GUILTY TX - Irene Garza, 25, found murdered, McAllen, 16 April 1960

If only his priesthood had ended and he was jailed when he attacked the other woman weeks beforehand, rather than just a $500 slap-on-the wrist fine, Irene might well be alive today!!!!:banghead::behindbar:behindbar
This is justice way too delayed. Take that Rene Guerra!!!:badmood::stormingmad:

Updated 48 Hours episode featuring Irene's murder is on right now.....

I saw it, it was definitely updated, had a whole new slant on it, but continued to show how this case could've been prosecuted years earlier if it weren't for the stubbornness of Rene Guerra (whom I think refused to prosecute because it was his own religion)!!!

It's just a shame that it took this long, especially because it appears everyone knew he was guilty almost from the beginning. And now he's gotten to love a full life and at his age, probably won't spend long in prison. Sad.

More than 20,000 pieces of evidence and documents have been made available in the trial of a former priest accused of killing a McAllen beauty queen and schoolteacher.

That was the extent of revelations in a status hearing, which lasted less than 10 minutes, in the case of John Bernard Feit, who faces life in prison in connection with the death of Irene Garza.

Not discussed during the lightning-quick hearing was Feit’s bond, something proposed during Feit’s initial hearings and most recently at the June hearing.

Feit’s attorney, O. Rene Flores, who followed Feit back to the basement of the courthouse for a quick discussion before addressing the media, said his team, which includes co-counsel Ricardo Flores, is more concerned with other issues.

“We’re not immediately concerned with bond at this point. We have plenty of other things involved in the case that we’re directing our attention to,” Flores said. “As far as him being in custody and so forth, I’m not immediately concerned with that right now.”

Feit is scheduled back in court on Oct. 27.

Former McAllen priest John Feit made an appearance in court on Thursday.

The purpose of the hearing was a status check. Both the state and defense are still preparing for trial.

The hearing was over in just a few minutes. No new motions were filed.

Another pretrial hearing is set for Dec. 8. Judge Luis Singleterry mentioned a trial date may be set at that hearing.

John Bernard Feit, the 83-year-old former priest and lone suspect in the death of Irene Garza, listened on Monday morning as his attorney O. Rene Flores, and the prosecutors for the state, Assistant District Attorneys Michael Garza and Krystine Ramon, gave the court an update on the case that was re-initiated last year, 60 years after the killing took place.

Garza said they have gone through most, if not all, of the evidence — more than 20,000 documents.

Flores said he too was ready — aside from another 1,000 or so documents which were recently turned over to him.

Both attorneys are still awaiting the results of lab analysis of some of the evidence.

Trial Date Set for Suspect in Decades-Old Murder Case

A former McAllen priest accused in a decades-old murder made a court appearance Monday morning.

John Feit was arrested for the murder of Irene Garza last year in Phoenix, Arizona.

Feit walked into court Monday using his walker and shook hands with people on his way to his seat. When his counsel asked him how he was feeling, Feit replied that he felt great.

The 92nd District judge, Luis Singleterry, set Feit’s trial date for April 24.

Former priest’s attorney files for change of venue

The attorney for a former priest accused of killing a McAllen schoolteacher doesn’t believe his client can get a fair trial in Hidalgo County, citing among some of his reasons, the overflow of coverage into the case that spans nearly 60 years.

O. Rene Flores, a criminal defense attorney based in Edinburg, and the man who has been by John Bernard Feit’s side since before he opted to waive his extradition from Arizona to Hidalgo County, formally filed a motion to have the trial’s venue changed, arguing that his client will not receive a fair trial in the county.

Flores on Tuesday filed a memorandum to the court containing more than 700 pages of documented evidence in support of his argument that the former priest has been over covered by local, state, national and international media.

Flores claims that up to more than 75 percent of potential Hidalgo County jurors have been exposed to unsubstantiated rumors and evidence of Feit’s alleged guilt — much of which would be inadmissible in court — and he claims another 69 percent of those jurors already believe Feit to be guilty, the memo states.

“The pervasive, prejudicial, and inflammatory nature of the media coverage thus makes a change of venue necessary to preserve Feit’s constitutional right to a fair and impartial trial,” Flores states in the memo.

Flores in his argument highlights the publicity coverage the case received even back in 1960, when Garza was first reported missing.

A state judge has delayed the April trial of the former Catholic priest charged with the 1960 murder of a South Texas beauty queen, and will hear arguments next month that a “media frenzy” has poisoned the jury pool.

O. Rene Flores and Ricardo Flores, representing 84-year-old John Feit, filed a 34-page memorandum last week asking to move Feit’s case out of Hidalgo County. They argued that the “inflammatory nature of the media coverage” in the past 57 years has made it impossible for him to receive a fair trial.

On Wednesday, Hidalgo County Judge Luis Singleterry agreed that the ex-priest is entitled to a hearing and set a May 17 court date. He also scrubbed the original April 24 trial date.

Judge to decide on trial relocation in John Feit case 'sometime next week'

Judge Luis M. Singleterry said more time would be needed to make a decision.

"I don't anticipate having reached a decision with all this until sometime next week, but I will inform you as soon as I do," Singleterry said.

If the request to move the trial is denied, a pretrial date has been set for July 19. The preliminary trial date has been set for Sept. 11.

Feit trial to remain in Hidalgo County

A jury of Hidalgo County residents will decide John Feit's fate.

Luis Singleterry of the 92nd state District Court denied Feit’s motion for a change of venue early Wednesday, court staff confirmed.

“The Court after reviewing the record, pleadings, hearing testimony and argument of counsel, is of the opinion that Defendant has failed to demonstrate the existence of such prejudice in the community that the likelihood of obtaining a fair and impartial jury trial is doubtful; therefore the Defendant’s Motion for Change of Venue should be DENIED,” according to court record signed June 7.

After being extradited to the Rio Grande Valley, 83-year-old John Feit was back in court for a final pre-trial hearing Wednesday morning.

"I think the purpose of this hearing was to try and establish a ground mark or a plan for jury selection and get this case tried before a jury." Stated the Prosecution.

The trial is scheduled to begin on September 11th.
