As long as the neighbors' bin is at the curb, there is no expectation of privacy. But that goes double for BK's trash at his neighbor's curb. Which is where I believe the father's DNA was retrieved.

Now if the neighbor's trash were not yet to the curb, but was still within the neighbor's scurtilege (a new term to me which seems to mean on the neighbor's property as opposed to the city-owned strip along roadside (including the curb)), then anything found in it could not be used against the neighbor.

IANAL but I expect the prosecution's argument in such an event would be that although the evidence recovered from the bin on the neighbor's property could not be used against the neighbor, it should still admissible against BK. After all, BK has no expectation of privacy in litter he basically dumped on the next-door property.

Other posters--more dedicated than I--have been reading PA case law and perhaps they will correct my assumptions here.

In CA, where I live, and in FL, where I grew up, there is a strip of land, between your house and the road, that belongs to the public. The homeowner must maintain it, but has few rights as to its use, including no expectation of privacy. Our city water co. installed a large housing for their equipment on the strip directly in front of my house, chose the location and color without consulting us. Anyone can park in that strip along the road (as long as they don't block my driveway), but let a weed pop up there and I get a $100/hr. bill from the City.
That is 100% logical and makes complete sense to me. However, I keep being slapped by the fact that the law is clearly not always logical, so I wouldn't be at all surprised if it turned out that it can't be used against anyone if it's in that scurtilege zone. smj
 
People commented on him looking optimistic, like he knew of good, not-yet-public developments, after a couple of December press conferences, if I recall correctly.
If the first part of that multi-part article in Airmail.com, Blum states that the Chief thought the abandoned Elantra found in Oregon was going to break the case. If his reporting on that point is accurate then, as late as December 20th, they didn't have a solid suspect.

I do think part of the reason we have that "glitch" (I love that) is the missing time between the murders and the 911 call and four hours that passed between the time the 911 call and the time officer Payne arrived on the scene (4 PM per the PCA). The swiftness of the gag order and the notes that revealing some of the information may endanger someone(s) adds to the intrigue.
I don't see anything suspicious about that at all. In a scenario like this not everyone will immediately go to the scene. Detectives have to be at the office to conduct formal interviews of the witnesses and someone has to obtain the search warrant. It is absolutely common for detectives to not begin processing a scene until hours after a crime is discovered.

I did not use the word suspicious on purpose, because that is not was I was saying or suggesting. That time gap is just part of a larger, interesting picture made more interesting by many other things.

I don't look at the delay in calling 911 as a glitch or anything nefarious. We can't judge someone's actions with the benfit of hindsight and there is no indication that they would have believed that they would wake up to find their roommates slaughtered.

Perhaps you know more about LE protocols than I do but when my family member was murdered, officers in patrol cars were the first to arrive (as is standard with most 911 calls), followed by crime scene analysts, a coroner (who has the authority to classify a death as suspicous and order an autopsy) and behind them come the people who start the investigative ball rolling (detectives). Not everybody arrives at a crime scene at the same time in order to protect the integrity of a crime scene.

The swiftness of the gag order was very likely originally put in place because of the overt hostility toward the survours and some that the armchair sleuths felt were suspects. A fair trial happens in a courtroom, not in social media and some of the social media sleuths were taking things way to far and in my opinion, endangered the lives of several people, as well as wasted LE resources with press conferences 'clearing' certain people. Ex boyfriends, people at the food truck, roommates and 'Adam' were just a few people who were endangered by social media doxxing.

I will not speak for that poster, but I will say that I did not consider any of it to suggest nefarious or suspicious activity, nor is there an attempt to judge anyone (by me).

However, yes, reasonable people can judge everyone involved based on what we know. Judging them does not always = doxing, threatening or intent to harm nor is it always posted.

I hope that our judgments, suspicions and general thoughts are fluid, based on facts as they are presented. We should be able to have open conversations in this place, within forum rules, based on our opinions and again, known facts. People who take things too far are in their own category and don't apply to the general population of us here to read court documents, examine photos and engage in civil conversation about our thoughts.

I've always read voraciously and loved to learn.

I think a part of why this case grabbed me and held on is that these young people half my age were all in the process of achieving something that I'd always been told was going to be part of my life, and then... it just didn't happen. And I've tried further education since, and it's always led to a catastrophic decline in my mental health. I eventually came to the understanding that formal higher education wasn't right for me.

