperately wants his son back, notes "Early Show" national correspondent Hattie Kauffman. Elizabeth sent him a text message saying she had killed Gabriel, but later claimed she gave him away to the strangers in San Antonio.

"I really have a hard time believing she just randomly gave Gabriel, the little prince, to somebody in a park," Bob Johnson remarked.

But, Kauffman says, Elizabeth Johnson had already promised the baby to another couple, Jack and Tammi Smith. She met them in an airport seven months ago and, early last month, they took Gabriel into their home, with adoption an option.

Tammi Smith told "Early Show" co-anchor Maggie Rodriguez Monday she and her husband don't have any idea about Gabriel's whereabouts. "I sure wish we did. I sure wish (Elizabeth) told us any name, any -- of anything," Smith said.

"We spent ten years building a successful business here (in Scottsdale)," Jack Smith said, "and, for us to throw that away, or even the thoughts of throwing that away for someone we had known for nine days, that's ludicrous. No, absolutely not."

So why do they think police consider them persons of interest?

"Well, we should be!" Jack responded. "We were the last people to see Gabriel before he left Arizona. So I was not shocked at all that they named us. ... Whatever they have to do and whatever they -- because, we had a week and a day prior to them actually doing it, we asked for a polygraph test. If this will clear up -- 'If you think we don't know something, give us a polygraph test, and then let's go on and focus on where we need to.' And that is to find this baby and give this wonderful, wonderful child back to its rightful family."

They took the test. Results aren't back yet.

Tammi says that, while Elizabeth was never all that affectionate toward Gabriel, she doesn't think Elizabeth could have hurt him. "She seemed to want the best for him," Tammi says.

An Arizona mother accused of hiding her infant son from his father on a cross-country trip has been charged with kidnapping and child abuse, and she has still not told police where she left the baby or whether he's even still alive.

Elizabeth Johnson, 23, was extradited to Arizona, and investigators are now looking at another couple who had been in talks to possibly adopt Johnson's son, Gabriel, as persons of interest.

Though Gabriel was last seen by witnesses in San Antonio, the FBI went to Nashville, Tenn., to investigate leads that did not, authorities said, turn up evidence on Gabriel's whereabouts.

It was a story she also relayed to Tammi and Jack Smith, the couple who said they were ready to adopt Gabriel from Johnson before she fled. They denied knowing where Gabriel was being kept, but police believe they may be hiding information.

In a jailhouse interview this week with a Phoenix CBS affiliate, Johnson denied harming their son, saying she told McQueary she had killed Gabriel to get back at him.

"He had ruined my life, and he hurt me, and I wanted to hurt him," she said. "And that was the only thing I could say that would hurt him."

She claimed in the same interview that she didn't know anything about the couple she left her son with, other than that they seemed trustworthy.

Johnson's grandfather, Bob Johnson, told ABC News that he doesn't believe his granddaughter's story that she simply left her child with an unknown couple.

"I think that she has given the baby to somebody, and I think she knows who it is," he said. "I think it's in San Antonio in somebody else's house, and she just ain't given it up.

"She has an anger-management problem, and she's working on that," Bob Johnson said.

A search of Johnson's car -- found by the FBI last Tuesday in San Antonio -- yielded no obvious clues or evidence of violence, police say.

Motherhood was never really Johnson's strong suit, Bob Johnson said.

"She discovered after eight months that there's more to this parenting than she wanted to get involved in," he said. "It was not her thing. She was into fashion."

"The father and Jack and I were in constant contact when we found out Elizabeth fled with the baby," Tammi Smith said. "When we finally got to speak to Elizabeth, she was so angry with the whole situation and told me, 'I have one message to give to Logan.'"

That message, Smith said, was sign the papers and the baby will be brought back.

Elizabeth Johnson, the Arizona mother at the center of the "baby Gabriel" case involving her missing son, has been charged with kidnapping, child abuse and custodial interference.

The Tempe Police Department said Sunday that Gabriel Johnson's 23-year-old mother is being held at the Maricopa County jail on the three felony charges after being extradited from Florida, where she was taken into custody Dec. 30 after failing to show up for a custodial hearing in Phoenix.

Police say she's being held on a cash only $1.1 million bond.

Appearing on HLN's "Nancy Grace," Pat Brown, a criminal profiler and author of "Killing For Sport," told Nancy Grace that she did not see the investigation ending well for the child. Although police have not disclosed why they believe Gabriel Johnson might still be alive, Pat Brown said that she could think of nothing that would lead authorities to believe it, either, given what is known about the case and the histories of individuals acting the way Elizabeth Johnson has for the past couple weeks. "My opinion is that baby is not with us," she said.

What led her to such a grave conclusion? First of all, Elizabeth Johnson's own words to the baby's father, Logan McQueary, indicate a cold, vindictive nature. She told him she killed the child, placed his small body in a diaper bag, then put the bag in a dumpster in San Antonio, Texas. That admission might have led Brown to think that Johnson just might have killed her baby. Another good indicator that the baby may be dead was the carseat and baby clothes left behind in a hotel room in San Antonio as if unneeded.

In a taped interview, Logan McQueary said that Johnson had called and told him he needed to sign some papers on December 9. He refused. He said he never saw the papers, but he knew that Elizabeth Johnson was attempting to allow the Smiths to adopt his child.

Offering up various scenarios of the investigation, Brown pointed out to Nancy Grace that at one point Johnson probably "got tired of that baby and wanted vengeance on her boyfriend so she just killed the baby."

Elizabeth Johnson's actions seem strange when looked at in retrospect. Her story of giving her child, a child she professed to love, to total strangers makes little sense, but, then, that was how she originally met the Smiths. They had come upon the young woman, distraught and crying, in an airport. Gabriel lay at her side. She told them she could not care properly for the child and was looking for someone to adopt him. The Smiths gave her contact information and over the course of several months proceeded to work with Elizabeth Johnson to actualize adopting the baby. But Logan McQueary, who was fighting his ex-girlfriend for custody, refused to go along with Johnson's plan.

Although Pat Brown said she believed the child was no longer alive, telling Nancy Grace that she just could not believe that Johnson simply found a couple to whom she gave her baby, until there is tangible evidence, there lingers a bit of hope that that is exactly what Elizabeth Johnson did simply to keep him from her ex-boyfriend. But Tempe Police do know that Johnson spent five days in San Antonio. Tempe Police also have not made public everything they have in the case of the missing child, so it is unclear why they remain optimistic that the missing child is still alive.

Still, the one person who has the most knowledge of the circumstances of Gabriel Johnson's disappearance has decided not to cooperate with authorities. All she has left investigators with are two disturbing possibilities, neither of which bode well for her or Gabriel Johnson.

An Arizona couple who tried to adopt an 8-month-old baby who&#8217;s been missing since Christmas say they now feel the mother of the baby duped and used them.

In an interview Monday from their Scottsdale, Ariz., home with TODAY&#8217;s Matt Lauer, the Smiths said they once thought Johnson was a good woman who was overwhelmed by being a single mother. That opinion has since changed dramatically.

&#8220;I feel like a fool, because knowing what&#8217;s up now that all the facts have been laid out in front of me, I see that she was lying to us and playing us,&#8221; Tammi Smith told Lauer. &#8220;Now, I&#8217;m not sure if anything she said to me was true.&#8221;

Her husband characterized Johnson as &#8220;deceptive.&#8221;


Elizabeth Johnson told the father of baby Gabriel that she had killed the child, but then claimed she had given the child away. Police think Gabriel may still be alive.

