ORLANDO -- The prosecution has only a handful of other witnesses to call. Judge Perry ruled that electronic time card information from Cindy Anthony's employer can be introduced by the state to rebut testimony she made earlier.

The prosecution plans to use its rebuttal case Friday to attack testimony offered by Casey's mother Cindy Anthony about computer searches she claims she made months before her 2-year-old granddaughter, Caylee, disappeared.

Defense Rests In Casey Anthony Murder Trial On Thursday
Anthony, 25, Could Face Death Penalty If Found Guilty

"Snip" UPDATED: 7:17 am EDT July 1, 2011

ORLANDO, Fla. -- Judge Perry asked Casey Anthony if it was her decision not to testify. She said it was and that she has had time to discuss the matter with her attorneys.

Local 6 legal analyst Mark NeJame noted that the defense never presented evidence or witnesses to bolster its claims in opening statements.

Lead defense attorney Jose Baez claimed that Caylee Anthony drowned in the family pool and was found by George Anthony. He said Casey Anthony acted with no apparent remorse following the death of her daughter due to emotional issues stemming from years of sexual abuse at the hands of her father.

George Anthony denied both claims against him on the first day of testimony in the trial.

Prosecutor Jeff Ashton said he wants the jurors to smell the cans of evidence that contain a piece of carpet taken from Casey Anthony's trunk during rebuttal. The cans apparently still carry the scent from her trunk that several people have testified was that of a decomposing body.

Perry said that the cans will not go back to the jury during deliberations and they will not be allowed to smell the air samples.

CSI Alina Burroughs, previously testified about photos she took of Casey Anthony's clothes during the execution of a search warrant at the Anthony family home.

The state entered into evidence several photos taken by Burroughs.

The state entered into evidence George Anthony's suicide note.

At the conclusion of the day a court spectator was found guilty of contempt for showing his middle finger toward Ashton. He was sentenced to six days in jail.

The state is expected to continue with its rebuttal case on Friday and closing arguments are expected to be held Saturday.

Prosecutor Linda Drane Burdick said the state also plans to call an executive from Gentiva, the company Cindy Anthony worked for in March 2008.

Cindy Anthony has testified that although her work records indicate she was at work when searches for chloroform were made on the family computer in March, she had actually left work early. She said as a salaried employee, she did not punch a clock and the records were not always accurate.

The state wants to prove that Cindy Anthony was at work when the searches were performed, but the defense argued that bringing in additional work records goes against Perry's decision that all documents should be turned over to the opposing side and would be a discovery violation.

Burdick said that although Cindy Anthony did tell her about some computer searches, she did not realize she would dispute work records that extensively.

Perry ruled that the defense could have the rest of the afternoon Thursday look over records from the Gentiva executive, but that the state could present Cindy Anthony's work records during rebuttal and they were not in violation of discovery rules.

Earlier Thursday, Baez asked the Anthony family was questioned about pet burial traditions.

Cindy Anthony was then called to testify about the death of the family pets.

Cindy said the first two dogs were buried wrapped in black plastic and tape, which is how they were prepared by the veterinarian.

A family cat was buried wrapped in a towel, then a plastic bag and wrapped with packing tape.

Cindy said tape was used to make the bags more compact.

In cross-examination, Cindy Anthony said her children were aware of the family pet burial tradition. Burdick asked her if any of the pets were killed using chloroform, or cut tape over their mouths. Cindy Anthony said no.

Baez played a brief Local 6 archive video depicting Henkel brand duct tape at a Caylee search command center in the parking lot of a Publix on Chickasaw Trail. The same brand tape was found on Caylee's skull.
Baez asked George Anthony about the video. Henkel is not a common brand of duct tape. It is manufactured in Ohio.

The same brand duct tape was found in the shed at the Anthony family home.

Krystal Holloway said she met George Anthony at a tent during the search for Caylee Anthony in October 2008.

Holloway testified that she developed an intimate relationship with George Anthony and that he came to her home around a dozen times.

Holloway said that during a conversation about Casey Anthony around Thanksgiving 2008, she said George Anthony told her Caylee’s death was an accident.

“He said it was an accident that snowballed out of control. I was in shock. By the time I looked up, his eyes were full of tears. I didn’t elaborate. I didn’t ask him anything further,” Holloway said.

Holloway said she provided investigators with her cellphone and letters George Anthony had written her. She said she lied to investigators about the affair at first because she was embarrassed, but she eventually told them the truth.
Holloway said her relationship ended with George after Caylee’s remains were found in December 2008.

Holloway said she was paid $4,000 by the National Enquirer to tell her story .

Prosecutor Jeff Ashton accused Holloway of sensationalizing her story to make more money. He accused Holloway of seeking out the Anthony family because they were well known after Caylee was reported missing.

Ashton pointed out that George Anthony never told Holloway he was present when Caylee died by accident.

Perry told the jury they could not consider Holloway's statements as a reflection of how Caylee died. He said Holloway's testimony can only be considered as evidence that George Anthony had lied about their affair.

Holloway said she is also known as River Cruz.

