State Spends $30K In Casey Anthony Case

The State Attorney's Office has already spent more than $30,000 to prosecute the case against Casey Anthony. More than $25,000 was paid to a forensic entomologist. Another $5,000 was paid to a University of Florida Soil and Water professor.

The State Attorney's Office tab for the case is already at $35,651.

Former Orange County prosecutor and defense attorney Will Jay says costs will go even higher as more witnesses in this case are deposed and more experts are needed.

The JAC would hand out the money should Anthony be declared indigent. JAC officials told the court already they have "severe concerns" regarding Anthony's request.

One drawback for the defense if their request is approved is every expense will be thoroughly examined, and it'll be public record.

The hearing is scheduled for 11 a.m. Thursday.

There is more information being learned about the backgrounds of the two sisters who have gone to the tabloid media to claim one had an affair with George Anthony, the father of Casey Anthony, who is charged in the killing of her daughter Caylee.

The two have been using the names River and Skye, and they have taken their story to the likes of the National Enquirer. They are twins who also have been arrested a number of times. Records indicate they are often in need of money.

Cecelia Holloway is using another name to publicize her sister's supposed affair with George Anthony: Skye Benhaida. She claims to be the sister of "River Cruz," who is actually Cecelia's 38-year-old twin sister Krystal.

Local 6 also found that Cecelia was in jail from August 2008 to January 2009, the time the two sisters claim the affair was supposedly blossoming.

The two women also made a joint appearance in another crime report in February 2008 after more than $1,000 in jewelry was stolen from an apartment neighbor of the twins

In fact, on the day Casey Anthony was being escorted out of jail on Aug. 21, 2008, Cecelia Holloway was being booked there for violating probation on another conviction in Seminole County for dealing in stolen jewelry.

The case against Casey Anthony was back in an Orange County courtroom on Thursday. Her attorneys asked the court to declare her indigent so her legal fees would be paid for by the state. Judge Stan Strickland said he would issue a ruling in five days.

Right before Anthony&#8217;s indigency hearing got underway, the State Attorneys Office unsealed evidence regarding conversations that Casey had with other inmates at the Orange County Jail. In February 2010 Judge Strickland order the motion sealed. He unsealed the document on March 16, 2010 and it was released to the public today.

So how exactly would it work? FOX 35 talked to former Brevard County judge Oscar Hotusing. He said one can be indigent by the courts declaring and confirming the proof that there is no home ownership or any hidden assets. In this regard, according to officials, Casey Anthony is eligible and will be filed, indigent for purposes of cause. The judge will control how much money she receives and is allowed spend through out the case.

Even if the judge approves Casey's request, a state agency says it still has big questions. They want to get a good look at her bank accounts. How Casey was able to fork over thousands to her lawyers when she had no job, and how did that money run out are just two of the hard questions her defense will have to answer.

Casey's lead attorney Jose Baez has never explained where that money comes from. On Thursday, he may be forced to answer.

At a hearing scheduled for 11:00am Thursday, a judge will decide whether taxpayers will foot the bill for Casey Anthony's legal fees. However, before that can happen, her defense team will have to prove to the Justice Administration Commission and the judge that she is broke.

Orange County Circuit Court Judge Stan Strickland presided over the hearing and asked the defense to provide an itemized list by Friday detailing how they have spent the $275,000 Anthony has already paid in fees and costs.

It was disclosed in court on Thursday that ABC News paid Anthony $200,000. Of the remaining money, $5,000 came from a donor whom attorney Jose Baez did not identify and $70,000 was given by California-based attorney Todd Macaluso, who has since said he has withdrawn from Anthony's case. Baez said Macaluso provided the funds to help defray defense costs.

Strickland said he will decide if the state should pay for Anthony's defense costs after reviewing the list.

Attorney Cheney Mason, who recently joined the defense team, said the public defender's office cannot afford to pay for the case, and Anthony's defense team will work pro bono.

Baez also said the money that Anthony has provided has already been spent on fees and costs related to the case. Those costs will now have to be explained.

Meanwhile, new evidence that the state of Florida did not want Anthony&#8217;s defense team to see immediately has been unsealed. The state said the notes and conversations are relevant to the case but added that they are not a confession from Anthony. Baez has 15 days to review the new evidence and decide if the defense will ask the court to block its release.

Also, the state attorney's office told Local 6 that it will be releasing about 1,000 pages of new documents in the case later this week or next week. It's not clear, though, what information the documents contain.

A new attorney is now on Casey Anthony's team. But he said his client is flat broke, and that&#8217;s why they said they need the public to pay the rest of her court fees.

Before a decision is made, Judge Stan Strickland wants to see where every dollar up until this point has been spent.