Whether Johnson researched Tammi and Jack Smith as potential adoptive parents for her son Gabriel is unclear, but knowing their histories, she probably couldn't have picked a better couple in which to spin her tale of woe.

Tammi Smith said her former husband abused her and after several years of fighting, she lost custody of her three daughters. Jack Smith also put up a fight for custody of his granddaughter, Hannah, from her biological father.

The Smiths admitted they saw their own heartbreak in Johnson's tearful blue eyes and believed every word.

"He was an upstanding person," said Gabriel Salas, McQueary and Johnson's neighbor. "He was doing everything he could to keep his family together."

Even Johnson's grandfather, Bob Johnson, told CBS 5 News that it wasn't McQueary but Elizabeth Johnson who had volatile tendencies, and was even arrested for trashing the apartment she shared with McQueary.

"Sometimes she just went crazy," McQueary said.

During the investigation, officers found Gabriel's collapsible crib was hastily tossed in her shed upside down, which possibly indicates she knew she wouldn't need it.

Even when they knew Johnson was on the run, they put her in contact with Janet Morris, an adoption specialist in Nashville, Tenn.

The FBI searched her house as part of the investigation into Gabriel's disappearance.

According to court documents, Morris was once challenged for allegedly stripping a father of his parental rights without properly notifying him -- exactly what the biological father of Tammi and Jack Smith's adopted daughter, Hannah, says the couple did to him.

Tempe investigators said they still think the Smiths know more than they are saying.

The results of Tammi and Jack Smith's polygraph tests were inconclusive.

Elizabeth Johnson still has no comment.

As of Monday, it had been nearly two days since Elizabeth Johnson was booked at the Fourth Avenue Maricopa County jail, and she still wasn't telling anyone where her son might be, she wouldn't even confirm that he's still alive.

Tempe Police Department Commander Kim Hale said, "There's three separate things that can happen. You can be deceptive, inconclusive or you can be truthful. At this time, it was scored by two different polygraph examiners and both rated it close to the same as inconclusive."

Jack Smith interpreted that question mark a little bit differently. Smith said, "Because it's not a truth detector, it's a lie detector. I did not lie, and so that's why it came back inconclusive."

He and his wife, Tammi Smith, are still persons of interest in Gabriel's disappearance. Investigators said the couple has been cooperative, but it's possible they know more than they're letting on.

Prosecutor Belle Whitney said at a court hearing Sunday that Johnson has done nothing to help police find her baby.

CBS 5 News reported Thursday night that Tammi and Jack Smith, the couple who tried to adopt Gabriel and who have been named as persons of interest in his disappearance, used to live in Nashville, Tenn.

Late last week, FBI agents in Nashville rushed to a home after getting a tip from agents in Miami that Gabriel Johnson might be there.

Exactly what evidence Elizabeth Johnson offered that led authorities to Nashville is still unclear.

Johnson and Gabriel's biological father, Logan McQueary, had been in an ugly custody battle. McQueary is listed on the birth certificate, but when Johnson filed court papers, she indicated another man could also be the father. That man is Craig Cherry.

Today, Tempe investigators said they interviewed Cherry and he told them he had never met Johnson and never talked with her. Cherry also told police that he was related to Tammi Smith. Commander Kim Hale, who is heading up the investigation for Tempe police said that information surprised him. "That was information that would have been probably helpful to us in the very beginning," said Hale. He also said that in all of the police interviews with Tammi Smith, she never mentioned she was related to Cherry. Police used that omission as an example of why they believe the Smiths are withholding information and why they are still considered persons of interest.

In a phone interview with CBS5, Cherry said he was Smith's first cousin and that the two are very close. Cherry also reiterated that he had never met Johnson and that he could only speculate as to how she learned his name, in order to use it on court documents.

But later Tuesday night, in a call to CBS5, Tammi Smith tried to explain.

"I remember the conversation between me and (Elizabeth). We were laughing about it and I just commented on how Logan (McQueary) and my cousin (Craig Cherry) have the same record about DUI's and stuff and we were making a funny joke about that."

But in the same call, Tammi Smith admitted she drove Johnson to court to file the paternity request. She even made three copies of the paperwork that clearly labeled her cousin, Craig Cherry, as the possible father of the boy she wanted to adopt.


Smith says she would have been forthcoming with investigators, but she doesn't remember them asking her about Craig Cherry.

Tempe police confirmed late Tuesday night that they had investigators in San Antonio, the last place baby Gabriel was seen the day after Christmas, searching for clues.

Chilling new details paint a picture of a family in hiding, keeping 8-month-old Gabriel Johnson out of the public's eye. It was new information coming from Elizabeth Johnson. Tammi Smith went to visit Elizabeth in Estrella Jail Wednesday.

Smith said, "I asked her questions about what these people looked like."

Smith said Elizabeth gladly described the couple she claims she gave Gabriel to in a San Antonio park. Johnson said the woman is between 5'1" and 5'3" and weighs somewhere between 110 and 125 pounds. Johnson told Smith the man was tall, a bigger guy with dark short hair. She said the couple is Caucasian, in their mid-30s and lives in San Antonio.

Smith said Johnson told her she's shared all this info with the FBI, after she found out about how much jail time she might face.

"She does want the baby to come back now, now because she wants to get out of jail, " Smith said.

But from what Smith said she heard Wednesday, that might not be an option.

Smith said, "They're telling her that this baby in two to three years won't be able to be recognized? Maybe they're going to stay in hiding for a while until they think it's time to come out."

Elizabeth Johnson, the Arizona mother jailed after she disappeared with her about-to-be-adopted infant son, confirmed today in a brief jailhouse interview that 8-month-old Gabriel Johnson is alive.

The Smiths have stuck by Johnson, but recently told ABC News that they are frustrated and want Johnson to tell police what she did with the baby. Tammi Smith told Johnson in jail that she and her husband have been blamed for Gabriel's disappearance.

"I am so, so sorry about that," Johnson replied. But still, no word on where Gabriel is.


Mom Describes Mystery Couple Who Supposedly Have Her Baby
Johnson said the couple is Caucasian, in their 30s. The man is tall with short black hair, and the woman is about 5 feet, 3 inches tall and has short black hair.

Johnson said the couple brought their own car seat and that they said they could keep baby Gabriel without anyone noticing.

Johnson also told ABC News that her time in jail has not been that bad. She has been able to see her lawyer every day and gets to spend time outside during her recreation hour.

Johnson's grandfather, Bob Johnson, told ABC News that he doesn't believe his granddaughter's story that she simply left her child with an unknown couple.

"I think that she has given the baby to somebody, and I think she knows who it is," he said. "I think it's in San Antonio in somebody else's house, and she just ain't given it up.

FBI questions Texas group in missing kid case

The nationwide search for a missing 8-month-old Tempe boy has led FBI agents to question employees of a San Antonio organization that oversees the licensing of colon-cleansing practitioners.

The International Association of Colon Hydrotherapists certified Tammi Smith of Scottsdale, who was named a person of interest in the search for Gabriel Johnson.

The boy's mother, 23-year-old Elizabeth Johnson, was last seen with Gabriel on Dec. 26 at a motel about a block away from the organization's offices.