On Wednesday, a grief expert Sally Karioth who never interviewed Anthony, laid out a hypothetical scenario with facts from the case, she testified it wasn't inconsistent with grief she's observed in similar situations. Karioth previously testified in the South Carolina murder case of Susan Smith, who was convicted of drowning her children.

"Young adults are reflective grievers and will often act like nothing happened," Karioth said.

Casey Anthony: Why didn’t she testify? WKMG points to sidebar
Caylee and Casey Anthony, George and Cindy Anthony, WKMG — posted by halboedeker on June, 30 2011 6:46 PM

Casey Anthony’s decision not to testify at her murder trial surprised many people today.

WKMG-Channel 6 investigative reporter Tony Pipitone found a possible explanation in a sidebar from last Friday: a discussion about Casey’s criminal activity.

State Rebuttal Over, Closing Arguments To Be Held Sunday
Court will not be held on Saturday.

"Snip" Updated: 9:58 pm EDT July 1, 2011

ORANGE COUNTY, Fla. -- The state began its rebuttal on Friday with testimony from a lawyer from Gentiva Health Services, the company that once employed Cindy Anthony.

Gentiva Health Services Chief Compliance Officer John Camperlengo was the first witness called Friday and answered questions about Cindy's work history during the week of March 17, 2008. Judge Perry called a morning-long recess before jurors entered the courtroom so the defense could take depositions of prosecution witnesses.

Cindy testified that she had run computer searches for the term "chloroform" while looking up information on chlorophyll. Prosecutors have contended that Casey made the searches as she plotted to kill her daughter 2 yr old Caylee Anthony. Cindy's testimony was a surprise to prosecutors.

Baez said prosecutors had failed to disclose all the information a computer expert and forensic anthropologist planned to testify. Baez wanted the evidence and witnesses to be excluded, but Perry only gave him the option of taking their depositions.

"There are real problems and then there are imaginary problems," said Perry. "I will give you all the time that you need, but if I find out this is an imaginary problem...because these folks are ready to return to their homes."

The witnesses were on the prosecution's rebuttal list.

Experts said defense attorneys may have left lingering questions and failed to deliver on promises they made at the outset to explain how Caylee died.

Work Records Contradict Cindy Anthony's Search Testimony
Anthony, 25, Could Face Death Penalty If Found Guilty

    UPDATED: 6:57 pm EDT July 1, 2011

Both sets of attorneys asked for a day off to prepare closing arguments, which will begin at 8:30 a.m. Sunday.

Judge Belvin Perry issued a court order Friday afternoon detailing the rules for closing arguments. http://www.clickorlando.com/download/2011/0701/28422020.pdf

Closing arguments are expected to last all day. Deliberations could begin Sunday evening.

Earlier this week, Cindy Anthony testified that she had performed searches for the word "chloroform" from the Anthony family computer in March 2008, even though records indicated she was at work. She said her records did not indicate that as a salary employee, she would sometimes leave early to avoid overtime.

Camperlengo testified that Gentiva keeps detailed email records for employees and that each employee has a unique network ID .

    Camperlengo presented records for Cindy Anthony's log-in times on March 17, 18, 19, 20 and 21, 2008.

The records indicate Cindy was at work, at the same time the search for "chloroform" took place on the computer at the family's home in east Orange County on March 17.

The records showed Cindy Anthony logged in to her work desktop computer the mornings of March 17 and 21 and logged out each day after 5 p.m.

The searches for chloroform on the Anthony family computer took place from 1:43 through 1:55 p.m. on March 17, 2008, and from 2:16 p.m. through 2:28 p.m. on March 21.

The records indicated that there was activity on Cindy Anthony's computer the afternoons of March 17 and 21.

Cindy Anthony vigorously shook her head in the courtroom during Camperlengo's testimony.

The state argues that Casey Anthony used chloroform on Caylee Anthony, and that action shows premeditation in Caylee's death.

The state then called Cindy Anthony's supervisor at Gentiva, Deborah Polisano.

Polisano said Cindy Anthony would be unable to access her work account from home.

Goldberger said he came to Orlando to take samples from Caylee’s remains, including strands of hair and hair mat from the toddler’s skull December 2008.

Dr. Michael Warren, said there is no protocol or best practice in his field requiring a medical examiner to saw open a skull in a skeletal case.

“In the field of forensic anthropology, when we’re presented with a human skull, there’s no reason to open that skull,” Warren said.

Warren said sawing open a skull is unnecessarily invasive and there are other ways to examine the interior of the skull.

OCSO computer forensics examiner Kevin Stenger testified that there was no search for “chlorophyll” on the days that searches for “chloroform” were made.

Cindy Anthony said her search for chloroform stemmed from a search for “chlorophyll” .

Stenger also confirmed that there was a specific Google search for "neck breaking." Cindy Anthony said the record of neck breaking could have come up due to a pop-up ad of a skateboarding video she remembers seeing.

Sandra Osborne said, she only found one reference to chlorophyll, and it was in a dictionary file.

Lead Detective Yuri Melich was called and was presented with the home phone records for the Anthony family that he previously testified to, as well as Cindy and George Anthony's cellphone records from June and July 2008.

Court will resume Sunday morning for closing arguments.