For the first time Thursday, we're learning how Anthony has paid for her legal expenses so far, and how much this case may end up costing taxpayers.

At one point Anthony had $275,000, which her newest lawyer, J. Cheney Mason, said isn&#8217;t much. &#8220;You might think it is if somebody was handed that, but a defense in a case like this normally costs in the millions," Mason said.

Anthony made a deal with ABC for $200,000 for exclusive photo licensing rights.

An unknown individual also made a $5,000 donation and former attorney Todd Macaluso gave $70,000.

A judge said he would need more information before he could decide whether or not to declare Casey Anthony indigent during a hearing Thursday morning.

Judge Stan Strickland asked Casey Anthony's defense team to provide an itemized list, of how their attorney's fees have been spent.

During the indigency hearing, a prominent lawyer was introduced as part of Anthony's defense team. Cheney Mason, a long-time Orlando defense attorney, has joined the Anthony defense.

Both Lyon and Baez said they had no knowledge of any book or movie deals.

The prosecution pressed Baez about money from a deal made with ABC News. "$200,000 came from a deal that was done by my client through the American Broadcasting Company," Baez said.

Baez said there are no future deals under consideration with any news or television company.

In 2008, Casey Anthony had no job, no assets and had been busted for stealing checks from a friend &#8212; all while her 2-year-old daughter was missing.

But the single mother who is now charged with killing her daughter, Caylee Marie, has somehow managed to provide more than $110,000 for her legal defense.

So it may have been no surprise that some members of the public were outraged and baffled when Anthony's attorneys recently requested that she be declared indigent &#8212; more than a year after being indicted on a first-degree murder charge.

Already, the Justice Administrative Commission, the state entity that doles out the public funds used in criminal cases, said it has "severe concerns" with Anthony's request.

Anthony signed affidavits indicating fees of $89,454.83 and $22,500 have been paid or will be paid to attorneys Jose Baez and Andrea Lyon, respectively.

JAC counsel will have a chance to talk about concerns with Anthony's defense team at a hearing before Orange County Circuit Court Judge Stan Strickland today.

Cecilia wrote that sister Crystal is a liar in a 2009 letter to a judge, Pipitone reported. Cecilia&#8217;s allegation: Crystal lied that Cecilia&#8217;s husband had beaten up Cecilia.

Even so, Cecilia has told WFTV-Channel 9 and HLN&#8217;s Nancy Grace that Crystal had the Anthony affair. The affair allegation is also in the latest National Enquirer, which wouldn&#8217;t tell Pipitone if it paid for the sisters&#8217; story.

How credible is their story? Pipitone noted that Cecilia was in jail from August 2008 to January 2009 &#8211; &#8221;the time the affair was supposed to be blossoming,&#8221; Pipitone said.

The women didn&#8217;t respond to WKMG&#8217;s repeated requests for comment, Pipitone said.

Details as to how Casey Anthony has been paying for her defense team emerged as her lawyers told a judge why the state should help pay for some of her legal expenses.

One public disclosure: ABC paid Casey Anthony $200,000. But those funds are gone, Casey Anthony's defense team told Orange County Circuit Court Judge Stan Strickland at a more than hour-long hearing today.

Casey Anthony appeared in court, joined by defense attorneys Jose Baez, Andrea Lyon, new defense team member Cheney Mason and New York attorney Linda Kenney Baden.

State prosecutors also attended, and pressed Baez about what money Casey Anthony once had. A lawyer with the Justice Administrative Commission, the state entity that doles out the public funds, phoned into the hearing too.

Assistant State Attorney Frank George told Baez that during an earlier, private meeting with Strickland, Baez talked about the amount of money tied to Casey Anthony's defense. George asked Baez to reveal that information in open court today.

Baez said the amount was $205,000. Of that, Casey Anthony received $200,000 from ABC through a deal.

An unidentified donor gave $5,000.

Baez then went on to say an additional $70,000 was given to the defense by attorney Todd Macaluso, who was once a part of their legal team.


In other developments, Strickland signed an order that unsealed information that prosecutors had initially sought to keep secret.

He unsealed it after Assistant State Attorney Jeff Ashton wrote in a one-page document filed this week that the state's investigation into the information is complete and there is no need to keep the details private. This means the material will now be turned over to Casey Anthony's defense team and the public. It's unclear what the information is about and it's connection to the case.

"I was looking all over for a Perry Mason. The best I could do was Cheney Mason,&#8221; Casey's lead attorney, Jose Baez, told the media after Thursday&#8217;s hearing.

&#8220;You do not come any larger than J Cheney Mason,&#8221; WFTV legal analyst Bill Sheaffer said. Mason is one of the top defense attorney's in the country. He has tried 50 murder cases successfully and is a part of a number of anti-death penalty organizations.

