'Junk science' at center of Casey Anthony hearing

ORLANDO -- Attorneys are waging a crucial battle over evidence this week in the Case against Casey Anthony.

Not only are the judge's decisions important to the case, but they could set a precedent for future cases.

Two police dogs trained to detect decomposing bodies searched the backyard of the Anthonys house and Casey’s car.

Jose Baez: And how do you know the dog alerted?
Sgt. Kristen Brewer: Best to my recollection, the dog sat (inaudible)
Baez: And at that time, did Deputy F. advise you that the dog had given a full trained alert?
Brewer: He advised the dog had alerted in that area at the time. That was the dog's alert.

    At times emotions ran high.

Both sides argued about that one strand of hair found in the trunk of Casey’s Pontiac.

Casey Hearing Day 2: 10 AM Update
    WESH Orlando "Snip" http://www.wesh.com/r/27306672/detail.html
Casey Anthony arrived in court in a hot pink cable knit sweater Thursday morning. Her mother, Cindy, is once again the only family member in court. Anthony has been busy going through binders of information at the defense table.
On the stand this morning is Deputy Jason Forgey, a canine handler with the Orange County Sheriff's Office.

Later Thursday, it's anticipated the focus of the hearing will switch to debating the science behind the air samples that confirmed the presence of chloroform and chemicals consistent with human decomposition in the trunk of Casey's car.

ORANGE COUNTY, Fla. --Attorneys debating scientific evidence get heated. Chief Judge Belvin Perry had to fight to keep them on topic.

The defense filed a motion Thursday, accusing Perry of bias and misstating facts.
    Motion: http://www.wftv.com/pdf/27311684/detail.html

Casey's attorneys want Judge Perry to reconsider his decision to allow the jury to hear Casey's lies to law enforcement and her family.

Bombshells from the prosecution's scientist that even got Casey's attention.

Dr. Arpad Vass, told the prosecutor his reaction to opening the sealed container holding the carpeting.

"I jumped back 20 feet. It was very strong. To me it was the smell of human decomposition," said Dr. Vass.

Casey's eyes widened when he said that, and then she looked down.

Dr. Arpad Vass, found eight times more chloroform emanating from her trunk carpet and 10,000 times more chloroform in the air from her trunk than he's even seen with unventilated decomposition.

WFTV legal analyst Bill Sheaffer said he expects that prosecutor Jeff Ashton, will convince Judge Perry to allow Vass's air tests to come into a trial for the first time ever.

Both sides will continue the battle over scientific evidence at another hearing on Friday April 1. They'll discuss "plant growth evidence," detectives collected along with Caylee's remains and a stain found in the trunk of Casey's car.

Judge Perry will also hear testimony about a heart sticker discovered near Caylee's remains

Vinnie Politan of “In Session” called it “the biggest moment of the day” at the Casey Anthony hearing today.

Dr. Arpad Vass: “First I jumped back about two feet,” Vass said.

“It was, to me, the smell of human decomposition,”.

WFTV’s Kathi Belich called it “a bombshell that got even Casey’s attention.”

WESH -Channel 2’s Amanda Ober reports: “Vass said over his career he’s personally overseen studies on at least 50 decomposing bodies and is intimately familiar with the unique odor,” Ober reported.

Ober also highlighted Vass’ testimony that chloroform detected in the trunk carpet was 10,000 times greater than what would found in a controlled sample.

“As an attorney that had a powerful effect on me,” Sheaffer said. “That’s going to have even a greater effect on a juror when they hear that.”

WFTV’s Belich reported, “Mason is the one who filed the motion accusing the judge of bias and factual errors, and Cheney Mason was not in court today

Casey Anthony attorney: Judge Perry has 'clear bias'
An expert also testifies about extraordinarily high levels of chloroform levels.

Casey Anthony's attorneys returned to court today for battles over scientific evidence that included surprising testimony about chloroform levels found in the trunk of her Pontiac Sunfire.

The defense filed a biting 9 page motion for a rehearing on its attempts to get Casey Anthony's statements to law enforcement and to her parents and brother and others inside the Orange County Jail kept out of her upcoming trial.

Today's defense motion cites "factual errors between testimony presented at hearing and the order denying [the] motion to suppress statements made to law enforcement officers."

The motion goes on to refer to a series of "inaccuracies" in Judge Perry's order regarding Casey's involvement with LE early on in the case on July 15 and July 16 2008. Also, "the court did not look at the evidence from the hearing objectively and instead displays a clear bias in explaining law enforcement conduct, factual inaccuracies in the court's order which were relied upon in reaching its conclusion, attorney Cheney Mason wrote in one part of the motion.

Chloroform levels extremely high, expert says

Arpad Vass, senior research scientist at Oak Ridge National Laboratory is testifying about his extensive research in buried body decomposition as well as surface decomposition.

Anthony's team is trying to stop air-sample evidence used in her murder trial.

Vass said Detective Melich contacted him about this case.

"He had some odor issues in the trunk of the car," he said.

Vass said in hundreds of such samples he'd collected through the years he'd never seen chloroform levels that high. His reaction, he said, was "surprise."

Vass says the amount of chloroform found in the air sample from the car was too high to be just from decomposition of a human body. "I don't think so," he said when asked by Assistant State Attorney Jeff Ashton. "It's much greater than that."

He estimated the levels found to be 10,000 times greater than normal human decomposition levels.

    Day 2 Of Casey Hearing
    Updated: 7:03 pm EDT March 24, 2011

Baez was scolded again for allegedly trying to pull a fast one on prosecutors by challenging something he agreed he would not challenge.

"Someone might assume that you were waiting in ambush," Perry said to Baez.

But Baez claimed he was pressured into that agreement because of the threat of a contempt charge.

"Opportunity happened to land on his lap, that he has a contempt charge lying over opposing counsel's head to basically force his hand," Baez said.

Both sides will continue the battle over scientific evidence at another hearing on Friday April 1. They'll discuss "plant growth evidence," detectives collected along with Caylee's remains and a stain found in the trunk of Casey's car.

Judge Perry will also hear testimony about a heart sticker discovered near Caylee's remains.
