Casey Anthony Back In Court, Lawyers Seek Volunteer Info

The Casey Anthony case heads back into an Orange County courtroom Monday.

Anthony's lawyers want Texas EquuSearch to turn over all records relating to searches done near the woods where Caylee's remains were found.

But the group is fighting the request, saying it invades the privacy of many of the volunteers who joined in the search. And the group's lawyers say Anthony's defense team is just wasting taxpayer money with the motions.

It's also possible the judge will talk about the release of more than 250 pages of secret letters Anthony exchanged with another inmate at the jail.

Casey Anthony was back in court on Monday for a hearing over documents related to the search for Caylee.

Judge Stan Strickland denied a request from Anthony's defense regarding access to records for thousands of Texas Equusearch volunteers. Texas Equusearch is the search and rescue group from Texas that hunted around the same spot where Caylee was eventually found.

Judge Stan Strickland denied a motion by the defense to release search records in the Casey Anthony investigation on Monday.

Strickland delayed a ruling during the morning hearing and then released his decision in the afternoon.

Attorney Mark NeJame represented Miller at the hearing. He said that Miller and the records have been available for months, and no request was made by the defense to speak with him or visit his office to review the documents.

"I think they should have the time to come to my office and review the 4,000 documents they're jumping up and down they haven't had access to because they haven't made the time to come over," NeJame said. "It is beyond me. It is incredulous to suggest that there is this bombshell, that things have been hidden from them when they're still sitting in my office."

If defense attorney Jose Baez wants details about the thousands of volunteers who helped search for Casey Anthony's 2-year-old daughter, he's just going to have to look at the records that have already been available to him for seven months, a judge decided Monday.

Casey Anthony's attorney Jose Baez complained that Texas EquuSearch has not turned over all of the names of people who searched the area near the Anthony home in east Orange County where Caylee Marie Anthony's remains were ultimately found.

Texas EquuSearch attorney Mark NeJame said Baez hasn't taken time to come to his office to look at the documents and it's incredulous to suggest there's a bombshell hidden in them.

NeJame said Baez's lack of reviewing the records is "either laziness or sloppiness."

Later, Baez proclaimed: "Why is everyone so afraid of uncovering the truth in this case?" "They are trying to kill Miss Anthony, and we are trying to save her," Baez said. "How can we do it if we are handcuffed at every twist and turn?"

Judge Stan Strickland has withheld ruling on a motion from Casey Anthony's defense regarding records for thousands of volunteers who searched for Casey's daughter, Caylee.

Last year, EquuSearch turned over information about the 32 volunteers who helped search near the area where Caylee's remains were later found, but Anthony's defense team said it believes more people also searched the area.

The defense said it believes some of the volunteers would be able to testify that Caylee's remains were not in the woods in September 2008, the final time Anthony was arrested.

Even if records are turned over, the search group said no one was ever in the exact location where Caylee's body was found.

Strickland said he could rule as early as today.

Lawyers yelled in court Monday during the latest hearing in Casey Anthony's murder case, but Casey sat expressionless, rarely cracking a smile and hardly saying a word to her lawyers. In the end, Judge Stan Strickland denied Casey's defense team their request.

Baez did most of the speaking Monday; Casey's new high-profile attorney, J. Cheney Mason, didn't play a big role.

Late Monday afternoon, Judge Strickland denied the defense request, but said Casey's attorneys can still go and look at the documents and, if they flag something that could be important, they can go back to the judge and try to get that released. The judge, though, isn't going to blanket release all the documents.


WHAT'S NEXT IN CASEY CASE?
Here's what's next in the case against Casey. Later this month, more discovery documents are expected to be released. In May, the civil case brought against Casey by Zenaida Gonzalez will have a pre-trial hearing.

Pen pal letters Casey wrote from jail to another inmate, Robyn Adams, could be made public as early as Tuesday after no one objected to the release of 50 jail house letters. A corrections officer suspected of passing those letters is on paid leave, but the defense decided not to fight their release. &#8220;We're not concerned with anything in there, there's no admissions,&#8221; Baez said after Monday&#8217;s hearing.

Baez said not releasing them would only fuel massive speculation in the media. &#8220;If you look at them within the context, they're of a person locked up 23 hours a day,&#8221; he said.

New accusations are flying against Casey Anthony's defense team.

The attorney for Texas EquuSearch is describing Anthony's dream team of lawyers as &#8220;lazy and sloppy.&#8221;

Anthony's lawyers wanted Judge Stan Strickland to grant them access to the names of every volunteer and all documents the group has relating to the search of Caylee Anthony. Defense attorneys said information the volunteer group is holding could clear their client.

But on Monday, Judge Strickland ruled Texas EquuSearch will not be forced to turn over information on its volunteers.

An FDLE investigation reveals Anthony wrote dozens of letters to another inmate in the Orange County Jail. Anthony's defense says they have nothing to hide.

"We're not concerned with anything in there,&#8221; Baez said. &#8220;There's no admissions. If we move to keep them private, you guys are going to speculate all over the place as to what's in there. You're going to find if you look at them in the context there of a person who&#8217;s locked up 23 hours a day."

There's no word on when the letters will be released.

Also on “In Session,” defense attorney Cheney Mason said a private conference with the judge had nothing to do with today’s proceedings. Mason said the discussed top was “an extremely confidential matter” and “may come out later.”

Mason took a swipe at NeJame, saying the contentious hearing was expected “given the personality of the little player there for Texas.”

Cheney added: “We are not going to lightly be relegated to having to rely on the judgments and expertise of Mr. NeJame or anybody else as to what’s relevant or is not. Even the state can’t determine that. They have to give it all to us.”

Mason repeated his contention — which he made long before he joined the defense team — that there is no forensic evidence to link Casey Anthony to her child’s murder.

And what about those 50 letters that Anthony wrote to a fellow inmate at Orange County Jail? Baez told “In Session” that they contain his client’s communications about food and what she’d like to do when released.

Anthony's defense team is seeking about 4,000 pages of documents from Texas EquuSearch, but Tim Miller, who is president of the group, opposes the motion. Miller called it an invasion of privacy for volunteers who searched for Caylee.

Judge could issue order today regarding volunteer records

After listening to two attorneys bicker about access to records earlier today, Judge Stan Strickland ordered Casey Anthony's defense team to look at records that have been available to them for seven months.

Strickland today denied a request by the defense for all records from Texas EquuSearch, a volunteer group whose members looked for missing Caylee Marie Anthony in 2008.

However, Strickland ordered the defense go through records of 32 searchers, records that have been available since late August in a local attorney's office.

If the defense needs access to more records, it is free to request those, Strickland said in a three-page ruling.


EquuSearch claims 32 people searched the woods around the location where the remains were found but that they did not go to the exact spot because the area was flooded at the time.

Attorney: Records are available for inspection

Texas EquuSearch attorney Mark NeJame fired back at Baez's claims, saying Baez has had plenty of time and access to view all the volunteer records. He called Baez's lack of doing so "either laziness or sloppiness."

NeJame said Texas EquuSearch can't be responsible for what searches people did on their own time, separate from the organization.