Perry instructed the jurors they they would return to the courthouse Sunday morning to receive instructions and hear closing arguments.

Defense attorney Cheney Mason brought up the defense's multiple motions for mistrial. Perry quickly denied any motion for mistrial.

Perry also quickly denied Mason's motion for acquittal and recessed court until Sunday morning.

Baez said the state had failed to disclose all the information to which a computer expert and forensic anthropologist planned to testify. The witnesses were on the prosecution's list.

"These folks are ready to return to their homes," said Perry, referring to the jury, which was not seated during the aforementioned arguments.

On Thursday, the defense rested without calling Casey Anthony to testify.

Casey Anthony: Won’t you please stop saying that, Nancy Grace?

Caylee and Casey Anthony, HLN, Nancy Grace — "SNIP" posted by halboedeker on July, 2 2011 10:57 AM

On her show, Grace stuck to her I’d-lie stance: ”Then I guess I’m going straight to hell because I would do it. I know I would do it.”

Grace cited her twins, again, as a reason she would lie. But Horowitz, to his great credit, set her straight.

“All you’re saying is that you care so much — you would die for your children,” Horowitz said. “But lying for them is not going to benefit them. You tell the truth and hope that people on the jury have mercy on your child’s life. You don’t lie to them. You would not lie. You just feel strongly that you would defend your children. There’s a difference.”

I hope Grace will take that idea to heart — and refrain from that I’d-lie-for-my-children speech, which some Grace fans might take seriously. It’s the wrong message to send. Just look at what happened to Cindy Anthony.

What will happen Sunday in the Casey Anthony trial?
What happens after Casey Anthony's defense team wraps up?

"snip" By David Fussell, Legal Expert
Last Updated: Saturday, July 02, 2011 1:47 PM

Closing argumentsAfter the jury instructions are read to the jury, one attorney for each side will be allowed to stand up and make a closing argument. Lawyer’s refer to the order of the argument as the state having the “sandwich” because the state gets to wrap its arguments around the defense’s argument.

Jury instructionsAfter both parties finish their closing argument the judge will read the jury instructions agreed upon at the charging conference to the jury. Each juror will also be given a copy of the instructions.

Jury retiresOnce the jury is instructed on the law, the judge allows the permanent jurors to go back to the jury room. All alternate jurors will either be dismissed or the judge will keep them separate from the 12 permanent jurors while the permanent jurors deliberate.
The jurors do not know which jurors are alternates until the judge separates them as the permanent jurors retire to deliberate.

The first job of the jury is to select a foreman. The Foreman is similar to a chairman of a committee, her or his vote does not count anymore than any other juror. The foreman is in charge of organizing and chairing the deliberations. The jury remains in the jury room deciding the case, until one of two things happen as to all charges. All 12 jurors reach a verdict on each count, or they determine they cannot reach a verdict on each count, after deliberating and trying their best. A verdict can be either guilty or not guilty.

The jury is not responsible for determining whether Ms. Anthony is guilty. The jury may reach a verdict on some counts or charges and not reach a verdict on others. On any count the jury cannot reach a unanimous verdict, the jury is said to be “hung” on that count and a mistrial will be granted as to that county.

SentencingA. If Ms. Anthony Is Found Guilty of First Degree Murder: There will be an additional phase of presentation of evidence.

During the penalty phase the state will present evidence and argument on what is referred to as “aggravators.” Aggravators are reasons which Florida law allows a jury to determine that the facts of the case are so bad that Ms. Anthony should receive the death penalty. The death penalty in Florida is not to be imposed in all First Degree Murders. Instead it is only to be imposed in the worst of the worst First Degree Murders. The aggravators only include the reasons included in the Florida Death Penalty Statute.

During the penalty phase the defense will present evidence and argument on what is referred to as “mitigators.”

After the evidence is presented in the penalty phase each side will have the chance to argue whether the death penalty should be imposed. After the argument the jury retires to the jury room again, and decides whether they will recommend to the judge that Ms. Anthony be sentenced to death. Again the jury does not have to agree and the penalty phase verdict is reported out by how many voted for death and how many voted against. If more than six vote for death there will be a sentencing hearing at a later date at which both sides can again to the judge alone whether he should impose the death penalty. While the judge has to consider the jury’s recommendation on the sentence, the judge is the one who decides to impose death.

    B. Ms. Anthony is found not guilty of First Degree Murder:

"ORLANDO, Fla.—After part one of Pam Plesea’s exclusive interview ran in this paper, she then followed it up with an appearance on HLN’s “Nancy Grace” show and started backpedaling part of her story, however I have documentation on everything that she reported to me, and so does the famed author Kathleen McKenna, who has been aided extensively in her book by Plesea, who is a retired English teacher and the aunt of defendant Casey Anthony"

"Plesea told Canyon News, “The last time I saw Casey was in the summer of 2001, when Shirley rented a condo on the beach to celebrate her and dad Plesea’s 50th Anniversary of being married. Casey sulked and sat inside an entire day under a blanket on the floor and refused to go out on the beach with the rest of us. She was 15 at the time, and she was a spoiled brat. "