So instead, I Fight Crime! XD

(And bore the pants off anyone in the threads who doesn't get excited by the history of and science behind footprints, blood, tool marks, etc. etc.) :D

Well I think you've found something that really suits your skill set. It really is a fascinating topic - I hadn't realised just how fascinating it was until I started immersing myself in the posts for this tragic crime. I'm really glad that all of us Websleuthers can benefit from your knowledge and research abilities. (PS I haven't been bored by any of your posts).
This is very sweet. Both of you.

School isn’t for everyone. Sometimes its constraints are too limited. Or, there’s just innumerable paths.

Just a historical example, a short answer of the outside of the box… (there are of course examples with much more inclusivity)


iamshadow, your forensic detail knowledge is really impressive. Excellent writer, too.

O/T. When I joined WS, (in midlife) a MP case drew me in. But what really fascinated me was forensic art. To give back the identity of the unidentified. This happened where I live. After 24 years of just a head being found on a nearby golf course, a forensic artist recreated the woman and that led to the break in the case. And her identification.

So, isn’t it the spark of passion and interest that is the education? Sometimes the path is not a road with known guideposts. Trust the passion I say.

As for this case, I am most curious about the forensics. All kinds of forensics. We’ll find out more in June. The detective work by multiple agencies is so elaborate. And the technological advances are stunning.

Really enjoying everyone’s input and discussion, and the verified professionals, too, on this case. It’s a full discussion.

I’m lurking mostly because I know how gripping a case like this can be. And it is about a horrific, horrendous tragedy that sleuths worldwide can relate to, can empathize with.

Shout out to WS for building such a big interesting base of thinkers.

I think that people are just reponding to some of the things you mention in your post where you speculate about why you have the feeling of glitch? REsponses are part of open discussion. You mentioned the timing of 911 call, the timing of the arrival of Officer Payne at the scene and the swiftness of the gag order. I read the responses as others expressing their opinions as to why there are ways to look at the matters you raised that make sense in the wider context of the history of this case. I responded earlier re Offcer Payne. I see the swiftness of the gag order as mostly to do with trying to ensure a fair trial amongst the intense publicity and speculation (including unregulated social media) that has surrounded this case. There is a ton of info at the Idaho Courts page, many documents where the gag order is addressed and arguments for it presented. We are all expressing our opinions here and exploring how we arrive at them and ofcourse those opinons are fluid and may change as outside events develop and individual inner understanding and knowledge change over time aswell. MOO
 
That camera is on the front of the neighbors house and faces away from the victims house. I have never thought it could pick up someone falling in that house, IMO it something outside possibly the killer slamming his/her truck after stashing clothes and the murder weapon in there MOO IMO

Exactly...back to my thoughts above. IF it was so sensitive that it could pick up a fall in a house behind them with the camera speaker not even facing that property it would pick up car noises, the wind, birds, parties, peoples intimate situations and every other sound. The recordings for the home owner would be loud and distorted, and worthless. IMO MOO no way the thud came from inside 1122

Same here Dotta a cash tip and a personal thank you, plus I personally dont want my food left outside unattended for even a couple of mins.

The killer may have been inside the 1122 House when the security camera picked up these sounds at 4:17. I think DM sees him just after the neighbor's security camera recording of distorted audio. FBI will clean that audio by removing unrelated noises.

I went to google maps to grab a screenshot of the house with the now missing camera [it was taken by police wearing a K9 jacket]. However, google has faded a large portion of the CS area. It was the gray house/white trim with the wire mesh attached to the railing.

I don't know about that... that hill looks even worse. Trees and scrubby plants and...bracken?, all quite close together, lots of wet dead leaves (a slippery nightmare), and the ground looks very uneven. Broken ankle territory, in the dark, with patches of snow. At least the approach from the front has gravel.



But yeah, I think, like my KFC order, she got an alert or a text, and either opened the door to the delivery person, or grabbed the bag from the front stoop. I think she got the bags directly from a person, just based on impressions of how things were worded around the delivery driver and the delivery. I think he literally saw Xana, and either handed her the bag or saw her open the door to take it. But it's just my impression, as are my ideas about the ankle breaking nature of deliveries in dark, uneven territory, so it should all be considered MOO.

The area where a car can park is to the right of the patio (Queens Rd) and isn't pictured in either of those. Take a look at the photo I posted before.

Those pictures make it look like a hill, when in fact, there's a road/driveway that goes up past the patio (the police car is parked on it and it continues up past the patio. If a person wanted to rise from one of those two chairs sitting off the patio, and walk down to the police car, they wouldn't have to go on over the rocks. The police do it in one of the bodycams.

