IF we get underway tomorrow, and I think we will... then they have jury selection and then what is the order of things? Is the hearing about a field trip to the scene up first?
 
I need to say this again. The value of that video cannot be discounted.

It pinpoints the exact time and exact location of the abductions and it captures the likeness of the abductor.

That is startling, it is heroic and IMI it will be convicting.

100% and the man accused doesn’t have a alibi for the time in question.

And any desperate attempt to try and change the time frame of the murders will fail spectacularly and come across as utterly desperate. I mean their other attempts Odins and tree letter writing also went down like a lead balloon.

I'm leaning towards this, tbh. I believe that the improper handling of discovery material tipped the scale, IMO, but I am not a fan of her in chambers handling or the draconian rules when it comes to the information she releases.

The improper handling is still undecided, afaik. IMO based on viewing other attorneys' bad actions, I don't expect any actions to be taken against B&R. Especially Rozzi... he wasn't involved on the MW issues.

This is my brief summary from the March 18, 2024 Contempt Hearing:
Long-time attorneys John Boren, Kay Beehler and Andrew Maternowski testified for the defense. They stated that the war room practices done by B&R are common practices. There were 8 more attorneys who signed affidavits for the defense, among them are Joel Wieneke and well-known Thomas Leatherman out of Elkhart Co., IN.

Clearly, I did not say that. I said the definitions were different.
However, the general public does not read the Supreme Court's definitions, they just go by what their understanding is. IMO

I think it's just a human reaction. In cases where I have experienced the Judge make a number of rulings I felt were wrong, it is natural to feel the Judge must be biased. But of course that isn't grounds to remove a Judge. Which is really the problem here. Otherwise Judge's would be sacked off left right and centre!

Testimonies by other attorney buddies about character references doesn't hold much weight with me because they know nothing about the Delphi case incidents first hand. Testimony under oath by AB, MW, their staff and youtuber BW would hopefully get to the heart of the deeds. That's a lot of subpoenas and Taking the Fifth. Maybe at some point in the future it will all be under review. Unless the Defense wins RA's case, then they'll be Rock Stars of the Bar! ;)

You're right.

If I was a juror on a case where there was solid evidence, I probably wouldn't think much about bias. However, on a case like this, where I'm in doubt, then my perception of bias would probably influence my opinion. It would have nothing to do with the SC but everything to do with my finding of innocence or guilt.

Your making a argument that's not there for me.

My point was if the jurors think she is treating one side differently than the other, it might influence their decisions. Regardless of the LEGAL definition I think it's really important for judges to appear to be neutral in the eyes of the public.

The Judge has been neutral and unbiased. So sayeth the SCOIN.
I am certain she will remain that during the trial.
The reason she has ruled many times against the defense is because their motions have been deficient by law, or by truth.
On spelling errors alone, they probably should be disbarred. That’s a joke, feel free to laugh.
The defense totally owns all their DENIED motions.

I can't believe it's common practice, when charged with keeping safe and confidential child murder scene photos, keeping such sensitive materials in an unsecured and unmonitored room, just out in the open for anyone to steal, copy or reproduce. That shows such negligence to me, very upsetting. JMO

Thanks for all these. These are all of the available ones.

We are still waiting on the transcripts of Detective Vido, Click, Murphy and BH's ex-wife.
 
On this eve before jury selection starts, I just wanted to mention that a group of average citizens are about to have their view of the world totally changed. They will willingly come in to do their civic duty and they will see and hear things that will forever change them. I pray for them to have strength to process what they hear and see. And also for the families that will finally come face to face with (who I believe is) the evil that took their daughters from them. They will see all the horrific things that were done to them and have to relive those days all over again.

These jurors will be tasked with determining if the evidence presented is enough to convict RA BARD. They will be sequestered away from their own families for all these weeks while they learn about the very real evil that exists in the world. I think child murder cases are likely some of the most difficult cases. The pure innocence of Abby and Libby in life and in their day walking on the trails... just shattered. I don't think we even get the full grasp of it just watching from the outside. We know it's horrific, but these jurors will KNOW it.

The day is finally here and while it's good and it's what we've all been waiting for, it's going to be hard for us too when we finally really hear exactly what was done. These things are usually worse than we even understand and I don't doubt this case will be exactly that. Horrific.

Don't forget to take care of yourselves also during this trial. We are all human and while we all feel different ways about what has transpired, what each side has done or not done, etc.. we have to be prepared to actually know the details too.

And I would hope it would be reasonable doubt not just some small doubts because of the speculations that have flooded this case from the start. That's what I worry about the most, that the jurors will be levelheaded, think realistically, and contemplate whether their reason is plausible considering only the evidence...not suppositions. AJMO
Praying for such people to make the jury <3