&#8220;I&#8217;ve been asked to join and I&#8217;m doing it pro bono,&#8221; Mason said in court during the Thursday morning hearing. &#8220;We&#8217;re just seeking confirmation of Ms. Anthony&#8217;s indigency and I don&#8217;t think that should be in question.&#8221; &#8220;He is a founding father of the Central Florida Criminal Defense Association,&#8221; WFTV legal analyst Bill Sheaffer told WFTV. &#8220;This is a game changer.&#8221;

It could mean there will be more changes. Mason is death penalty qualified. That could mean Andrea Lyon is no longer necessary on the defense team.


INDIGENCY DECISION HANGS ON DEFENSE'S LIST
Casey was in the court room wearing a a striped, light-colored, button-down, long-sleeve shirt and dark pants. She was all smiles as she sat down between attorney Jose Baez and new addition J Cheney Mason as the indigency hearing got underway.

&#8220;I think it needs to be out here in open court. So, if they want to tell me what happened in the past, the court is willing to listen,&#8221; Judge Stan Strickland told Cheney, referring to money already paid to attorneys in the case.

Under oath, Baez said Thursday he received $205,000 early on in the case, made up of $5,000 from a yet unnamed donor and $200,000 from ABC, the latter being something WFTV reported over a year ago.


JUDGE UNSEALS MOTION; DEFENSE GETS 15 DAYS
According to information provided by the State in a motion to block the judge&#8217;s Thursday release of the evidence, &#8220;the Orange County Sheriff&#8217;s Office was contacted by an inmate in the Florida Department of Correction, who stated that she had communications with the Defendant while in the Orange County Jail.&#8221;

According to the State&#8217;s motion, &#8220;that inmate was interviewed on or about the 22nd day of January 2010 and relayed potentially relevant statements by the Defendant, which are not in the nature of a confession, and gave the name of another inmate who also had communication with the Defendant. The second inmate, presently incarcerated in Federal Prison, was interviewed on or about the 27th day of January 2010 and reluctantly confirmed communication with the Defendant adding that she had received approximately fifty written communications from the Defendant which were then in the possession of another individual whose identity was provided to the Orange County Sheriffs Office.&#8221;

At the end of Thursday's indigency hearing, Judge Strickland agreed to give the defense 15 days before releasing the actual evidence referenced in the State's motion. After 15 days, the actual evidence will be released unless the defense files a motion to block it.

The names of the inmates have not been released, but prosecutors Thursday handed over to the defense interviews from a Robyn Adams and Silvia Hernandez. It&#8217;s unclear if they are the inmates referenced in the &#8216;secret&#8217; documents.

WFTV asked Jose Baez on Thursday if he even knew about the letters.

&#8220;I'm not going to comment on any of that until the court has an opportunity to hear our arguments,&#8221; Baez said.

Casey Anthony wrote letters to woman from jail, prosecutors say

Prosecutors on Thursday disclosed that murder suspect Casey Anthony wrote 50 notes or letters to a woman she befriended while in the Orange County Jail, and that those notes may be used as evidence.

In paperwork released Thursday, prosecutors don't say what's in the notes, only that they don't include a confession.

Authorities handed over the notes to the Florida Department of Law Enforcement for an investigation. FDLE agents interviewed the woman, now in an undisclosed federal prison, on Feb. 12, according to court paperwork.

The woman told authorities that she befriended Anthony while in the Orange County Jail, that the notes were passed while both were inmates there and that once the woman was moved to the federal prison, all communication with Anthony ended. She told FDLE agents she did not want to "get anyone in trouble" but said a county corrections officer may have helped the women communicate.

Authorities found out about the woman and the notes when a state inmate contacted the Orange County Sheriff's Office, saying she, too, had had communications with Anthony while in the Orange County Jail.

WFTV-Channel 9 legal analyst Bill Sheaffer highlighted the addition of high-profile Orlando attorney Cheney Mason to the defense team.

&#8220;This is the most significant event to the defense and the prosecution since the discovery of Caylee&#8217;s body,&#8221; Sheaffer told WFTV anchor Vanessa Echols.

&#8220;Cheney Mason does not believe in the death penalty,&#8221; Sheaffer said. &#8220;And because the state is seeking death in this case it is his commitment to 1) win this case on the facts and have a verdict of not guilty entered. But failing that, he wants to make sure she does not face the death penalty.&#8221;

The evidence? Anthony made statements &#8220;relevant to the case&#8221; to another inmate, and that inmate pointed to another inmate who had hand-written notes from Anthony, Weber said.

The state says these statements are not a confession, Weber added.
