Says that he has ignored the court's orders in the past, talking about hearings before Judge Callahan, Judge Groner, and other Wayne County judges. He's digging way back through Kilpatrick's many different appearances before judges.

Talking about what he says is Kilpatrick's "demonstrated history of not following other court's orders," Bullotta says Kilpatrick is a flight risk and should be detained.

Kwame Kilpatrick has no reason to flee, says his lawyer Jim Thomas. He has appeared at every hearing--federal, county and otherwise--showing up on time and paying attention.

"Mr. Kilpatrick is not a danger to the community," Thomas said.

Kilpatrick appears to be in a daze. His eyes look tired, and he seems worn down. We've not seen this kind of emotion during the entire trial.

Prosecutor Eric Doeh is now addressing the judge with regard to Bobby Ferguson.

Doeh reminds the court of Ferguson's criminal history. Remember, he pleaded guilty to assault many years ago for pistol whipping an employee of his. Doeh is also talking about the hundreds of thousands of dollars recovered at Ferguson's home and office, as well as weapons that appeared to be in his possession.

As Doeh speaks, Ferguson is as stoic as he was throughout the trial. His hands are folded at the desk, his head is cocked to the side. Kwame Kilpatrick's head is resting in his hand, and his eyes are closed.

Evelyn reminds the judge that Bobby Ferguson is married and has five children. He makes a good point that the cash and guns found in his home were discovered as part of the bid-rigging trial from the Summer. Remember, that trial ended in a mistrial, so the "facts" of that case are still up in the air.

As we wait to hear from the judge, we're getting a good look at the victorious prosecutors. Huddled together at their table, they're all smiles.

On the flip side, defense lawyers seem stunned. They're leaning back in their chairs and not speaking. Kilpatrick's mother looks devastated as she sits in the second row.

"A decision turns on the burden of proof, and that's true of this case as well," Edmunds says.

Edmunds notes that Kilpatrick has, in the past, said he is innocent and will not be headed back to prison. That's clearly not the case now, Edmunds says. In other words, now that he has no chance of vindication, she suggests that he has less incentive to return to court.

Kilpatrick and Ferguson will be remanded for detention. They're going behind bars.

Detroit - Former Detroit mayor Kwame Kilpatrick and contractor Bobby Ferguson will head straight to prison just hours after a jury found them guilty in their months-long corruption trial.

Judge Nancy Edmunds opted for immediate imprisonment instead of allowing the men to remain free while awaiting sentencing in the next few months.

During an afternoon hearing, Kilpatrick sat with his attorneys, with family members and supporters seated just behind him. On her way into the courthouse for that hearing, Kwame Kilpatrick's mother, former U.S. Rep. Carolyn Cheeks Kilpatrick, said, "I served 32 years. Pray for my family."

Edmunds asked defense attorneys to argue why their clients should not be sent immediately to prison. Kilpatrick's attorney said the former mayor does not have the financial means to flee.

Prosecutors countered, saying Kilpatrick needed to be detained due to his history of lying, disobeying court orders and his ability to access cash that might allow him to flee. They described Ferguson as a violent flight risk.

Following the arguments, Edmunds recessed the session to consider the information presented...

Well whatever it is it should be wearing off here in the next couple hours & hopefully he'll have a sleepless jittery cold night. Time to think about how good he could've had it. How he could've made the city shine. Look at the wide path of destruction this man & his family have caused. Imo

He could have made it to the top. I recall his words "I want to tell you, Detroit, that you done set me up for a comeback," in 2008. Who would have thought his return to Detroiit would lead to this?

Detroit — Kwame Kilpatrick lost his bid Wednesday to leave prison and visit his family in Texas.

U.S. District Judge Nancy Edmunds refused to release Kilpatrick on bond pending sentencing in the City Hall corruption case. He faces up to 20 years or more in federal prison after being found guilty of 24 charges, including racketeering conspiracy.

The judge ruled Kilpatrick, who complained he needs to leave the federal prison in Milan so he can receive medical treatment for an injured knee, did not persuade her that he won't flee while out on bond...

I, for one, don't think anyone should get bail if you are found guilty of a crime. I sure hope the judge gives him the maximum penalty. It's 20 years isn't it and don't let him out on good behavior either?

Detroit — Federal officials continue to play hardball with former Detroit Mayor Kwame Kilpatrick and are unmoved by his complaints of leg pain from an old football injury and resulting safety fears in prison.

Transcripts of a Thursday meeting between U.S. District Judge Nancy Edmunds, Deputy U.S. Marshal Sandy Murphy, assistant U.S. Attorney Mark Chutkow and Kilpatrick defense attorney James C. Thomas showed federal officials weren't overly concerned about the alleged plight of the disgraced former mayor.

The transcripts also demonstrated another attempt by Thomas to have the court reconsider its decision to deny bond to Kilpatrick, who is locked up pending sentencing in the City Hall corruption case...

At least 20 years, but taking into consideration KK's past record, he could get more than that. I hope he does.

