At this point, for future reference, I have attached the motion for clarification that I mentioned previously. Nothing new but interesting. Also attached is a subpoena request for two subjects: 1. Wayne Hunt 2. Chancey Smith

This will be useful to use to catch up with when the trial process resumes. Whenever that might be.

Ummm....wow. I graduated high school with Wayne and dated him (I'm old....this was a long time ago). We're still friends today. Just so weird to see his name here.

Dale County Circuit Judge William Filmore didn't immediately rule on what testimony jurors would be allowed to hear at McCraney's trial, set to begin Aug. 15. Defense lawyers asked the judge to prevent jurors from considering any evidence collected from the car where the bodies were discovered, saying the car has been crushed and is no longer available, preventing them from inspecting it.


So - looked it up - and yes he does have a hearing on Monday.

Hilton Green Beasley (17) & Tracie Jean Hawlett (17) (reported missing July 31, 1999, Ozark & found August 2, 1999 in trunk of car) - *Coley Lewis McCraney (25 @ time of crime/45/now 48) arrested (3/15/19), charged (3/16/19) & indicted (6/6/19) with 2 counts of 1st degree murder, 2 counts of 1st degree murder while in the act of murdering two or more persons & 1 count of 1st degree rape (Beasley). Plead not guilty. Held without bond. DA will seek DP.

Trial was set to begin on 8/15/22 has been postponed until 2023. Jury selection began on 8/8/22 & ended on 8/9/22 with not enough prospective jurors.

8/9/22 Tuesday, Jury Selection Day 2: There had been concerns about the prospects of finding an impartial jury, but those concerns deepened on Monday when only 75 of 250 summoned showed up. Quickly reduced to 58 for a plethora of reasons, the pool was whittled down even more during individual questioning of prospective jurors that centered largely on pretrial publicity. Eventually, the pool became too slim to empanel 15 jurors that is required by law, forcing Dale County Circuit Judge William Filmore to delay McCraney’s capital murder trial. Trial has been temporarily postponed until at least 2023.

I own property in another county - I had moved there and registered to vote when I took up residency. Many years later I married, moved and changed my voter's registration to the city in that county, adjacent but different. My brother, who lives at my old address, brought me a jury summons for that county. I called the courthouse (that I'd once been locked inside but that's another story) and explained that I no longer resided there, hadn't for years and was registered to vote in the adjacent county but I didn't want to get in trouble for not showing up. The sweet lady on the other end of the phone said, "It's okay, honey, that was probably from the bad list" and hung up. The "bad list". And, yes, this was/is Alabama.
 
Won’t happe. But it was appropriate to ask.

In reference to the bond hearing for September 8th. It has been requested by defense counsel to be rescheduled from the morning session to the afternoon session @ 1:30 p.m. cst.

No problem, should be no big deal. Motion granted in part by Judge Filmore.
I find the wording of the order a bit revealing of the judical oversight tightening in this case coming to bear IMO.
Read both and see if you can pick up what I am feeling if you would.
It is not unexpected. It has been a long road.

8/12/22 Update: Next status hearing or could be motions hearing on what evidence will be allowed in trial on 8/15/22. 8/15/22 Update: Among the reasons that a jury could not be seated to deliberate the fate of suspected murderer McCraney is because some ordered to serve have died. That is understandable because driver’s license information, used to choose prospective jurors in Dale County, is sometimes outdated. Some were excused because of unavoidable conflicts, others disqualified because they did not meet requirements & some summons returned marked undeliverable. Five in Dale County & two in Houston County are dead. Then, there are a few who neglected their civic duty which aggravates Woodall. Those who fail to appear for jury duty could face contempt of court charges.
8/17/22 Update: “(McCraney) is not a danger to the community, nor a flight risk,” his attorney David Harrison wrote in a motion he filed Tuesday. McCraney is asking for his jail release on bond. Dale County Circuit Judge William Filmore, Sr. has set a 9/8/22 hearing on McCraney’s latest request.
8/18/22: Defense Motion for court reporter to transcribe interviews. Specifically for Lt. Tommy Merritt & Rena Crumb on 7/1/22, Rena Crumb conducted 2/3/22 by Michael Bryan & interview of Dan Drive conducted on 3/19/29 with Chief Marlos Walker, Corporal Everett Evans, FBI Special Agent Heather Whalen & SBI Agent Barry Tucker. Order: Motion for court reporter to transcribe interviews motions-granted signed by Judge William H. Filmore. 8/22/22 Update: Defense requests the bond hearing to be heard in the afternoon @ 1:30pm-granted. If a jury can not be seated at next trial Judge Filmore will consider the motion for change of venue.

Okay, so he's been incarcerated, waiting for trial for just under 3.5 years, and without bond. What are the chances the judge grants that now? TIA