"It's a long shot, but we're questioning people there to see if there is a connection," said Kim Hale, commander of investigations for the Tempe Police Department. "Our focus continues to be in San Antonio where the child was last seen."

"I have nothing to say about that," Smith said. "That's retarded. I've never been to the office in San Antonio. I've talked to people there and called them. Nobody from the FBI has called us, yet. This whole thing is ridiculous. I have begged and begged for them to ask us questions - nobody will ask us questions, nobody will come to our home."

Smith owns Healing Waters in Sun City West and in Glendale, according to her company's Web site. Her husband, Jack Smith, also was named a person of interest in the case. The couple had said they were interested in adopting Gabriel from his mother and father, Logan McQueary. Police have said the Smiths are withholding information that could lead them to the baby boy.

Smith says Johnson left the toddler with an unknown couple in San Antonio, Texas the day after Christmas.

She told reporters after the meeting that "according to Elizabeth, these people are going to try to hide this baby because they believe that in a few years nobody will notice who this baby is."

Smith went on to say that Elizabeth told her the couple came to Elizabeth's hotel room in Texas with a new car seat, placed Gabriel in the car seat and abruptly left.

"She did definitely describe the people and what they look like, they're definitely in San Antonio, she (Elizabeth) did sign paperwork, but they did not notarize it or anything like that," said Smith.

According to Smith, Elizabeth also told her during the nearly 45-minute jail house visit that the couple did not "buy" Gabriel and the man and woman were both white in their 30s.

Hotel Clerk Says Elizabeth Johnson Used Different Name

As investigators open a missing persons case for Gabriel Johnson in San Antonio, we are learning more about mother Elizabeth Johnson&#8217;s possible movements during her time in San Antonio from a hotel clerk who checked Johnson into one of the hotels. The clerk, who wishes to remain anonymous, says Johnson checked in under a different name and believes Johnson had a Texas ID.

The clerk told us the hotel swipes identifications and the computer puts the information on the screen for the employee, but in order to look up Johnson&#8217;s information they need the alleged alias that Johnson used to check in. That name has not been revealed. The clerk says they never saw Elizabeth Johnson with a baby, and Johnson even allegedly brought in a baby car seat and was holding it behind the desk so the clerk couldn&#8217;t tell if the baby was inside. The clerk says the only other time they saw Johnson was when Johnson needed some towels. We also learn from the clerk that there is a dumpster in the back of the hotel and is allegedly emptied twice a week. Cops have spoken to the clerk, who has relayed all of this information.


Who is Craig Cherry?
Police reportedly recently spoke to Cherry, who told them he has never met Johnson, and is actually Tammi Smith&#8217;s first cousin! Police say that new detail surprised them and was information that probably would have been helpful to them in the very beginning. Cops say in all the interviews with Tammi Smith, she never mentioned she was related to Cherry. Police cite this as one example of why they believe the Smiths are withholding information and why they are still persons of interest in the baby Gabriel investigation. Craig Cherry spoke with CNN Affiliate KPHO and told them he and Tammi Smith are very close, but doesn&#8217;t know Elizabeth Johnson and could only guess as to how Johnson learned his name and used it in court filings. Tammi Smith explains how this all came about, saying Johnson told her that the other possible father of Gabriel was actually someone Logan McQueary knows and Johnson was allegedly worried that if McQueary saw that, he would try to fight the other possible father. Tammi Smith claims Johnson initially wanted to make up a name, but Tammi Smith told Johnson she couldn&#8217;t do that. Then Johnson allegedly suggested she use Jack Smith&#8217;s name, and Tammi Smith would not let her. While saying she was joking, Tammi Smith admits they discussed other possible people to put on the document, including Tammi Smith&#8217;s cousin Craig Cherry. Tammi Smith drove Johnson to court to file the paternity request and reportedly even made 3 copies of the paperwork that clearly labeled Craig Cherry as the possible father but never noticed it. Smith says she never read it because she was in a hurry and didn&#8217;t know Johnson put Cherry&#8217;s name down until she got a call from Cherry saying the media was hounding him. Tammi Smith confesses would have been forthcoming with investigators, but she doesn&#8217;t remember them asking her about Craig Cherry and she didn&#8217;t know Johnson had written that name down.

New lead in Baby Gabriel's Arizona disappearance?

A blog entry from early January is sparking some interest in the case of a missing Arizona infant.

In reply to a web post on BeckyHiggins.com, blogger "Beth" wrote, "I live in WI, but am currently in San Antonio, TX. My husband and I are adopting a handsome baby boy that was placed into our care on January 1. I've decided to make my project life about Baby Gabriel. Even though I won't be home when my project arrives I am clicking away taking his photo here in San Antonio."

The entry is timestamped on January 4th. There's no contact info listed for Beth.

Officers say Elizabeth Johnson is not cooperating with the police investigation but seems to be telling other people her claims about what happened to the boy. On Wednesday, Tammi Smith visited Johnson in jail.

After meeting with Johnson, Smith told reporters that Johnson claimed she gave the baby to a couple in San Antonio.

"She said, 'I was in the hotel room... that they came in my hotel room. I held (Gabriel), and we talked, and I signed the paper,' which obviously was not notarized, and then she put the baby in the car seat. They left her hotel. She did not see the baby in the car," explained Smith.

Investigators have confirmed that Johnson stayed at two San Antonio hotels. She allegedly told Smith that she only stayed at one hotel. Johnson also allegedly said that she believes there is surveillance video of a couple leaving the hotel with Gabriel.

Police told News 4 WOAI that Johnson's claim that a couple is pictured on surveillance video with the child is inaccurate. Investigators have said that Johnson has changed the stories that she is telling people.

A news conference with Tempe Police scheduled for 1 p.m. Thursday was cancelled because there was no new information to offer.

Robert Johnson showed up for the visit with his grandfather Bob Johnson. The elder Johnson said they were there to support Elizabeth but also to try to get her to come clean. "It was our intention to ask her to give up the location of the baby and settle this thing. Life goes on. We can't be playing around with this. There's better ways to settle this than how she's going about it," said the jailed woman's grandfather.

Less than 5 minutes after walking into the jail, both Johnson men came out. They were refused a visit with Elizabeth. Corrections officials said Elizabeth's visitors for the day were restricted to legal advisers.

"The thought going through my head is that her lawyers had told her that she is not to be giving any more interviews. But that has nothing to do with her visiting family," said the older Johnson.

Twin brother Robert said he was highly disappointed he didn't get to see his sister. "It's pretty messed up. Love to see her and I don't know why we can't," said Robert.

Horn would not say what detectives are looking for, but it's likely investigators are interested in computers and any of the Smith's travel documents.

The search warrants come just hours after Tammi Smith voluntarily met with Tempe detectives for more than two hours Thursday.

As she walked out of Tempe Police Department Headquarters, Smith could be heard saying, "That was rough."

"I made a poor decision back when I met Elizabeth," said Smith. "I helped her (Elizabeth) file her paperwork so she could get her child support and things like that. There was another name put on there and I helped her (Elizabeth) fill out that paperwork, and because of that it obviously doesn't make me look good."

"Instead of putting a false name there, I helped her (Elizabeth) put another name," said Tammi Smith.

With her husband, Jack, waiting nearby, Tammi went on to say she and her husband do not have attorneys, but were considering calling one.

According to documents, he had previously filed a restraining order against her, after he said she trashed their Tempe apartment, causing thousands of dollars in damage.

