Just went out to find more sources after reading your post. I stand corrected.

I rarely ever visit any Murdoch or formerly Murdoch owned news sources. This is a great reminder of why.

Thanks for pointing me in the right direction!
Sorry if I came across badly. Always enjoy your thoughtful posts. I was probably seeing red cos Daily Mail sensational headline.

@AllisonMartTV

TODAY: Bryan Kohberger’s attorneys will argue to get the death penalty off the table. They say that it’s outdated and unconstitutional. Kohberger is accused of killing University of Idaho students Madison Mogen, Kaylee Goncalves, Ethan Chapin, and Xana Kernodle.

As far as I know the death penalty is neither outdated nor unconstitutional.

Fantastic. Judge Hippler is supremely organised and on top of things. Moo
And just replying to myself to note according to latest order Judge will hear argument first thing regarding allowing testimony of the D's witnesses. I thought he might make that decision prior to the hearing based on written submissions but was wrong. Given those witnesses will testify via zoom if permitted, and assuming they're fully cognizant of the situation, this makes perfect sense and seems the fairest course of action. Jmo.

Really like the way judge has mapped out the entire hearing.

Attorneys and experts will discuss the death penalty today in Boise at a hearing in the Bryan Kohberger case. Starts at 8:30 a.m.

First order of business is whether Kohberger can wear street clothes at public hearings. Ten items on today’s to-do list. Potential death penalty method to be discussed.

Never minding how any one of us might feel about the death penalty, is this the right time/venue for challenging it?

In States that have eliminated it, how did that come to be?

If she's successful, this will become the new case law, right? BK v. The State, overturning the DP?

Just feels like a hard veer for me, to have a trial within a trial over whether the DP is [all the things she claims] when, IMO, the DP is legal in the State in which the crime occurred at the time it occurred.

Is this how it's done or is she sidetracking the trial?

JMO

This is first time I've ever been exposed to a death penalty trial so no knowledge. But according to our @Cool Cats is standard defense procedure to challenge the DP when it is being pursued by the state.
