TODAY: Bryan Kohberger’s attorneys will argue to get the death penalty off the table. They say that it’s outdated and unconstitutional. Kohberger is accused of killing University of Idaho students Madison Mogen, Kaylee Goncalves, Ethan Chapin, and Xana Kernodle.

And just replying to myself to note according to latest order Judge will hear argument first thing regarding allowing testimony of the D's witnesses. I thought he might make that decision prior to the hearing based on written submissions but was wrong. Given those witnesses will testify via zoom if permitted, and assuming they're fully cognizant of the situation, this makes perfect sense and seems the fairest course of action. Jmo.Fantastic. All I know is from watching true crime defendants are still getting sentenced to death. IMO I don't believe either of those (outdated or unconstitutional ) are good enough arguments against the death penalty. we shall see.Whether it is outdated is clearly a matter of opinion.

This is first time I've ever been exposed to a death penalty trial so no knowledge. But according to our @Cool Cats is standard defense procedure to challenge the DP when it is being pursued by the state.Never minding how any one of us might feel about the death penalty, is this the right time/venue for challenging it?
In States that have eliminated it, how did that come to be?
If she's successful, this will become the new case law, right? BK v. The State, overturning the DP?
Just feels like a hard veer for me, to have a trial within a trial over whether the DP is [all the things she claims] when, IMO, the DP is legal in the State in which the crime occurred at the time it occurred.
Is this how it's done or is she sidetracking the trial?