A protective order was later dismissed when the couple got back together.

On Dec. 14, McQueary wrote in his complaint that Johnson hid the baby at a friend's house until police finally found the boy at 3:30 in the morning.

That's when Johnson allegedly told him she wanted to give Gabriel up for adoption to another couple, the Smiths, who are now persons of interest in the case.

"She called me on the phone and said, you need to sign these papers," said McQueary. "I said, 'What papers,' and she said, 'I already gave them to the people that are going to adopt him.'"

In the latest twist, Johnson claims there is video to prove that Gabriel was handed off to a couple in Texas. Tammi Smith told FOX 10 that she visited Johnson in jail Wednesday, saying the FBI has the surveillance video. The FBI has not confirmed that.

"After two days of getting to know them, on the third day they came to her hotel. They stayed inside the hotel for a while, she held the baby while they talked and they finalized things. She felt very pressured and scared, scared that she might go to jail or those types of things and pressured because she knew they really wanted a baby," Tammi Smith told us. "She wants out of jail and she wants that baby back so she can get out of jail."

Police search home in missing baby case

Tempe Police spent Thursday night searching the home of Jack and Tammi Smith. The Scottsdale couple is considered "persons of interest" in the case of missing Gabriel Johnson. Police believe the couple is withholding information that could help with the investigation. Sgt. Mike Horn of the Tempe Police Department said, "The warrant is specific to the investigation for Gabriel Johnson".

A baby-sitter came forward on Wednesday saying she watched Gabriel for about two hours while Elizabeth left the hotel. The woman says Gabriel appeared dirty and lethargic, "He had stains around his mouth and dried boogers around his nose," said Alisa. She also said Elizabeth told her "She had already drugged the baby but if he started to cry to give him more Tylenol". Elizabeth continues to say that she gave Gabriel to a San Antonio couple after hanging out with them for two days. Elizabeth said the couple really wanted a baby and was willing to hide him from police.

More clues into Baby Gabriel's whereabouts

Tammi Smith, the woman who hoped to adopt Baby Gabriel, is still a person of interest but also is shedding light on the situation after she talked to Johnson. According to Smith, Johnson handed the baby to a San Antonio couple who vowed no one would ever know.

It is possible the couple could stay in hiding and Smith says they assured Johnson no one would recognize the young boy after a few years.

The couple was described by Johnson as Caucasians in their mid-thirties. The female was short with long, blonde hair and the male was a &#8220;bigger guy&#8221; with short, dark hair.

A blog comment on a scrapbooking website is also being investigated by Tempe, AZ authorities. Whoever wrote the entry says they are from Wisconsin but are currently in San Antonio where they adopted a young boy named Gabriel on January 4th.

Yesterday, a woman from the Midwest blogged about adopting a baby named Gabriel in San Antonio. Investigators are following up on that, but have not yet been able to confirm anything.

Back here in the Valley, police are putting the pressure on a couple they consider persons of interest in thee case -- Jack and Tammi Smith, who claimed they were trying to adopt Gabriel.

Investigators spent hours with Tammi yesterday. Late last night they served a search warrant at the Smith's home in North Scottsdale.

Maricopa County prosecutors say 23-year-old Elizabeth Johnson was indicted Thursday by a grand jury on charges of kidnapping, child abuse and custodial interference. She remains jailed in Phoenix.

Authorities say Johnson fled the state with her 8-month-old son Gabriel during the week of December 22 in an apparent custody battle. The boy was last seen in San Antonio where Johnson spent Dec. 22 to 27 in two different motels. Johnson was arrested Dec. 30 in Miami and extradited to Arizona.

The mother of an 8-month-old boy who has been missing since late December was indicted by a grand jury Thursday.

Elizabeth Johnson was indicted on charges of kidnapping, chid abuse, custodial interference, and conspiracy to commit custodial interference.

Tempe Police Department spokesperson Mike Horn confirmed that a search warrant was served at Tammi and Jack Smith's home near 160th Street and Rio Verde Trail Thursday night.

Jack Smith said police took his laptop computer and made a copy of his business computer's hard drive. He said they also took brochures they had for a foster agency.

He said police arrived around 7:30 p.m. to secure the home until the search warrant arrived. Smith said detectives began searching around 11 p.m., finishing around 12:45 a.m.


The Smiths say they offered to allow police search the home weeks ago.

"When Gabriel disappeared, they said basically, if you really care about your son and you want him back, and you want Elizabeth to bring him back, that you'll sign the paperwork and then she'll bring him back to us, and you'll know he's safe," said McQueary. "And I said, no, I'm not signing any paperwork."

The Smiths said they were just relaying messages from Johnson to McQueary after she had taken off with the baby.

"Let's do this paperwork, and maybe she'll tell us where the baby is," Tammi said. "It's not legal anyway, but does she have to know that? I mean, I'd rather get the baby back and sign the phony papers, but I guess the detectives don't want us to do that."

Despite reports that they wished to adopt Gabriel, the Smiths now say they have nothing to hide, and that they're doing all they can to reunited Gabriel with his father.

"We were actually just thinking of maybe just getting a dog," joked Tammi. "It seems to be a hard process adopting, and I don't know that we want to go through this again, unless the courts said, here's a baby and the parents both signed. That's different."


How Elizabeth and the baby disappeared
Police say Elizabeth left Arizona with Gabriel on December 18. There have been no signs of her child since the day after Christmas.

Police did find Elizabeth in Florida and arrested her for failing to appear at her custodial hearing.

"She was confronted, arrested and interviewed exhaustively about the whereabouts of the child," said Wayne Jones, with Miami Beach Police.

Elizabeth's twin brother, Robert Johnson, said he doesn't believe his sister's story, but also said he has to support her.

In September of 2009, police arrested her for criminal damage.

Then in December of 2009, another police report revealed Elizabeth called police and told them McQueary had taken Gabriel and would no give him back.

Police later accused her of filing a false police report after learning Johnson herself gave Gabriel to Tammi and Jack Smith.

A babysitter who watched Gabriel Johnson the night he and his mother arrived in San Antonio says Elizabeth Johnson seemed detached from her son. 18-year-old Analisa Urias says Johnson contacted her after seeing her babysitter ad on Craigslist and hired her to watch her son on the night of December 21st at the Homegate Studios and Suites on Laureate Drive.

&#8220;She was not affectionate towards Gabriel or anything, it did not seem like she really wanted him.&#8221; said Urias who says Johnson gave very few instructions to the babysitter before leaving. Urias says there was a sharp knife sitting in the room.

Two hours later, Johnson returned to the room and received a phone call from someone speaking loud enough for Analisa to hear. Johnson told her it was her grandmother and explained her husband was threatening her family because of a custody battle

&#8220;She said she needed to figure out what she was going to do with her life.&#8221; according to Urias.

A source told the Tribune on Thursday that Johnson also could be facing federal charges of kidnapping and providing false information to a federal law enforcement officer.

Johnson&#8217;s twin brother, Robert Johnson, told the Tribune on Friday the family&#8217;s attorney advised him not to comment.

Police will not elaborate as to who Johnson's alleged co-conspirators are, and they said Jack and Tammi Smith remain persons of interest.

Detectives searched two computer hard drives and confiscated a laptop, the couple said.

"They took and just duplicated everything that was on (the hard drives)," said Jack Smith. "They took a laptop that hadn't been turned on in about eight months."

