Our constitution provides that no person shall be brought to trial for a capital crime except upon indictment of a grand jury. This means that no one may be prosecuted for a capital crime except by a vote of the grand jury. Except for capital crimes, the state attorney (or the statewide prosecutor) may initiate all other criminal charges. The grand jury of course may indict for any crime that the evidence justifies.

Jarred Harrell in Court for Pretrial Hearing


CLAY COUNTY, Fla. -- The man who was arrested on child *advertiser censored* charges and is now charged with murdering a 7-year-old girl, stood before a judge this morning.

The judge listed the four charges Jarred Harrell now faces: first degree murder, kidnapping, sexual battery, and lewd or lascivious battery.

Harrell pleads not guilty in Somer Thompson case

Harrell is being held in an isolated Clay County Jail cell without bail. His next court appearance is scheduled for April 26.

Harrell also faces multiple child *advertiser censored* charges in two other cases.

He is being represented by public defender Kate Bidell, who declined comment after Harrell's arraignment.

"I don't think I'll be saying anything," Bidell said.
