1:40 p.m. The case has gone to the jury and the jury is currently in the process of choosing a foreman.​


Here we go, gang… nothing to do now but refresh Twitter/WS and gnaw my nails till we have a verdict. Been a long, long, 7-almost-8 years
 
[Prosecution rebuttal before the case went to the jury]

Court is back in session at 1:07 p.m.

McLeland begins his rebuttal to the defense’s closing argument.

He says it’s been a long 3 or 4 weeks, that now it is time to hand the case over to the jurors. He tells them “you’re in the driver’s seat.” “I’m not up here to tell you how to feel.”

McLeland says the defense did not back up their claims, that the prosecution has witnesses on the trail that day and that they simply reaffirm that Allen was there.

He tells the jury that witnesses after the murders on the high bridge do not matter.

McLeland points at Allen and says he used a gun to scare them. He says Libby had a “blood outline” of a tear on her face.

He tells the jury that Oberg’s testing was verified, that it links Allen to the crimes.

News 8’s Kyla Russell says Allen is extremely engaged and looking at Baldwin with disbelief.

RA doing the mental math now and realizing he’s been led down the wrong path by the defense.

That audio was of poor quality and it is simply too short to make a definitive conclusion of whose voice it is. That’s not the point though. The point is that audio came from the man in the video.

No argument there - true, it is the man's voice on that video from what we have been lead to believe and what was released publicly.

However, it is also true that not one person ever recognised it as Richard Allen's voice in the 5 years before his arrest nor did anyone ever point a finger at Richard Allen.

A man who worked in a job that dealt with the public daily.

Have always hated the "mushroom hunting" explanation as anyone local knows March is the earliest with April being the best time. I have a hard time believing he was hunting in Feb.
He said he was there that day to watch fish, but that he did mushroom hunting at other times. He claimed he didn’t have his gun on Feb 13, but I think he said he took it with him on days he went mushroom hunting.

So… another coincidence. He goes there enough to be familiar with the area, and usually has his gun when he goes, but was there on Feb 13th and somehow that particular day did not have his gun. Hmmm.

That’s not true—for a long time there were tips called in all the time by people who thought various people were BG. They were checked out by the humans conducting an incredibly famous, sensational investigation.

The (non-video) lead on RA was misplaced in the shuffle, but that actually means that the state investigated a whooooole lot of other leads and tips before rediscovering the info on RA and focusing in on his story (where he placed himself AT THE SCENE, which corroborated the stories of other witnesses and allowed folks to deduce that RA is BG).

Good point. LE even flew out to Colorado to talk to a potential suspect. Remember how we all analyzed that person's gait from a video of him walking in court? He wasn't BG.

The video was blurry; the only thing to go on was the clothing.

No one who visited that CVS would have seen him in those clothes.

Claims he didn't have a gun but did. Claims he did have his phone, but didn't. Claims he went home to bundle up on an unseasonably warm day.

Oh, and he claims he killed them and then walked away to live his life.

Fair enough!

But no one called to say it was Richard Allen's voice and the only call that did come in about Richard Allen was from Richard Allen himself - just to let them know he had been to the trail that day.

[before Jury went out]​

2:03 p.m. Jury is given instructions.​

At 1:15 p.m. jury instructions began.

Judge Gull says the alternate jurors will be in the deliberation room, be engaged but will not participate. She says their decision must be beyond a reasonable doubt. She says the burden is on the state to prove that.

Gull says it is “not beyond all possible doubt.” She says that defendants are not convicted on suspicion. She tells the jury their decision must be unanimous.

She tells them if they are left with two interpretations, they must choose one that sides with innocence. She says they can take into account any bias the witness may have. She said they should believe the witness until they cannot with a good reason.

Gull says nothing she said during the trial should be considered evidence. She says there are no transcripts of the witnesses. She says there is nothing that was not admitted.

Gull tells the jury that during deliberation they must consult with reason. She says bailiffs will be outside the deliberation room. She tells them they cannot leave unless the full group is present. She says there is no mention of sentencing in the paperwork.

Gull says a foreperson will be chosen and will sign the verdict. Gull says the bailiffs took an oath that they will not communicate.

At 1:24 p.m. the jury leaves with instructions.

Judge Gull now lays out expectations for those outside the deliberation room. She says the attorneys need to be within 5 minutes of the court room.