Though they said the search was unexpected, the Smiths said they have nothing to hide.

The Tempe Police Department said its goal is simply to find Gabriel.

"Based on (Johnson's) statements, she either killed him or handed him off to someone else," police spokesman Mike Horn.


Police Release Photographs Of Baby Gabriel
On Friday, the Tempe Police Department released photographs of Gabriel taken from Johnson's camera.

According to an e-mail from Horn, time stamps from the camera indicate the final photographs were taken Dec. 26. Gabriel was reported missing Dec. 27.

Investigators believe the photographs were all taken in a room at the Home Gate Hotel in San Antonio, Texas, Horn said.

Late Friday, Tempe Police released a series of pictures, showing 9-month-old Gabriel Johnson alive in a San Antonio motel. A couple of the photos are date-stamped "December 26th," which is the last day police can confirm Gabriel was alive.

Most of the pictures show Gabriel playing on a bed or crawling around, but others are troubling. In two of the pictures, Gabriel is seen grasping what appears to be a medicine dropper.

The newly-released pictures also reveal Gabriel's mother, Elizabeth Johnson, brought family photos when she fled. Tempe Police say it looks like Johnson's mother and brother are in picture frames placed on a motel nightstand.

Meanwhile, investigators continue combing through evidence seized when they served a search warrant on the home of Tammi and Jack Smith.

Tammi Smith says she invited police to her home to search her files. They left the Smith's North Scottsdale home at 12:45am Friday with a laptop, other computer files, phone records, and documents.

They're going to find evidence that we were following the law. Nothing shady," said Tammi Smith.

Tempe Police Lt. Mike Horn said in an e-mail Friday evening that the pictures were taken from Elizabeth Johnson's camera when she was arrested in Miami Beach, Florida nearly two weeks after the pair went missing.

Horn says investigators believe all the photographs were taken at a Home Gate Hotel and that the last two photos have a date stamp of December 26.

On Friday, Jack Smith said police took his laptop computer and made a copy of his business computer's hard drive. He said they also took brochures they had for a foster agency.

Jack Smith said he had "a hard time understanding" the timing of the police activity at his home.

"If they had got here at 6 in the morning, they could have had coffee with me and spent the day with me," he said. "But yet, they had to keep my daughter from going to bed last night until midnight. My daughter is always in bed before midnight."

He said police arrived around 7:30 p.m. to secure the home until the search warrant arrived. Smith said detectives began searching around 11 p.m., finishing around 1 a.m.

"Let me tell you how worried I was," said Jack Smith. "I fell asleep on the couch."

Logan McQueary's family has been keeping relatively quiet about the case, his father Frank McQueary spoke out about the case Friday, asking the public for help finding his grandson.

He asked people to keep an eye out for, "that next door neighbor buying stuff for a baby and they didn't have a baby before. Let somebody know."

"The people that have Gabriel don't want to give him up, that it's somebody that Elizabeth for some reason or another has this arrangement with, that they want to keep him, and we want him back," said McQueary. "I want my grandson back."

Mother of missing baby faces 4 felony charges

As police continue their nationwide search for a missing baby, a Maricopa County grand jury has indicted the child's mother on four felony charges.

The indictment comes as the San Antonio Police Department has opened its own investigation into Gabriel's disappearance. Elizabeth Johnson spent six days in San Antonio, and her car was found at a motel there.

On Thursday night, Tempe police served a search warrant at the Scottsdale home of a couple who last week were named "persons of interest." The warrant was executed at the home of Jack and Tammi Smith, who had wanted to adopt the baby.

The warrant was signed and sealed by a judge and executed by detectives, said Tempe police Sgt. Mike Horn. He declined to comment on what investigators were looking for or what they took out of the home. But he said detectives left the home at about 1:15 a.m.

The boy was last seen with his mother in San Antonio, where she spent Dec. 22-27 at two motels in the city. She then left her car at a Motel 6 near a bus stop. She was arrested in Miami on Dec. 30.


McQueary told reporters he felt extorted by the couple and they told him the only way Johnson would come home is if he would agree to sign over his rights. Tammi Smith disputed that and said she was only trying to help get Gabriel back to Arizona.

The longer 8-month-old Gabriel Johnson is missing, police say, the less likely it is that authorities will find him - dead or alive.

For three weeks, Tempe police have been following up leads locally and in Texas. The FBI has fanned out across Nashville, Boston and Louisiana. The San Antonio Police Department has opened its own missing-person case. Together, they are getting 20 to 30 tips a day.

"If the child is in good hands, and that's a big if, then the child will still be around," said Tempe police Cmdr. Kim Hale. "But the longer we go, it doesn't help us as far as trying to recover him, wherever the child is, whether that is in a home, or the child has been taken across the border to Mexico, or if he's in the bottom of a landfill."

A broken family
Gabriel's mother, Elizabeth Johnson, 23, is a product of the Boston foster-care system. She lived with five different families before coming back to the Valley at the age of 12 to stay with her father, a recovering drug addict, according to her grandfather, Bob Johnson.

Gabriel's father, Logan McQueary, 25, has a felony record that includes burglaries dating to 2004 and was in jail on parole violations before and after his son's birth.

Johnson and McQueary first met at Mohave Middle School in Scottsdale. She was later expelled from Saguaro High School in Scottsdale, although Bob Johnson said she was a high-achieving student with a nearly perfect grade-point average. She enrolled in a charter school in Tempe and transferred to a school in Boston for her senior year.

After McQueary had a falling out with his boss, he and Elizabeth moved to Fort Smith, Ark., Bob Johnson said.

It was there that Gabriel was conceived.

When the couple returned to Arizona, Johnson told her grandfather she had considered terminating the pregnancy. After Gabriel was born, the couple discussed adoption before deciding to raise the boy, the grandfather said. The next time he heard the word "adoption" from his granddaughter, it was December.

Relationship deteriorates
In custody documents filed in December in Maricopa County Superior Court, McQueary said he ended the relationship. In July, he alleged, she became enraged when he didn't return home from work on time and took a knife to his clothing, the couch and the baby crib. She broke dishes and took a cooking pan and smashed the TV while the baby was in the Tempe apartment.

They were forced to move into another apartment.

McQueary said Johnson got out of control again in September when she got mad at her brother on the phone. She cut up the baby's clothes and the crib and broke every window in the apartment.

When he broke up with her in mid-December, she told him to take the baby. Then she called police to report Gabriel had been kidnapped.

McQueary petitioned for full custody of Gabriel on Dec. 11 and followed up three days later with an emergency request for temporary custody without notice to the mother.

"She has said several times in the past that she doesn't want the baby," he wrote in his petition, filed on Dec. 14. "She's yelled and screamed at him when I would go to work. When I would go to work, I would put the baby in his room and when I would get home five hours later he would still be in the room (with) no changed diaper and crying and I would ask her what she was doing and she would just yell at me and say go shut that thing up."

On Dec. 21, in a petition to enforce child-custody determination, he wrote, "When Elizabeth gets mad, she can and will hurt the baby."


By then, she had been away from her home in a Tempe trailer park for three days.

Media frenzy
Since Johnson's arrest, she has refused to speak to investigators, and it's unclear whether the mystery will ever be solved.

"Time is not on our side when it comes to the recovery of this child," Hale said. "The recovery chances grow much more dim as time goes on."

