Hello all... I busted out of time out a little bit earlier (was shackled for the last 24 hrs, lol)... I promise to be good now

Quick question about today, did ALV do her closed hearing and any news on the outcome of that? Or is it tomorrow?

No that's tomorrow.

What happened this afternoon?

All I was able to get was the seal.

The judge held a closed hearing with Alyce LaViolette today at 1:15 AZ time. No word on the outcome or if we will see her back on the stand Tuesday.

The jury was in and out in five minutes. Only thing they heard was a stipulation that Jodi didn't have a gun or knife in her hand at the time she took the close up of Travis's face in the shower. This was a compromise between State & DT following the Daubert hearing earlier in the day.

The parties stipulated that the defendant was not holding a knife or gun in her hands when exhibit #159 was taken.

JVM has been talking with one of Travis' friends, Jesse McPherson...a friend who Travis opened his home to, about how generous Travis was...and now about the rough day in the courtroom for Travis' family.

If she was holding a weapon in one hand and the camera in the other it would have to be the gun. If she was simply holding a knife on TA I don't think he would have just sat there and let her take the photo. He would immediately start trying to defend himself. A gun, on the other hand, is a different kind of threat. It might cause someone to become frozen with fear. Personally, I think she had the gun on her person and used it while he wasn't looking, to get the jump on him. Since she went there to kill him there would be no point in warning him in advance. IMO her plan began to go awry when the gunshot did not kill him and, for whatever reason, she was not able to shoot him again. That's when she went to get a knife to finish him off. In addition, I think her original plan was to shoot him in the shower so all the blood would go down the shower drain. She wanted to make sure she didn't get any of his blood on her to accidently take back to CA on her person or in her car. She thought she planned the perfect murder but, think again JA.

also for those just joining us: while most of what was done today was under seal or was otherwise challenging the eye guy or arguing mistrial.. TODAY WAS A PIVOTAL DAY. The last straw has been munched off and it is a nub.


We may not get to see it all (re: sealed hearings) but this judge is on it and she is doing a great job. They are working. While the jury may be inconvenienced with all of these sealed hearings they are still a part of the trial and the process if you will.

Also: the defense has not rested so we do not know what will be in store for tomorrow.

I watched the earlier proceedings--two motions for mistrial and the Daubert hearing. During the motion that dealt with the defense team's accusation that JM harassed and intimidated Samuels and ALV the judge mentioned the closed door meeting/sealed hearing. She also referenced it at the end of the Daubert hearing. Specifically said the ALV meeting would take place at 1:15 p.m. AND that she'd rule on the hail Mary involving the photo/Bryan Neumeister testimony.
