Anthony Defense Team Wants Case Dismissed

Anthony's attorneys want the judge to drop the case because her defense team never got a chance to look at the scene where her daughter Caylee's remains were found.

The attorneys said they also want a change of venue, maybe in Miami-Dade, Broward or Palm Beach counties, and they want a ruling in 30 days.

They said they also want all video and audio tape of their client recorded by the Orange County Jail to be destroyed.

Casey Anthony's defense team asked that the murder case against her be dismissed because the state prevented her attorneys and their experts from properly inspecting the scene where her daughter's remains were found, according to court documents filed late Thursday.

In addition, Anthony's lawyers asked Orange Circuit Judge Stan Strickland to stop the Orange County Jail from videotaping her visits with them and with her family.

&#8226;The defense agreed to the state's request for a transcript of George Anthony's grand-jury testimony. He testified before his daughter was indicted for murder.

&#8226;Her attorneys also filed a response to prosecutors' request for evidence supporting a defense claim that someone other than Casey Anthony placed Caylee's body in the woods. Anthony's attorneys wrote that their claim was based on documents, pictures and video provided by the state.

Brad Conway, the attorney for Casey&#8217;s parents, George and Cindy Anthony, told News 13 Friday that his clients have no problem with their visits with Casey being recorded, but unless it has some value as evidence, they do not want it released to the public.

Conway said he felt pretty confident the motion would be granted to keep those visits sealed unless they would be used some way in trial.

A representative with the Orange County Jail told News 13 visits are always monitored for the client&#8217;s safety. The representative added they have no intention of offering special treatment to Casey Anthony, and she would be treated like every other inmate.

Anthony's lawyers filed the motion Thursday night. They also asked the judge to stop the Orange County jail from videotaping Anthony's visits with them and with her family.

The defense said Anthony needs family support and releasing the recordings of her jail visits could be an attempt to punish her before the trial.

A message left for a state attorney's office spokeswoman was not immediately returned early Friday.

Anthony's defense team also said they would like the trial, if it proceeds, to be moved to Miami-Dade, Broward or Palm Beach counties. They said they want a ruling on the matter in 30 days.

It has been nearly a year since Casey’s parents have talked to her in person, partially because Casey’s attorney, Jose Baez, requested that they not go to the Orange County Jail, since their conversations would be recorded and released.

Conway told News 13 the Anthonys have been communicating with Casey through letters, but they still want to be able to have a private, sit-down conversation with her.

Conway said he felt pretty confident the motion would be granted to keep those visits sealed unless they would be used some way in trial.

Prosecutors want a transcript of George Anthony's secret grand jury testimony that led to the first-degree murder indictment against his daughter Casey.

George, a former detective, told investigators he recognized the unmistakable odor of a dead body in the trunk of Casey's car when he picked it up at a wrecker service.

Prosecutors presented the grand jury case and George is working with the defense team, so both sides likely already know a lot about the testimony, which is supposed to be secret.

Anthony's defense ream said they also want all video and audio tape of their client recorded by the Orange County Jail to be destroyed, and they want a transcript of what Casey Anthony's father, George Anthony, said to a grand jury on Oct. 14.