Elizabeth Johnson called her grandfather. Bob Johnson. It was the first time they've spoke in nearly a week. The two only spoke for a couple of minutes, talking about items she wanted him to pick up from jail. Johnson asked her grandfather to pick up the $300 she had when she was arrested in Florida, as well as an expensive ring she said she was wearing.

The call came just minutes after Bob told CBS 5 he wasn't sure his great-grandson was still alive.

Bob Johnson said, "The more days that go by, the more concerned I get for the health and welfare of baby Gabriel. It would seem that whoever she gave the child to, under the assumption she did indeed give the child to someone, those people would be scared out of their mind by now."

Johnson also said he's having trouble getting the car Elizabeth took off in back to Arizona. He said FBI agents gave him the all clear to come to Texas and pick it up, but Johnson said Tempe police told him they're going to hang onto it in case this turns into a homicide.

"Elizabeth told me if anyone came knocking on the door not to answer it," Urias told ABC News.

"Elizabeth told me to give him a bottle in about an hour and then her exact words were to, 'Give him more medicine if he started crying to shut him up,'" Urias said.

"Gabriel wasn't acting like a normal baby," she said. "He was acting scared, he didn't want to play. He acted like he was sad."

In another disturbing claim, Urias said she found a large knife next to the bed in the motel room.

"It looked like a butcher type of knife and, you know, I thought that was weird because why would she have it next to her bed? It's something that would belong in the kitchen," Urias said.

Police in Arizona are now looking into an online posting from someone claiming to have adopted a child they called "Baby Gabriel."

The online posting is said to be from a woman from Wisconsin named "Beth" who claims she was here in San Antonio January first to adopt a little boy. Elizabeth Johnson was already in jail in Florida by that time. She claims she gave the boy to a couple she met here at a park. Elizabeth Johnson remains in an Arizona jail on multiple charges.

Elizabeth Johnson refuses to say where 8-month-old Gabriel is, even though her friends and family keep asking her to open up. She told her grandfather her lawyers say helping find her baby won't help her.

Johnson said, "Most of the things I wanted to ask her, she said she can't talk about."

Johnson said for the most part, Elizabeth is keeping her mouth shut. He said she told him her lawyers told her not to say anything.

Johnson said, "They told me kidnapping is kidnapping and she's gonna get 20 years ."

Bob said Elizabeth doesn't know why she'd help investigators since her lawyers told her she's going to prison for 20 years no matter what she does to help them.

At best, this is a kidnapping case with a child found. At worst, this could turn into a murder investigation. Bob hopes that isn't the case. He said Elizabeth may be the only one who can answer questions about her son's whereabouts.

"That's the message I left today," Johnson said. "Quicker they find that baby, quicker you get out of here; it's that simple."

Logan McQueary, the father of the missing 8-month-old Tempe baby, is again speaking out on his past with the baby's 23-year-old mother Elizabeth Johnson. He's also losing hope that Gabriel will ever be found.

McQueary says that while Johnson was pregnant with Gabriel, he gave her the option to have an abortion, but she said she wanted to have the baby. As the relationship fell apart, she then started talking about adoption.

He also expressed worry about a photo taken of Gabriel while he was in Texas. In the photo, he appears drowsy and is holding a bottle of prescription medication. McQueary says Gabriel wasn't on any medication.

"When I saw that picture I started crying. Even when he is tired he never looked like that before," he said.

At a press conference Monday, McQueary told FOX 10 that Johnson had a tendency to go into uncontrollable rages. He is certain she is capable of killing a baby, but he is clinging to hope that Gabriel is still alive.


Earlier Monday, Elizabeth Johnson's grandfather visited her in jail and they talked for about 20 minutes. He says he encouraged her to tell the truth, but she wouldn't open up.

"She's prepared to stay strong in her conviction that she did the right thing and the baby's in good hands," said Robert Johnson.

The Tempe Police Department says that when baby Gabriel first went missing, they had "strong indicators" that he was still alive and in good health. But they say now, those indicators are not nearly as strong.

Indicators police had that the baby was alive aren't as strong as they once were, Lt. Mike Horn told reporters, though he declined to elaborate on those indicators.

After telling his father on the phone that she had suffocated Gabriel and stuffed him in a baby bag, Johnson was arrested in Miami on Dec. 30 without the child.

"There is a very real possibility that Elizabeth killed Gabriel," Horn told reporters.

"What frustrates people, what scares people is that we may come to a point where we don't know what happened to Gabriel. And tips aren't coming in at the same volume they were a week ago."


Police in San Antonio have searched dumpsters and landfills in the area where Johnson had stayed with Gabriel, Horn said.

The boy's 25-year-old father, who lived with Johnson in Tempe up until last month, said that he has moved in with his father and that they have set up a new room for Gabriel.

McQueary said he has wrestled with whether to visit Johnson in jail and whether that would make her more likely to speak or further anger her.

Johnson&#8217;s family members say she has stopped giving them much information after her lawyer advised staying silent would be in her best interest when the case goes to court.

Police in Arizona continue their search for Baby Gabriel. The infant, at the center of a heated custody dispute, was last seen the day after Christmas.

Investigators have released new photos of the eight-month-old baby. They were taken December 26, the day before he was reported missing. Police still don't know if he's dead or alive.

CBS News caught up with family members visiting her in jail.

Bob Johnson, Elizabeth Johnson's grandfather, said, "It's our intention to ask her to give up the location of the baby and to settle this thing.

The Smiths, according to Lt. Mike Horn of the Tempe Police Department, are still considered "persons of interest" in the case.

Horn told Rodriguez police are "optimistic" that Gabriel is alive, saying they've had "indications" that there may have been a plan to adopt him out.

He added, "Unfortunately, as each day passes, we also have to wrestle with the fact that Elizabeth may have carried out what she originally said, and that she killed him. So we have to progress that both are a possibility, but at the same time, we are very optimistic that we can find him."

Logan McQueary laments the day he gave Gabriel back to Elizabeth Johnson.

"I wish I didn't have to bring him back. None of this would have happened," said McQueary at his first public press conference in two weeks.

McQueary expected Johnson would live up to their joint custody agreement; however, police say she kidnapped her boy and ran to Texas. Once there, police say she either killed Gabriel or simply gave him to strangers.

"I think about it every single day whether he's dead or alive. I want to believe that he is alive, I just want her to tell the truth," said McQueary.

McQueary thinks Tammi Smith and her current husband Jack know more than they are saying, but came forward today to get their faces out of the news.

"This is about Gabriel and I want to find my son. Everybody's been concentrating on the Smiths and I don't think it's about them. It's about finding my son," said McQueary.

Tempe detectives are looking into the possibility that a missing 8-month-old boy may be disguised as a girl by the people who have him.

"There's one thing we've learned in this investigation and that is that anything is possible," said Tempe Police Sgt. Steve Carbajal.

According to detectives, 23-year-old Elizabeth Johnson refuses to tell authorities where the baby is or who may have him.

Police also confirm to ABC15 there are two, separate, yet parallel investigations involving the disappearance of the toddler.

According to Tempe Police Lt. Mike Horn, a team of detectives is working a missing persons investigation and a homicide investigation at the same time because it is unknown if boy's mother gave the child away or killed him.

Newly released photographs taken the last day a missing Arizona baby was seen show the boy as lethargic and holding what appears to be a medicine bottle.