I'm glad that the Judge isn't caving in to Kilpatrick's foolish demands. Judge knows as well as I do that Kwame wants to bolt. He is a major flight risk and can't be trusted anywhere outside prison. If he's gets a chance to run, that knee injury won't bother him one bit ;)

"Due to the rigors of trial and parole, he was unable to spend any meaningful time with his family and he requests permission to do so at this time," lawyer James C. Thomas wrote in a request filed Monday in federal court...

Kwame Kilpatrick asks judge to overturn conviction

Detroit — Kwame Kilpatrick asked a federal judge Monday to overturn his corruption conviction and order a new trial.

In a twist, Kilpatrick filed the request by himself and revealed that he has filed a complaint with the Michigan Attorney Grievance Commission against his taxpayer-funded lawyer, James C. Thomas. It was unclear early Monday whether Kilpatrick had split with his longtime lawyer, who could not be reached immediately for comment.

In the 22-page filing, Kilpatrick, claimed there was insufficient evidence to convict him of racketeering conspiracy, a 20-year felony, blasted the grand jury selection process and complained about his lawyer's conduct and "blatantly prejudicial" media coverage...

Detroit — Disgraced former Mayor Kwame Kilpatrick entered a federal courtroom Thursday in handcuffs and prison threads in hopes to replace his longtime attorney with another tax-payer funded lawyer.

Kilpatrick told U.S. District Judge Nancy Edmunds that his attorney, James Thomas, isn't defending him and refuses to communicate, saying their relationship is destroyed.

Edmunds retorted, saying Kilpatrick's lawyers have represented him with vigor and with great personal effort...

Kwame Kilpatrick was ordered to the federal prison in Milan March 11. He says he slipped on the transport van step that day, injuring his knee, and will need surgery to repair a ruptured tendon.

Detroit — Kwame Kilpatrick can't flee on a gimpy knee, his new lawyer said, while making a request to have the former mayor released on bond pending sentencing in the City Hall corruption case.

Kilpatrick needs surgery to repair a ruptured tendon in his knee, might need to use a walker and has to undergo three months of physical therapy, defense lawyer Harold Gurewitz wrote in a court filing...

Kwame Kilpatrick's newest attorney has filed a request for a new trial.

In March, Kilpatrick was found guilty of 24 charges, including racketeering and extortion. He's imprisoned while awaiting sentencing.

A date hasn't yet been set for it. He could get 20 years in prison for the racketeering convictions alone.

In May, Kilpatrick's prior counsel, James Thomas, withdrew from the case and handed it off to Harold Gurewitz.

Gurewitz filed Kilpatrick's request for a new trial on June 28, saying Kilpatrick was denied his right to a "choice of conflict-free counsel"...

Detroit — Ex-Mayor Kwame Kilpatrick will be sentenced Sept. 3, almost exactly one year after his City Hall corruption trial started in federal court.

The sentencing date was set Thursday by U.S. District Judge Nancy Edmunds and will cap a years-long odyssey that saw Kilpatrick go from mayor and national political figure to federal prison inmate.

Prosecutors say Kilpatrick, who was convicted of 24 charges including racketeering conspiracy in March, likely will be sentenced to 20 to 30 years in prison.

“I would take the over if you set it at 20 years,” said Peter Henning, a former federal prosecutor who is a law professor at Wayne State University. “The government’s focus is going to be on the abuse of power and harm to the city.” ...

Detroit — A federal judge refused to grant new trials Thursday to former Mayor Kwame Kilpatrick and city contractor Bobby Ferguson or acquit them of corruption charges.

U.S. District Judge Nancy Edmunds said she would explain her decision in writing soon but hinted that her opinion would not contain any surprises.

Kilpatrick and Ferguson were quickly handcuffed and escorted out of the courtroom by deputy U.S. Marshals, bound for the federal prison in Milan where they are being held until sentencing next month. But not before Kilpatrick turned to an unidentified female friend in the gallery and tapped his chest near his heart.

The judge’s order removes one last obstacle ahead of sentencings for Kilpatrick, his father, Bernard, and Ferguson, all of whom were found guilty by a diverse jury in March following a five-month trial. Edmunds also refused to acquit Bernard Kilpatrick of a single tax charge...

Kwame Kilpatrick seeks to delay prison sentencing one month

Detroit— Former Mayor Kwame Kilpatrick wants to push back his sentencing date in the City Hall corruption case one month so his new lawyers have more time to prepare.

Kilpatrick’s lawyers filed a request Tuesday to delay the Sept. 3 sentencing, a request that would prolong the highly anticipated conclusion to one of the country’s biggest public corruption cases. A delay would protect Kilpatrick’s due process rights and give his new legal team time to review “voluminous testimony and trial exhibits,” according to a filing Tuesday in federal court.

Attorneys Harold Gurewitz and Margaret Sind Raben replaced Kilpatrick’s trial team after the jury returned with guilty verdicts on 24 counts against the former mayor in March.

“This court’s obvious rush to sentencing for Mr. Kilpatrick is a violation of his right to due process,” Gurewitz wrote...
