GUILTY TX - Alan, 48, & Darlene Nevil, 46, murdered in their Garland home, 17 Aug 2010

it's beyond my imagination that a 12 year old girl would do this ...... RIP

From the article it says: family and friends said the girl is Darlene Nevil's daughter and the boy is the daughter's boyfriend.

So sad, I can't imagine what would make a kid do this.

Capital murder, in adult cases, can bring the death penalty.

However, the U.S. Supreme Court has ruled that juvenile defendants can't be executed if they were under 18 at the time of their crimes.

Hill also explained that juveniles can't be certified to be tried as adults until they reach age 14.

The maximum capital murder penalty for children is 40 years incarceration with the Texas Youth Commission -- the state’s juvenile corrections agency.

But, Hill added, the TYC can recommend parole for someone, if they respond well to "rehabilitative efforts."

"Minimum length of stay is three years on murder," Hill said, "but on capital murder, the minimum length of stay is 10 years.

"After age 19, TYC would lose the jurisdiction and the person would go into the adult system."

At that point, they could enter a regular prison or be released on parole, but as an adult, Hill said.

Sad and disgusting. 12 year old girls should be having sleep overs and going to movies with other 12 year old girls. Not having 13 year old boyfriends!

Guardian assigned for 12-year-old Garland girl accused of murdering her mother, stepfather

Generally speaking, an ad litem is an attorney appointed in absence of a parent or at the request of the lead attorney. The girl lived with her father in Ohio prior to joining the Nevils in Garland last summer, but no family members were present in the 304th District courtroom of the Henry Wade Juvenile Detention Center on Thursday

Sad in a way, that there was nobody for this girl. A bit o/t, but reading stories like this makes me think I'm glad my partner and I don't have any kids. We got together when I was 38 and he was 55 and though we wanted to at the beginning of our relationship, we decided against it. In reading stories like this I'm glad we didn't have kids. You want to do the best by them, but it's not certain they see it that way.

A 13-year-old Garland boy accused with his girlfriend of killing her mother and stepfather reached a plea agreement with Dallas County prosecutors this week...

He was discharged to the Texas Youth Commission, to spend six weeks in an evaluation facility... At age 19, he will be transferred into the adult system.

The girl was sentenced to 20 years in a plea agreement Monday, half of the maximum that she was facing in the juvenile system. It’s also less than the 28 years handed down earlier this year to her 13-year-old boyfriend and accomplice. By law, she will serve at least 10 years...

The girl will be in custody of the Texas Youth Commission until a hearing sometime between her 18th and 19th birthdays. It will then be determined whether to send her into the adult system for the remainder of her term.