And while we're on the subject of those for whom the truth is too big a burden, Tammi Smith facilitated Johnson's lie about Cherry. Indeed, given that Cherry is related to Smith, it seems likely that she suggested the name to Johnson to use in her false filing with the court.

In a Facebook message posted by Tammi on December 23, she said, "Please keep praying for Gabriel and his Mommy's safety on the road! She has found underground help in TX that has given her formula/diapers, etc. and all the legal formalities... Keep praying for his safety.

"At first she mentioned that it was a domestic violence shelter, and she had used the word 'underground' maybe once in the conversation," said Tammi. "And instead of saying 'domestic violence,' I didn't want that to make Logan think that he was violent towards her."


Let's see. Johnson found "underground help" in Texas which just may have been a domestic violence shelter. Hmm. The plot, already thick, thickens more. She got help with "formula/diapers... and all the legal formalities." Can I envision Johnson going to a DV shelter, telling them she's been abused by McQueary, telling them she's too young to raise this child and needs to find adoptive parents? Yes, I believe I can. Can I imagine the kind folks at the DV shelter facilitating everything to separate the father from his child? Yes, that too. Do I believe that the DV shelter had available to it not only some legal documents, but adults willing to take a child via a none-too official process? Yes.

The Baby Gabriel case, where his 23 year old mother said she gave this beautiful baby away to a couple whom she didn&#8217;t know is beyond disturbing and confusing. It didn&#8217;t make any sense to me until I looked at Elizabeth Johnson&#8217;s Body Language while she was wearing her red jail outfit and was facing the court for the first time. To me, her body language revealed a lot. It was telling. To me the signals showed someone who may possibly have been on drugs. Perhaps she sold the baby or traded the baby to support her drug habit if she indeed had one.

I also want to add that in analyzing her voice and the content of her speech in the jailhouse audiotape that was released, it appeared to me that she did tell the Baby Gabriel&#8217;s father that the baby was dead in order to hurt him and get back at him. However, based on her tone and the content, it did appear to me that the last time she saw Baby Gabriel, he was alive.

This photo os most telling as we see the side to side jaw movement which ELizabeth does several times during the course of her arraignment. People do not usually shift their jaws from left to right. It is not s normal orofacial behavior. Instead, people move their jaws up and down, not sie to side. Oftentimes with certain drugs like meth in particular, people have been known to do this body movement a lot. There is also a clenching and a chewing action associated as well.

This is another side to side movement fo the jaw so that you can better see what I am talking about. Also note the eyelid droop. When eyes don&#8217;t usually blink simultaneously there is often an indication that something is going on with the person neurologically. When people drugs there are obvious changes in the brain which may manifest in a lack of coordination, including the lack of coordination of blinking ones eyes at the same time.

Apparently Elizabeth only allowed interest Tammi Smith permission to interview her as she said she had new information about the people she said have her baby boy when Smith visited her in the Estrella Jail on Wednesday.

But why would she allow Mrs. Smith to visit her and no one else? What is the relationship between the two of them?

While I am not accusing Mr. And Mrs, Smith of anything, something just does NOT sound right to me vocally, or look right to me, body language wise. I will tell you what my observations are in an upcoming blog and share my feedback .

Apparently I am not alone in my view as things don&#8217;t look or sound right to the police either, especially of they are referring to her and her husband as &#8220;people of interests&#8221;. The one thing I can say with confidence is that Tammi Smith&#8217;s vocal tone speaks volumes to me. Something does NOT sound right at all!

Gabriel Johnson was last seen around December 26.

According to her MySpace page, it appears Elizabeth was posting messages just days after her son went missing.

On her MySpace bio, Elizabeth calls herself a "proud parent" and labeled her mood as "adventurous" on December 29, 2009, and appears to have last logged-in on December 30, 2009, the same day she was arrested in Miami.

When asked about the MySpace page and visitor postings, Tempe Police Sgt. Steve Carbajal said, "Detectives are using any means necessary to find information and especially Gabriel."

Horn said investigators believe all the photographs were taken at a Home Gate Hotel and that the last two photos have a date stamp of December 26.

Horn said the pictures were found on Elizabeth Johnson's camera when she was arrested in Miami Beach, Florida nearly two weeks after the pair went missing.

McQueary believes Gabriel may have been medicated or drugged based on Gabriel's appearance in the photos.

"It didn't look like him (Gabriel), didn't look like he was happy in those pictures," said McQueary.

SA Woman Who Babysat Missing Boy is Praying for him

A San Antonio woman who babysat for Gabriel Johnson is one of the last people to see the little boy in San Antonio. Analisa Urias tells News 4 WOAI, "I am hoping and praying that he is alive and that whoever has him does come forward to return him safely to the family."

Urias says she watched Gabriel at the Homegate Studios and Suites near I-10 and Huebner. The boy and his mother were staying there. Urias says the hotel room was dirty and Johnson kept a butcher knife on a table near the bed.

She watched the child for about two hours around mid-day and says Johnson explained that she needed a babysitter because she had an "important appointment." She was gone for about two hours. Urias says Johnson seemed angry and irritated before she left but was happy and in a much better mood when she returned.

The babysitter didn't have any other information about where Johnson went that afternoon except that she looked like she was dressed to go to a party. Urias has been interviewed by the FBI and is hoping that others with information about baby Gabriel will come forward. If you have any information, please call Crime Stoppers at 224-STOP.

Newly released photographs believed to have been taken the last day a missing Arizona baby was seen show the boy as lethargic and holding what appears to be a medicine bottle.

Tempe police Sgt. Steve Carbajal says the photos are from the camera of the baby's mother, 23-year-old Elizabeth Johnson.

Police have had the photos for weeks, and Carbajal says he's not sure why the department is only releasing them now.

Carbajal says the pictures are concerning and raise questions about Johnson's treatment of Gabriel.

McQueary Family Wants To Say Thank You For Prayers And Support

Wil and Kelli McQueary, the uncle and aunt of "Baby Gabriel," as the 8-month-old has been dubbed, have planned a candlelight vigil in honor of their missing nephew.

"There's a lot of family and friends in this area and that's whey we chose this park to do it in," said Kelli McQueary.

The McQuearys believe in the power of prayer, so they're asking the public to join them for a candlelight vigil for Gabriel Sunday on the south soccer field in Chapparel Park.

It's a thank you to the hundreds of people who have sent their support in every way imaginable, and the planned gathering can only help Gabriel's father Logan, who is still struggling for hope.

The McQueary's also hope a mass gathering might spur someone's memory and provide the pivotal piece of the puzzle that leads to the truth.

"We do talk about it, the 'what ifs'. But we just can't go there. Until I see proof, Gabriel is still alive," said Kelli McQueary.

Tempe detectives have processed a GPS device that may have been used by the mother of a missing 8-month-old boy.

Investigators say the information from the GPS, including its origin, cannot be released.


Detectives will not say how many people have been questioned involving the search for the boy, but Jack Smith, who is considered a 'person of interest' in the case told ABC15 a family member outside Arizona has been interviewed.

"They (investigators) went to my son's house in Tennessee and asked him a few questions which is all normal stuff, they have to do that and that's ok," said Jack Smith Wednesday night.

Tempe police get national attention over baby Gabriel case

On network morning shows and cable news interviews, the Tempe Police Department has been thrust into the national limelight thanks to the country's interest in a missing chubby-cheeked baby boy.

The attention, however, comes at a time of turmoil as the department faces massive and unprecedented cuts.