And the DoorDash driver was carrying merely a bag from JitB, which to my knowledge packs nothing breakable in their sacks. My point is that if the DoorDash driver had been there before, as is likely, they knew how to get to the back slider. I bet there were many orders during parties and the parties utilized all of that back space (and its parking. The house used to face Queens Road - when the current back patio was the front entrance.


DoorDash drivers go up to second and third floors in buildings, if that's what people request. That little walk from the "driveway" to the back patio has been traveled by many a footstep.

IMO.

BBM: I have to ask so that I can stop trying to find the camera I'm thinking of (attached to the top of a wall or a gutter, not the one near the doorbell) so,please, can you direct me to a source that confirms/shows that the camera (either the one near the door or another one) was taken by police wearing a K-9 jacket? Thank you!

Thank you @gliving! Not the one burned in my memory (it was silver/metallic, not white, and somewhat skinnier) but so appreciate you taking the time. I may well have the location of the camera I'm thinking of confused though, perhaps it was not mounted on the house immediately N/W of the west wall of XK's room. MOO
 
I'm not sure what Nancy Grace said--or was thinking, but Ring cameras are not activated by sound.




The neighbor's Ring camera was triggered by motion--maybe a cat, but not likely. They have sensitivity controls that typically only detect larger moving items, like humans. That keeps them from being triggered constantly.

So, there's something we're not hearing about the Ring audio--such as it has a video to go along with it.
Just wanted to say one of our neighbors has a cat that roams around and this cat frequently triggers our Ring camera. The corresponding chime drives our dog nuts.

Additionally, we’ve had spiders and other typically long legged bugs trigger our Ring camera when they crawl on and across the camera itself. This actually happens quite a bit at night!

All this on the default motion sensitivity settings.

Just my experience.
 
the interesting part is that the name of the dropbox account is redacted. if it were BK or a victim, it would not be redacted. so who had what in a dropbox account? certainly evidence from other warrants would not be delivered that way, and even if it were, if it were a known source, it would be named.

I just went down the rabbit hole, LOL! Please help me climb back out!

I was watching a Hughes video about the missing time before his cell phone was picked up near Blaine, ID 30 minutes after the murders. This was the 15 minutes missing after he left Moscow but before he was picked up south of town (near Blaine ID) when he actually turned his cell phone back on.

It is VERY rural there with a few houses and some businesses but at least by Google Earth, it looks like there are several places he could have stopped at 4:30 in the morning to ditch the knife, his clothes, etc.

There is only one small creek crossing Rte 95 during the blackout time period. There are a few rural dirt roads that would occur after turning off Rte 95. This are prime spots of interest to me.

I could post screen shots of these locations but it shows some identity for homes and businesses so I will not post that for fear of violating WS policy.

My point is that if he ditched the knife or even changed out of his Dickies coveralls, I think there could be evidence if LE had had the resources to do a few searches in targeted locations off 95.

Unless he just stopped the car and tossed the knife into one of the adjacent fields... but he wouldn't change clothes on a main road even if 4:30 am so i really think he pulled off the main road somewhere to account for this missing time.

I think he pulled off one of these dirt roads and I could count less than 5 places I think he would have done it at.

If I lived there, I might do my own search.

This presumes LE has not done a search of these areas already. For all we know, they may have done a metal scan by drone and have located the knife. The FBI has a lot of resources.

The killer may have been inside the 1122 House when the security camera picked up these sounds at 4:17. I think DM sees him just after the neighbor's security camera recording of distorted audio. FBI will clean that audio by removing unrelated noises.

I went to google maps to grab a screenshot of the house with the now missing camera [it was taken by police wearing a K9 jacket]. However, google has faded a large portion of the CS area. It was the gray house/white trim with the wire mesh attached to the railing.

While I cannot say whether Google blurred the area or not, I would like to say that we y'all have the option to blur your own homes out on Google maps. I did this myself years ago for security purposes.

Hope this info is helpful and still relevant as I did it years ago.

  • First go to google maps and enter your home address
  • Enter into street view mode/dragging the yellow human(person)-shaped icon located in the bottom right corner of the screen onto the map in front of your residence.
  • Your residence is in view, click “report a problem” in the bottom right corner of the screen.
  • Center the red box on your home and choose “My home” in the “request blurring” field.
 
Did I miss where it was confirmed that the Walmart receipt and Dickies tag were definitely for a pair of Dickies coveralls? I know many were hypothesizing that he would have worn a coverall type thing to make for quick clean up, and then with the Dickies tag it became known that Dickies does make a work coverall thing.... but was it ever confirmed that the Dickies tag was for a pair of coveralls?