Sgt. Steve Carbajal said he couldn't quantify at this point how much manpower or money has been put into the case, but did say that investigators have literally worked around the clock.

Officers were also sent to San Antonio and Miami to further the investigations there.

"Could we dedicate the same manpower (to a case like the search for Gabriel Johnson)? We would do what the situation dictated, but obviously there's a cost for that," Carbajal said. "It might not be financially, but these cuts impact how we provide services and when we have big investigations like this, it strains our resources."


News of the potential layoffs has been trickling down the chain of command and employees have been given opportunities to ask questions in forums, Carbajal said. He wouldn't speak to the morale of the force, but admitted that news of possibly losing jobs in the department is hard for any officer to take.

Family of missing baby's father to hold vigil

The paternal family of a missing 8-month-old Tempe boy is holding a candlelight vigil for him in a Scottsdale park on Sunday.

The family of Logan McQueary, the father of Gabriel Johnson, who has been missing since Dec. 26, is inviting the public to the vigil in honor of Gabriel at 6 p.m. Sunday at Chaparral Park. The park is at 5401 N. Hayden Road, and the vigil will be held at the south soccer field.

The McQueary family said they are hopeful that the baby will be safely returned.

Logan McQueary and his family and friends plan to gather at Chaparral Park in Scottsdale on Sunday evening.

The vigil will start at 6 p.m. McQueary's son, Gabriel Johnson, disappeared after Christmas while in his mother's custody in Texas.

Exclusive: Police expected to search landfill for missing baby

Police were at a landfill Friday that officials previously said they might want to search in connection with the case of a missing 8-month-old baby.

Gabriel Johnson was last seen in San Antonio on December 26th. Last week, investigators informed the operators of the Allied Waste - Tessman Road Landfill located at 7000 IH-10 East about the possibility of a search.

News 4 WOAI have been checking the site each day. When News 4 WOAI crew pulled up to the site Friday, several officers were there along with search dogs. However, police would not answer any questions.

Focus of lost-baby case shifts to what-ifs

Though the search for Gabriel Johnson continues, questions have turned to what happens to the missing baby's mother, Elizabeth, if the child is never found.

"We have to look at: Did Elizabeth kill Gabriel like she said she did?" said Sgt. Steve Carbajal, a Tempe Police spokesman.

Suspects have been arrested in only a handful of missing-body cases in Maricopa County. Some cases have been successfully prosecuted, usually aided by a confession and extensive forensic evidence. Other cases never result in charges, even if police believe they know who committed the crime.

Investigators, including a team from Tempe, have searched dumpsters in San Antonio, where the child was last photographed. So far, there has been no luck in finding Gabriel or his body.

Anything else police might have found, they are keeping close to the vest.


Statements of murder
After telling her ex-boyfriend she had killed the child, Johnson said she was leaving the country, according to court documents. She said she would call McQueary to tell him where he could find the "blue-colored" baby.

While those statements give detectives investigative leads, experts consider it debatable whether they would hold up in court.

"Generally, there has to be some sort of corroborating evidence," said attorney Dale Baich, with the Federal Public Defender's Office in Phoenix, who specializes in matters of habeas corpus. "I'm not sure making those statements by itself would be enough. There may be explanations and reasons why she would say what she said."

But police keep returning to the possibility that Johnson killed her son, especially as other leads of him being alive run out.

To corroborate the initial statements, police would need evidence that could include the child's body before they could pursue homicide charges. Without his body, the prosecution must somehow prove the boy is dead.

"In court, the prosecutor has to tell a story to the jury, and the problem with not having a body is you're missing part of the story," said retired Tempe Police Detective Allen Reed.

Unfazed by accusations
Elizabeth Johnson, however, doesn't seem concerned about the possibility of being charged with homicide, said her grandfather, Bob Johnson. He visited Elizabeth in jail on Jan. 14 and has spoken to her on the phone about every other day since, he said.

"At this point, it's common sense that the longer something like this drags out, the worse it looks for the victim, in this case Gabriel," he said. "But I don't think she would have harmed the child, let alone killed him, and have the attitude she has."

Bob Johnson said his granddaughter seems convinced the most serious charges she is facing, kidnapping and child abuse, won't be lessened if the boy is found alive.

"I tell her the easiest way for her to get out of here, the fastest way for her to get out, is to tell them where Gabriel is at," Bob Johnson said. "The quicker he shows up alive, the quicker you can get out of here."

According to Matt Zarrell, producer of "Nancy Grace," Elizabeth Johnson put together several hundred dollars for her sudden cross-country run. She sold her dogs for a couple hundred dollars. She took in a renter for $400 or $500. She sold her laptop computer. But, according to Zarrell, police are saying that "the numbers just don`t add up." After adding up Johnson's hotel costs (she stayed in San Antonio hotels for at least five days), gas for the trip to San Antonio, the bus ticket to Miami, the visits to salons (which included manicures and pedicures) and expensive shopping sprees when she arrived in Florida, authorities believe that Johnson spent far more than can be accounted for. What is more, when she was arrested in Florida on the warrant for custodial interference (she failed to appear at a custody hearing with Gabriel on December 28), she had nearly $500 in cash on her person.

Although investigators, which include various Arizona and Texas police agencies and the FBI, aren't openly speculating, when they say that the money isn't adding up and the person of interest has more than can readily be accounted for, there is the possibility that authorities may be pursuing the idea that Elizabeth Johnson might have sold baby Gabriel, which might account for the extra cash.

Or did she kill him and head on to Florida to enjoy herself, which, by all indications, she seems to have done. Until she was arrested, that is.

But Elizabeth Johnson is not talking. She has insisted that baby Gabriel is still alive, but that could be just so much misdirection to keep a murder charge from being added to the charges of kidnapping, child abuse, custodial interference and conspiracy to commit custodial interference she already faces.

Which leaves investigators still wondering: Where is baby Gabriel Johnson?

The worst moments of McQueary's life are matched with hope his son Gabriel will come home. Sunday evening friends, family and complete strangers gathered together to support McQueary and pray for the missing baby.

"We are always praying for Gabriel's safety first and foremost, and second that he be found and brought home to his daddy," a family friend said.

It's been almost a month now and still no word on where Gabriel Johnson may be.

"I know just about as much as you guys do,&#8221; Logan McQueary said addressing the media. &#8220;Tips keep slowing down and they haven't had really anything right now."

Amidst the tears and hugs is optimism from someone with information will come forward.

"We need that little boy, his whole family needs that little boy,&#8221; McQueary&#8217;s grandmother, Dorothy Woodard said. &#8220;We just need him so bad."

"I believe he's out there, you know maybe these people are just keeping him and won&#8217;t give him up," Logan McQueary said.

The mystery surrounding a missing Tempe baby has captured the attention of the nation. In Scottsdale Sunday night, more than a hundred people gathered for a vigil and to show their support.

Family members say they're holding out hope Gabriel will be returned home safely, but their desperation is apparent.

At Chaparral Park, the group held candles and said prayers shared words of encouragement.

"Please please let us know anything you know," says Gabriel's great-grandmother. "If he's out there and somebody's hiding him is he dressed up as a little girl... think about that too."

McQueary says he believes Johnson is capable of hurting their son, but he's praying she would never do such a thing.

"All I want is for her to tell the truth. Stop being so stubborn and tell us where he is, who has him, give us a name or anything that can help us find him," he says.
